“making nurses work overtime could cost people their lives.” “I’m a factory worker with heavy machinery, so really, the only life at risk is my own or my coworkers.” “Oh that’s fine then!” *cracks whip*
Everyone at my job got tired of mandatory overtime and most of us stopped doing it. Then all of the sudden mandatory overtime went away. It's as if they could not fire everybody or something. Just saying.
I dont understand how you agree to a schedule of say 4 days on 4 days off but then they add on call days every other week and mandatory overtime. Your days off go from 4 to usually 1 or 2. When a contract was signed that I got 4 off. How do they have ultimate legal discretion but employees who have the skill don't have any leverage. Missouri doesn't even require breaks from employers, so you also don't get that. I'm a worker, but I'm not a slave and I have a life. Companies need to hire more people rather than making people work 84 hours in a week. It's not an emergency on my part that they want cheap labor rates. The labor act that is nearly 100 years out of date, this needs to change. Even China doesn't allow unlimited overtime to be forced on their workers. Sure you may volunteer to work those hours or be asked but making it mandatory is tyranny.
I’m a healthcare worker and we use ADP for timeclocks. My supervisor can manipulate and adjust my time for missed punches. However, we also have a policy that overtime is allowed only if approved. So my question is if not approved are they legally allowed to remove OT from ADP so they won’t pay me. I mean we are currently short staffed, they are not hiring new people and work is pouring in non-stop. They asked us to finish the job but 8 hours is just not enough and mistakes are happening.
When my dad started working as a union plumber in the 1950's any time work out side of 8 am to 4:30 pm was double time. Now is all time and half except Sunday. It's cheaper to work people 60 hrs because healthcare is the same rate no matter how much they work. It's time to stop the bullshit. I for one think 40 hrs is enough. Make over time more expensive. Double time for all overtime and a living wage for all full-time workers!!! Some of us want a life. 32hrs would be better.
These laws protect business owners but not the citizens. If I get a part time job I should not be made to work full time hours the business should be responsible for hiring the necessary employees to cover the work load
I Live in VN and my manager hires a foreigner from Belgium and he treats us like slaves. Forcing us to do overtime against our will so that he can report well to the higher up. My solution: quit the job regardless of what they say about me. My life is not about work all the time
I’m a chauffeur and my hours vary each day, never a set start/finish time or amount of hours. I’m in California and was wondering is there a limit to how many hours I am legally allowed to drive? I have requested to not work more than 10 hour days, but I was told I have to work whatever they give me. Average driving most of the year is over 11-13 hours. Thank You
Im working overtime hours Friday, Saturday, Sunday, Monday, Tuesday Wednesday, which is the split in the pay period ends on Sunday, than im working during the whole pay period Monday through Sunday. Is this how managers cut back on overtime and not have to pay. Im tired of working through the weekends. Im thankful I noticed. Im looking for a new job.
Can an employer require it's employees to work 40 hours of volunteer hours per year that is paid if it's not in the my job description? Basically require us to do 40 hours a year and we are allowed to take time off during work hours to complete the 40 hours which would be paid. The issue is that I am a sales rep and when I take time off It can hurt my overall income.
@@JobAttorney Thanks, Doing volunteer hours reduces my ability to make commissions as I I would be doing volunteer hours that would keep me from working my normal sales job so I guess it's unfortunate if they can require this.
My employer is trying to get me to violate my DOT hours of service. They want me to leave out at 11pm. The company I arrive to won't open until 8am. It's a four and a half hour drive. Wait another 2 hours to leave than another 3 to 4 hours at my second stop. 2nd stop is 2 hours away also. Than drive back to my job 3 hours +. I told them that will violate my hours of service, which it has many of times. What should I do?
Can my job make the first shit work every Saturday and second works no Saturday just Monday threw Friday I'm in Texas is there a law that protects us against it
@Law Office of Vincent P. White no time in a half company of 5 employees so we're getting taken advantage of. We get paid straight cash for anything over 40hrs smh
Hello, can a federal Exempt employee be forced to work overtime? Can they be reprimanded for refusing, if only offer time off for hours worked? Thank you
How about someone that works for transit and has a union my employer told me it's an emergency and their forcing me overtime this is in New York also I have to write why I refused overtime
Wouldn't that just be standard time then? Maybe your job has unusual scheduling but in most places 40 hours a week is the norm and any more than that is considered overtime.
these laws, show you that slavery is not gone
That part

Can an Employer force you to work overtime? For some reason, every attorney that takes this question cannot give a straight answer.
Overtime isn’t even in my vocabulary. Lmao.
There is other jobs out there just saying can’t force to stay
Absolutely

If you send someone to jail....
They still aren't working...
So.. problem hasn't been solved.
They wouldn't send you to jail, they would just let you go. The government doesn't currently care if you work mandatory overtime, just the employer.
They forced me to clock out before my shift end😢

Don't violate your DOT hours, the employer definitely won't help you if the DOT comes for you.
The choice for employer is either ST or no time.

Texas is an at will state so probably.
Can an hourly auto tech refuse being forced to work overtime?
Hi my Job is only paying me 9hr for overtime I make 18hr shouldn’t I be paid 27 an hour for over time ?
Overtime should be time and a half
Why would you work overtime for 9a hour?.

Unfortunately, the fact that some one else is abusing FMLA won't change your dynamic with the employer.

Generally salaried employees can be required to work more than 40 hours in a 7 day period, although if things get too extreme that can break down.
@@JobAttorney Mr. White, what you do is awesome, I have subscribed to your post. Thank you Sir
What if youre a normal staff. And they are tryiht to force you to do unpaid overtime on a SUNDAY?
Unpaid overtime for hourly staff is always going to be a potential claim, speak with a local employment attorney.

If you have a union, then it depends on what your collective bargaining agreement says
