Expecting others to endure the dog barking all day for no good reason is not reasonable. The assistance animal owner has options, they can put their dog in doggy day care or train the dog to better deal with stress so that they don't bark so much. The property owners have a right to demand a solution to this issue.

I do not support special rights for ESA. Why not? I am blind. In recent years I have experienced riding the city bus and stepping in or sitting on dog crap left by an ESA. I can't begin to express how much I resent that. As a small time property manager I resent having to replace, at my own expense, all the carpet, pad and sections of sub-floor in apartments where an ESA cat has lived.
This article is misleading . My son brought back his Military War Dog or MWD from Afghanist. So let's be clear here a retired MWD is not a service animal but can be covered under an ESA because because they both have PTSD . It's a shame that the report wants to cookie cut. Some ESAs are essential

I have a psychiatric and medical alert and response service dog and she’s been nearly attacked on numerous occasions by pets in none pet friendly places. It’s not an inconvenience it’s a felony crime. People think it won’t harm anyone. It’s harming legitimate service dogs ability to get access to places were allowed. Also, we’re illegally asked for identifications, certifications, registrations and documentations. Also, asking for what disabilities we have or to show them what we have.

It even states that online businesses will try to make their certifications and registrations look legal. So the “certification” you claim to have is fake and a scam. Me and my service dog turned the corner in a book store and came face to face with a 100 pound german shepherd that instantly went into attack mode. He didnt grab my dog but he was out of control. The man kept using german commands (which is typical training in attack dog work) and had no vest on the dog. We told the manager and the manager said “Well he said it was a service dog so I cant kick him out” uh YES YOU CAN! That dog is a danger and according to ADA if a “service dog” lunges, barks or bites it can be thrown out of a store. He could of and would of killed my REAL service dog.

My service dog has been to the zoo and aquarium. Only restriction was they asked us not to go into the viewing area for the wolves and coyotes since they would get upset. Everything else was fine.
My cat is an ESA. I have a letter from both my psychiatrist and psychologist stating that she is needed for my health. I dont try to take her places. And she does fly with me but she's in her carrier and I pay for a ticket. I hate people who abuse the system. It makes it harder for us who truly need are pets for are emotional and mental health. ESA despite not needing training should at least he well behaved. If someone has a dog that barks it Head off then it shouldn't be allowed to be an ESA. Or any animal that is known to be destructive.

They care for each other !!! THAT IS A SERVICE THAT HER DOG LEARNED GROWING UP CLOSE TO MY DAUGHTER - that was her training !! How can anyone say that her little dog does not do a service or that her dog doesn’t work ?? Please have pity on persons that only have a pet to count on for their help, companionship, love and to keep them going because they are present for their pet as their pet is for them . Maybe their should be a susport pet AREA in everyplace - also I have been to restaurants that entry isn’t handicap accessible!??? Not Cool 😎!!! Also my Type 1 grandson family had dogs as pets but the inside dogs AND the outside dogs knows when he goes high or low - they react - they don’t know what to do but whining but the outside dogs will cry outside his window at night. One major problem that isn’t talked about in this video, is that people keep mixing up ESA with SD. I’ve seen plenty of dogs with SD vests on, while in a store and the dog was constantly barking and/or attacking people or actually SD. So, their “claimed” SD is actually just a ESA. This pandemic is just about a lot of problematic ESA, but also fake SD. Unfortunately there isn’t a proper way to tell if a dog is a real SD or a fake one, until that dog causes trouble. Because, by law, all you can only ask “Is that a Service Dog?” and “What’s their task?”, which a lot of people could properly lie and “claim” their pet, as a SD. Also vests aren’t required to be worn by real SD, same goes for leashes because it could hinder their tasks, making it harder to identify real SD from fake ones.

Show her the law. It says clearly in the ADA FAQ that ESA's do NOT have public access rights. Tell her that you will turn her in as she is endangering people with Legitimate Service Animals. Or, you could help her get her dog trained to the degree that it would be a legitimate Service Animal.
By law it can. There can be individual cases where an animal won't work, for example, you could not have a Clydesdale in a small apartment, and of course dangerous animals are not acceptable, but with those few exceptions, any animal can be an ESA.

As landlords, we do not allow pets. An ESA dog is a pet. A service animal is a pet. We had one applicant argue her dog was a Service Animal and NOT a pet, we said fine, have the dog fill out an application and he will be on the lease. Never heard back from her.
there is a federal law that says you do have to accomodate ESAs, so legally speaking, no, ESAs are not pets. But again, that's not the problem, the problem is that there is no enforcement of what is an actual emotional support animal providing, gasp, actual support, and just some entitled prick trying to get their pet in their apartment.

ESA are not protected by the ADA and are not allowed in non pet friendly places. Thats the fucking law whether you are smart enough to know that or not. You are breaking federal law by bringing a non service animal into public stores. You are also putting legit handlers at risk if your PET distracts or attacks their dog. You are not disabled! The doctors who sign off on these fake letters should have their license suspended for a year for a 1st offense, and permanent the 2nd offence.

My leases always allowed pets, but there was a non-negotiable pet fee per animal paid upfront.

if you need emotional support dog train your dog to be an actual service dog. One trained to be working, and being able to actually help you.

As landlords, we do not allow pets. An ESA dog is a pet. A service animal is a pet. We had one applicant argue her dog was a Service Animal and NOT a pet, we said fine, have the dog fill out an application and he will be on the lease. Never heard back from her.
there is a federal law that says you do have to accomodate ESAs, so legally speaking, no, ESAs are not pets. But again, that's not the problem, the problem is that there is no enforcement of what is an actual emotional support animal providing, gasp, actual support, and just some entitled prick trying to get their pet in their apartment.

So you are breaking the law then. Cause ESA and service dogs are covered by law to live in a no pets allowed living space.
I hope you get sued into homelessness! You legally CANNOT deny someone with an ESA or Service Animal. And you CANNOT charge extra for a Service Animal. Service Dogs are not pets, they are legally considered medical equipment.
Do you charge people extra for wheelchairs and oxygen tanks to? What apartment complex do you own so we can all leave reviews and report you for discrimination.

Your esa has no public access rights and can not go to stores or restaurants with you.
ESA are not protected by the ADA and are not allowed in non pet friendly places. Thats the fucking law whether you are smart enough to know that or not. You are breaking federal law by bringing a non service animal into public stores. You are also putting legit handlers at risk if your PET distracts or attacks their dog. You are not disabled! Leave your fucking pet at home!

i sympathize with the people that do it for breed restriction reasons on housing. breed restrictions are bs and have no basis. no breed of dog should be restricted anywhere that allows pets.
That's simply not viable. Some breeds of dogs need a lot of outdoor space whereas other dogs are quite comfortable living in a small apartment.
This video is inaccurate and misleading, including when it says "by law a service animal can only be a dog or a mini-horse-- this is incorrect. Is there such a legal thing as an "emotional support service animal"? You will find out in my upcoming UA-cam video on the topic of emotional support animals and service animals. Service dogs are also for ptsd, diabetes, heart issues, mobility and many other things.

There is no service animal certification. You can designate your pet as a service animal when you get a pet tag. Total scam, and dangerous to the public.
