    my apartment is infested with fake ESAs. got one barking 24/7 in the apt below me right now in fact. Had a coworker admit she didn't want to give up her dog when she moved into an apt so she went to someone to create a fake ESA certificate.

      @@johnniebeavers4003 absolutely nothing. I just moved out of there. After over a year of complaining about that barking dog, the apartment office finally admitted to me they never did anything. absolutely no repercussions for having an unruly dog that's obviously not acting as an ESA. Two more fake ESA showed up in the Apartment next door. those didn't bark too much but they tried to attack me when I pass them in the hall. yeah, providing LOTS of emotional support.

      @@VoodooV1 Property owners are required to make reasonable accommodations for people who need emotional support animals.
      Expecting others to endure the dog barking all day for no good reason is not reasonable. The assistance animal owner has options, they can put their dog in doggy day care or train the dog to better deal with stress so that they don't bark so much. The property owners have a right to demand a solution to this issue.

      Technically, an ESA doesn’t have to be trained. Barking doesn’t fall under that. It would likely fall under the noise complaint problem, not the ESA one

      @@johnniebeavers4003 People can believe they've caught a fake, but it's hard to prove and costly to prove in court. There are legal penalties for being caught, but that rarely comes into play. Usually a LL just puts up with it.

    The doctors who sign off on these fake letters should have their license suspended for a year for a 1st offense, and permanent the 2nd offence.

      Doctors can get in big trouble, but the guy that has to make the accommodations can ask so very little about the legitimacy of an ESA, it's hard to prove. Particularly with online doctors!

    Technically, every pet is a emotional supoort animal. The people running these certificates services are not looking out for your best interest, they're out there to make a quick buck out of you. I have a dog myself, but im not going to say hes the same as a trained service dog.

      Yes, that’s true except they can’t technically be in Esa until you get that proper documentation from your doctor that you see in person like my cat was my Esa but I actually made it official by talking to my doctor in person because there’s no way I was going to cheat the system it’s wrong and it’s just not right,

    I had potential tenant call me once, asked if I allowed ESA. I said yes. He said good, because they have 3 dogs and they're having a hard time finding a new place. Of course I'm limited what I can ask, but I asked if the doctor's form specified the patient must have 3 dogs? He said no, that ended that. I thought to myself- what does the patient suffer with, that one dog or even 2 dogs can't help? It takes 3? They were an obvious cheater.

      My leases always allowed pets, but there was a non-negotiable pet fee per animal paid upfront.

    I do not support special rights for ESA. Why not? I am blind. In recent years I have experienced riding the city bus and stepping in or sitting on dog crap left by an ESA. I can't begin to express how much I resent that. As a small time property manager I resent having to replace, at my own expense, all the carpet, pad and sections of sub-floor in apartments where an ESA cat has lived.

    This article is misleading . My son brought back his Military War Dog or MWD from Afghanist. So let's be clear here a retired MWD is not a service animal but can be covered under an ESA because because they both have PTSD . It's a shame that the report wants to cookie cut. Some ESAs are essential

      the problem is, and I'm just speculating because I don't have hard data, but for every one legitimate ESA, there could be 10 fake ones...or more. It's being abused because there is simply no enforcement. So yeah, it will eventually have the consequence of ruining it for those few that do actually need it and have actual well behaved animals.

    It’s not just in Florida’s it’s everywhere unfortunately. I have a psychiatric and medical alert and response service dog and she’s been nearly attacked on numerous occasions by pets in none pet friendly places. It’s not an inconvenience it’s a felony crime. People think it won’t harm anyone. It’s harming legitimate service dogs ability to get access to places were allowed. Also, we’re illegally asked for identifications, certifications, registrations and documentations. Also, asking for what disabilities we have or to show them what we have.

      @@Wontreplyeverdontbother actually, under federal Americans with Disabilities Act, there is NO national registry recognized. It even states that online businesses will try to make their certifications and registrations look legal. So the “certification” you claim to have is fake and a scam. The only legal thing is the training. Service dogs aren’t even required to be vested or leashed if it interferes with their tasks or the persons disabilities.

      Me and my service dog turned the corner in a book store and came face to face with a 100 pound german shepherd that instantly went into attack mode. He didnt grab my dog but he was out of control. The man kept using german commands (which is typical training in attack dog work) and had no vest on the dog. We told the manager and the manager said “Well he said it was a service dog so I cant kick him out” uh YES YOU CAN! That dog is a danger and according to ADA if a “service dog” lunges, barks or bites it can be thrown out of a store. He could of and would of killed my REAL service dog.

    Freindly reminder: SERVICE DOGS AND ESAS ARE COMPLETELY DIFFERENT
    Esas:
    -dont need to be trained
    -bypasses breed/ size restrictions
    -bypasses no pet rules ONLY IN HOUSING
    -no pet fee ONLY IN HOUSING
    -no id, registration, certification, ect
    -only doc note
    -CANNOT go into non pet friendly establishments
    Service dogs:
    -needs to be trained to help with a disability
    -goes virtually everywhere with their handler unless is poses a safety risk (zoos, aquariums, zip lining, skydiving, ect)
    -no ID, certification, registration, ect
    -only doc note
    -doesn't have to wear anything identifying to say it's a service dog (ID, harness, ect)
    -CANNOT be denied in public spaces except for if the business would need to change alot, the dog is barking excessively, using the bathroom in said establishment, or is otherwise not under control
    -Any breed and/or size
    -owner can train the dog
    Therapy dogs are also very different from both of these
    All have very important jobs and help people however their rights and requirements are very different

      My service dog has been to the zoo and aquarium. Only restriction was they asked us not to go into the viewing area for the wolves and coyotes since they would get upset. Everything else was fine.

    My cat is an ESA. I have a letter from both my psychiatrist and psychologist stating that she is needed for my health. I dont try to take her places. And she does fly with me but she's in her carrier and I pay for a ticket. I hate people who abuse the system. It makes it harder for us who truly need are pets for are emotional and mental health. ESA despite not needing training should at least he well behaved. If someone has a dog that barks it Head off then it shouldn't be allowed to be an ESA. Or any animal that is known to be destructive.

      better start helping to expose the fake ones. This problem isn't going to go away until there are actual consequences and there is a very real likelyhood that the scammers can ruin it for the legitimate needs.

    Not to mention there are many, many people allergic to cats and dogs and you ought to have a reasonable expectation not to have an allergic reaction in every public place you visit. My wife has allergic asthma and we have often left restaurants or had to sit in the very back of planes because she will have difficulty breathing. Legitimate service animals are worth that inconvenience, ESA's are frivolous and stupid. People need to come before pets.

    the law needs to specify MINIMUM 4.5 hours of patient CONTACT (equivalent to 6 therapy sessions either in person or through actual telehealth.

    99.999% of ESAs are just pets. The legislators should do away with ESAs for the sake of the few people with disabilities that require real service dogs and for the sake of society.

    Idk 🤷🏻‍♀️ about fake ESD but I can tell you that I do not have any pets but I LOVE PETS AND I SUPPORT ALL WORKING PETS ( mostly dogs) !!! Even EMOTIONAL SUPPORT DOGS KNOW THEIR JOB !!! I have a very ill adult daughter that her tiny dog knows if she isn’t breathing right and will wake her at night - her little dog knows when she is in pain and her dog will distract her to help her . Her dog knows if she gets upset and she will share her little sweet self to give LOVE to my daughter ! When my daughter is sick all night up and down her fur baby is up and down her ramp by my daughters bed to set by my daughter ALL NIGHT LONG - her fur baby is loyal and dedicated!!! They care for each other !!! THAT IS A SERVICE THAT HER DOG LEARNED GROWING UP CLOSE TO MY DAUGHTER - that was her training !! How can anyone say that her little dog does not do a service or that her dog doesn’t work ?? Please have pity on persons that only have a pet to count on for their help, companionship, love and to keep them going because they are present for their pet as their pet is for them . Maybe their should be a susport pet AREA in everyplace - also I have been to restaurants that entry isn’t handicap accessible!??? Not Cool 😎!!! Also my Type 1 grandson family had dogs as pets but the inside dogs AND the outside dogs knows when he goes high or low - they react - they don’t know what to do but whining but the outside dogs will cry outside his window at night. The inside dogs want to guard him !!! DOGS ARE SO SMART !!!!

    One major problem that isn’t talked about in this video, is that people keep mixing up ESA with SD.
    I’ve seen plenty of dogs with SD vests on, while in a store and the dog was constantly barking and/or attacking people or actually SD. So, their “claimed” SD is actually just a ESA.
    This pandemic is just about a lot of problematic ESA, but also fake SD.
    Unfortunately there isn’t a proper way to tell if a dog is a real SD or a fake one, until that dog causes trouble. Because, by law, all you can only ask “Is that a Service Dog?” and “What’s their task?”, which a lot of people could properly lie and “claim” their pet, as a SD.
    Also vests aren’t required to be worn by real SD, same goes for leashes because it could hinder their tasks, making it harder to identify real SD from fake ones.

    I wish people didn’t ruin it for people who actually needs Esa because the airlines don’t allow it anymore and it’s because people ruined it for people who actually benefit from an ESA people should do it correctly go to the doctor. and won’t happen on the first visit you won’t get that letter but after you see your doctor for a little bit, you could always ask them but please people do it the right way and don’t cheat the system.

    Emotional support animals do not have access to public spaces where a pets are not allowed. Only service animals are allowed.

    My moms friend does tht with her esa takes everywhere and people allow her to and say nothing to her you can't tell her any different she calls u stupid or person tht doesn't know anything says her esa papers say she can take anywhere

      Show her the law. It says clearly in the ADA FAQ that ESA's do NOT have public access rights. Tell her that you will turn her in as she is endangering people with Legitimate Service Animals. Or, you could help her get her dog trained to the degree that it would be a legitimate Service Animal.

      By law it can. There can be individual cases where an animal won't work, for example, you could not have a Clydesdale in a small apartment, and of course dangerous animals are not acceptable, but with those few exceptions, any animal can be an ESA.

    As landlords, we do not allow pets. An ESA dog is a pet. A service animal is a pet. We had one applicant argue her dog was a Service Animal and NOT a pet, we said fine, have the dog fill out an application and he will be on the lease. Never heard back from her.

      there is a federal law that says you do have to accomodate ESAs, so legally speaking, no, ESAs are not pets. But again, that's not the problem, the problem is that there is no enforcement of what is an actual emotional support animal providing, gasp, actual support, and just some entitled prick trying to get their pet in their apartment.

      I hope you get sued into homelessness! You legally CANNOT deny someone with an ESA or Service Animal. And you CANNOT charge extra for a Service Animal. Service Dogs are not pets, they are legally considered medical equipment.
      Do you charge people extra for wheelchairs and oxygen tanks to? What apartment complex do you own so we can all leave reviews and report you for discrimination.

    I have PTSD and I have an emotional support animal thru my therapist!! Stop all the hype no one is abusing the system! Do you know it’s not easy bringing your dog everywhere get a life people! Jealous of someone’s mental illness back off!!

      ESA are not protected by the ADA and are not allowed in non pet friendly places. Thats the fucking law whether you are smart enough to know that or not. You are breaking federal law by bringing a non service animal into public stores. You are also putting legit handlers at risk if your PET distracts or attacks their dog. You are not disabled! Leave your fucking pet at home!

    i sympathize with the people that do it for breed restriction reasons on housing. breed restrictions are bs and have no basis. no breed of dog should be restricted anywhere that allows pets.

      That's simply not viable. Some breeds of dogs need a lot of outdoor space whereas other dogs are quite comfortable living in a small apartment.

    This video is inaccurate and misleading, including when it says "by law a service animal can only be a dog or a mini-horse-- this is incorrect. Is there such a legal thing as an "emotional support service animal"? You will find out in my upcoming UA-cam video on the topic of emotional support animals and service animals. I went to law school and took a disability law class. I am not an attorney, but I do work in the legal arena. Stay tuned. ; )

    There is no service animal certification. You can designate your pet as a service animal when you get a pet tag. Total scam, and dangerous to the public.
