Then in bankruptcy court those potential sources of income are either confirmed or eliminated - legally and finally. What this likely means to CZ is bankruptcy court is going to tick through all those sources of money and mark off all those that are wrong, silly or very unlikely to ever deliver. The bankruptcy court itself is obligated to pursue legitimate lawsuits required to bring in money to pay creditors. But they won't be chasing dumbass defamation claims that aren't clear and winnable.

I’m not well acquainted with how this works in America but I remember seeing a case where this rich guy purposefully initiated a lawsuit in a state that had poor Anti-SLAPP legislation to make it more costly for the other parties involved.

I still don't understand why people continue to use defamation lawsuits as threats. Enough people know now that either they get dismissed and the plaintiff has to pay all lawyer and court fees if it's the result of an anti-SLAPP ruling, or in this case, if you sue a journalist, they will allow it to proceed because they get to look into all your dirty laundry during discovery.
Because it’s a scare tactic. They’re banking on people being intimidated enough by the lawsuit that they backtrack and take down the videos or whatever. They’re not seriously considering taking it to court for real. Have them write a template letter for you that explains the available sanctions for the attorney and client for SLAPP suits, then pay them to mail it out whenever you get one of these threats. Seeing that show up after a threat is the lawyer equivalent of "I encourage you to fuck around and find out".

Different industry but this happens all the time in my profession, medical profession. One of my mentors got invited to a Christmas celebration of a family who had a baby with down syndrome. Once a lawyer started talking to the family, they then decided to sue my mentor. My mentor won his case but it jaded them and they quit medicine altogether and lamented over the fact that they were this kids godparent and broke bread on Christmas together.
