The businesses for assuming they own the sidewalk, the cops for assuming every word that dribbles out of their mouth is a "lawful order" and municipalities making anti-Constitutional ordinances. I don't put blame on most 911 call centers because they are following a very specific script, and they do not get to choose what is a valid police call and what is not.
What gets me is the business owner is obviously conservative (Redneck Gourmet) and would tell you all about how proud he is of the US constitution, especially the second amendment. And that's all he cares about or cares to know.

Officer Beneke was trying to bully Jeff into leaving, by vaguely projecting the law to mean one thing, when the complete opposite is true. When Jeff didn't give in to the bullying, Officer's Beneke's threat to come back if someone else calls, was his way of protecting his ego. As he tucked his tail and walked away.

Main streets/ sidewalks in old towns are sometimes tricky things. Be sure to get your "read" right. Brick pavement at curbside is likely indicative of an original utilities company or city easement, then the big rectangles of concrete sidewalk are usually city, then the narrow concrete rectangles abutting buildings are possibly private property/ public access.

I shake my head every time I see one of your videos and how you are constantly harassed by the police and even I'm not sure how bad it is for the veterans here in Phoenix but I know it's not good. I've been going to the VA here for thirty years and the service is horrible. The VA Police are constantly giving trouble to the veterans. A friend of mine was thrown to the ground and handcuffed and dragged back into the doctor's office because the doctor had been making him wait for 2 hours and had not showed up for the appointment. My friend Tom got tired of waiting and left. Actually chased him outside in the parking lot and said you have no permission to leave. WTF! WHY DID YOU ASSHOLES ALWAYS SAY THAT YOU ARE BEGGING FOR MONEY?

WOW, seems a lot of people responded to this last comment I wrote. 100 likes is the most likes I've gotten any comment in a long time. So I thought I'd tell you another story. I have been a quadriplegic for 35 years. I didn't find out until after my injury seven years later, I was eligible for the VA benefits for medical. It was only after I complained that wrote a letter to the paraplegic news magazine who published my article about how I had tried to better myself by going back to school. As soon as I graduated from Glendale community college, I found a job. Immediately I lost my workman's comp. No one told me they would cut that off instantly. I only worked for two weeks and the company went out of business. It was a scam or write off for taxes for the rich. I had taken computer drafting and was designing handicap signs for government buildings. After that two weeks I realized there was no way I could do 40 hours a week. I had to take the industrial commission back to court and now only received half of what I was getting originally. Many years later my bones had become brittle. I broke my left knee and shattered it into many places turning it the wrong way while transferring myself getting in and out of bed. I asked the VA for help and I had to wait for two years. All the while my knee was broken in extreme pain. They put me on oxycodone all that time. Then someone was stealing some of my pills. After that the government decided to cut me off totally along with all the other veterans. I had to find a civilian who would attempt to do the operation to fix my knee. Apparently the VA only wanted to amputate and that's all. They wanted to send me to Tucson to do it. I wouldn't let them do that. I finally found a civilian Doctor who would fix it. Just before I was to get discharged from the hospital after 17 operations, I tried to turn myself in bed at the hospital and broke my femur. Then they decided to cut out my whole leg including my hip bone. That was when the pandemic started. Needless to say I do not trust doctors anymore. I did not get the shot. After going home my back stitches came apart and has remained that way ever since. I will just say I hate the VA.
Same with the cop who gave Jeff "5 minutes" to leave the rest area on the interstate. They don't want to commit to an enforcement because they know they're wrong. But they also don't want to acknowledge Jeff is right because it would bruise their ego.
We should also educate our children so they don't make the mistake of joining the military. Nip the problem in the bud so to speak. My dad was a combat veteran and he educated me so I didn't make the same mistakes he did.

I think that cop knew two things..... 1) he didn't care for you standing there and 2) there was little he could actually do about it while remaining within the confines of the law. He was working from assumption and presumption that you were in fact homeless but approached with caution. Perhaps he has seen your videos or videos of other encounters with people exercising their Rights on a traditional public forum.
I would have told him I am not homeless and asked him if he knows about the "bridge the gap of your ignorance of the First Amendment Program" LOL. when the LT arrives on scene he's already made a determination about whats happened and does not follow investigative procedures to make a determination if a crime has occurred, he's just there to "chase you off" without having knowledge of whats really happening... this is the problem with law enforcement, they treat different perceived people with different actions rather than the ones they are to follow all the time... thats why certain economic groups face far less justice than the others, because certain steps in the process get skipped by lazy cops who know certain parties are unlikely to have the financial means to hold them accountable to the law...

I pretty sure the Supreme Court has ruled that cops can trespass people that are “standing out there.”
Cop probably knew he had no legal grounds to ask you to move along so he just hoped his badge would intimidate you enough that you would do as he asked in order to keep the business owner happy. Another great video Geoff.

It seems that Officer Beneke would prefer it if people didn't have first amendment rights. He wasn't clear on whether your rights depended on the number of calls the PD received or who the callers were.
Assumption is strong here. They just assume and say, we've had some calls.
I am always amazed that just because you are holding a sign, they assume you are homeless yourself. You are just passing on the message that homeless vets need some attention and deserve our help. Keep up the good work and hopefully you will save some service people on hard times.

That was handled well. The cop tried the typical bullies tactics, then left.
It should be illegal for law enforcement to threaten people who are engaged in constitutionally protected activities.

I think that cop knew two things..... 1) he didn't care for you standing there and 2) there was little he could actually do about it while remaining within the confines of the law.
He was working from assumption and presumption that you were in fact homeless but approached with caution. Perhaps he has seen your videos or videos of other encounters with people exercising their Rights on a traditional public forum.
I guarantee you the cop realized he was being recorded and choose not to do anything illegal.

I would have told him I am not homeless and asked him if he knows about the "bridge the gap of your ignorance of the First Amendment Program" LOL. when the LT arrives on scene he's already made a determination about whats happened and does not follow investigative procedures to make a determination if a crime has occurred, he's just there to "chase you off" without having knowledge of whats really happening... this is the problem with law enforcement, they treat different perceived people with different actions rather than the ones they are to follow all the time... thats why certain economic groups face far less justice than the others, because certain steps in the process get skipped by lazy cops who know certain parties are unlikely to have the financial means to hold them accountable to the law...

That business owner wouldn’t have the right to the freedoms he has it if wasn’t for the vets! To think a veteran holding a sign to bring awareness to our vets and honor them is a issue standing on a public sidewalk. Which they don’t own or have any authority over, but to think you ask them to move. What type of person are you? is the question. And why do people assume holding a sign your homeless? And a officer no matter how many calls you get the fact is not the call or how someone feels are they breaking the law? It is astounding to myself coming from a long line of military family that a vet is treated so badly and not granted the respect they deserve. Any business owner or anywhere a vet should be welcomed he fought for our country sacrificed his time, his life and gave so much to this country and he can’t stand on a public sidewalk not harassing bothering anyone, and in Jeff’s case honoring all those that served. I would be ashamed of myself and wouldn’t give that business a dime of my money. Thank you Jeff, for all you do. You truly are a patriot!
