    Sec. 12-18. - Picketing.
    (a) Definitions. The following words, terms, and phrases when used in this section shall have the meanings ascribed to this subsection, except where the context clearly indicates a different meaning:
    "Picketing" or "picket" shall mean a peaceful demonstration by one or more persons outside a business, governmental agency, or organization to protest the entity's activities or policies.
    "Sidewalk" shall mean that portion of the public right-of-way which is designed primarily for the use of pedestrians and may be paved or unpaved.
    "Street" shall mean the entire width between boundary lines of every way publicly maintained when any part thereof is open to the use of the public for purposes of vehicular traffic, including that portion between the shoulder of the roadway and the curb.
    (b) Persons engaged in picketing shall observe the following: (1) No picketing shall be permitted upon any public street or right-of-way designed primarily for vehicular traffic. (2) Persons engaged in picketing shall remain on the outer limits of any sidewalk being used for that purpose (i.e. upon the side nearest the street), and shall keep moving at all times. (3) No person, while picketing, shall impede or hinder pedestrian or vehicular traffic upon any sidewalk, street or public way. (4) Persons engaged in picketing shall maintain a distance of ten (10) feet from each other, and shall at no time prevent free and unimpeded movement of invitees and owners onto and away from any private property, or any person onto and away from any public property. (5) It shall be unlawful to picket after sunset and before sunrise anywhere within one hundred (100) yards of a residential property line. (c) Any person violating any provision of this section shall be guilty of an offense.

      YES IT DID GO RIGHT OVER BOTH OF THEIR HEADS...two adult black women who both work IN A LIBRARY where there is SO MUCH INFORMATION ABOUT THE CIVIL RIGHTS MOVEMENT AND WHAT HAPPENED TO BLACKS! What Jeff asked them SHOULD HAVE immediately meant something to them and they should have understood what he was making a point about and why for crying out loud!

    Not only is this ordinance a 1st amendment violation, but also an ADA violation. How is a person whose mute/has speech impediments supposed to get out their message if only verbal delivery is allowed?

      yes, also not only verbal is allowed, but the person who hold the sign MUST ALWAYS BE MOVING, non-stop. So if you are disabled, this city officially hates you, denies you picketing even for 10 bucks. Because if you pay 10 bucks and do not 'always move' - you violate their law.

      I agree...IF they work for the city, county, state or federal government (We, the citizenry and taxpayers) and they state in their official capacity to any auditor that the auditor CANNOT DO the constitutionally protected activity he/she is peacefully doing on or in public property...THE GOVT WORKERS are harassing and trying to VIOLATE someone's rights themselves, cops or no cops, and the city or other government should STILL BE LIABLE for their unlawful actions.

    It’s not the ordnance that’s the problem. It’s the mega-privileged bullies who work for government who believe they can tell citizens where to stand that are the problem. It’s the cops who go out on a line to forcibly remove law-abiding citizens at the whim of these privileged workers. It’s the supervisors and trainers of these workers who dropped the ball and allowed these miserable people to exercise their power without guardrails or accountability.
    Great job on this Jeff. Your mega-polite behavior really serves to show people just how bad our governments are in 2023, where zero provocation still begets ill treatment.

    When i organized a protest, about 500 people showed up, chief of police called me a few days before to ask if i was going to get a permit. I told him that on principle that I could never lower myself to get a permit to engage in constitutional activities, as that would imply i need permission to exercise my rights.

    Land of the free…it’s a crime that towns, cities, and police have no shame in violating the Constitution. They are so afraid that the “wrong type of people” will stand on public property and say things they disagree with, that they try and ban free speech, freedom of religious expression, freedom of the press, freedom of assembly, and freedom to petition the government for redress of grievances. I hope you are able to take this to court and correct this terrible and incorrect application of law. Thank you for what you do!

    Absolutely disgusting behavior by these people. A wonderful sign honoring and bringing awareness to our vets and told it looks like panhandling and trying to run a vet off. Vets should be honored everyday no where they go and gave the honor and respect they deserve. Absolutely shameful display of behavior. If it wasn’t for these vets they have sacrificed so much and their lives so you can walk around free. As a military family I am appalled. At least these people are being shown to thousands of people and who they truly are! Terrible look for the Mayor and the community.

    12-18 doesn't say you have to be on a sidewalk to picket. It says if you are on a sidewalk picketing, you can't hinder pedestrian traffic. Basically the entire ordinance is "don't hinder traffic, don't hinder pedestrians, don't picket near homes after dark". How are they twisting this into demanding Jeff move to a sidewalk?

    The number of officers who have no clue that property owned by a city and open to the public (especially the site of city hall) is no different than the sidewalk in front of city hall - both are public property. - Absolutely disgusting!

    Jeff, you need to keep the Supreme Court ruling in your pocket so that when they show you the city ordinance you can show them the federal ruling. I'm not sure why you wouldn't have those types of tools in your pocket.

      The cops need to cite someone for the ordinance before it can be challenged. Most people don't stand up for their rights and will just pay the $10. Its just a bully tactic to generate revenue.

    A picketing ordinance?!? This officer tried to enforce a picketing ordinance?! That is absurd. Any ordinance that is in direct conflict with the first amendment will never hold up in court. But more importantly, it should not exist to begin with.

    Theses little backwoods lawyers think they can make up any laws they want. The sad part is how many of these unconstitutional fines have they collected on, before someone like Jeff calls their bluff. And that's all that Sgt was doing he was bluffing hoping he would pump some fear in Jeff and get him to move.

    we used to honor our vets!!! my grandfather survived 3 suicide attacks in the pacific, my uncle served in korea and my father in vietnam so i am bias!!!! i still shake hands and respect all who served, we all used to. i need to ask????     The sergeant was smart enough to leave well enough alone and by doing that, he kept the city from a lawsuit and also retained the unconstitutional ordinance to be used against some other poor soul in the future.

    This cop literally read out loud the legal definition of “Picketing” as declared by the local Judiciary and then he said “You are not doing any of that”. Meaning your actions do not satisfy the conditions required in order for someone to be adjudicated guilty of this offence. And then proceeds right ahead to discuss punishment for committing the infraction that he (the officer) just admitted wasn’t being committed! 🥴

    Officer reads the definition of picketing and then immediately says, 'you're not doing that'.
    THEN reads 'Persons engaged in picketing' unironically not remembering three seconds prior where he said you aren't picketing.
    He also said his LT was the one that told him about it. Get the LT's name that thinks the first amendment is halted by this city's picketing laws. He also remarks that you can do it on the sidewalk, while 12-18 specifically states you can not.
    This is not the appropriate law for what they think is the crime.

    What municipality thought they could enact some legal? "Ordinance " without consulting an attorney to confirm the legality of said Ordinance? If they DID consult an attorney AND the (incompetent) attorney approved it , once the municipality discovered the attorney was/is incompetent, WHY would the municipality continue to spend TAXPAYER money on incompetent advise/service . Upon discovery, would the municipality get taxpayer money back ? (Refund)

    I wonder how they would feel if the city passed an ordinance saying no blacks could go into the library? They would be appalled and LIVID at an ordinance that was so stupid. Yet they see nothing wrong with abridging free speech, freedom of religion, and freedom to redress your government.

    Remember where Jeff was. We in the South used to pass laws to deal with those pesky and irritating Civil Rights protestors about 60 - 65 years ago. /sarc off/ I think if you check the date of passage of most of these ordinances and laws in many of the towns Jeff audits, they date from that time period.

      I have a hard time understanding how "the business" would be served by having Jeff removed from city (public) property. If "the business" believes Jeff's sign and message are a nuisance, what does that say about "the business"?
      Do they fear that Jeff's going to solicit money that "the business" feels entitled to? Or does "the business" hate homeless vets, and prefer that God doesn't bless them? Does "the business" feel entitled to those blessings?
      Seems rather odd that the cop tried to use an obscure, unlawful, and unconstitutional city ordinance against Jeff, rather than the readily available 1st Amendment and the plethora of easy to find relevant case law to protect and serve Jeff's rights.

    What if the city ordinance said no minorities allowed on city property? That also violates the constitution. A violation of the constitution is a violation of the constitution. Theirs no small violations when it comes to our right. This cities that pass ordinances that violate the constitution need to be exposed.

    How is it possible they think public property and city property are not the same? Especially that you can stand on a public sidewalk but not on city property? Huh? Doesn't the city own the sidewalks too abd aren't they public? 😮

    Jeff Gray needs to have a shirt on underneath his shirt that says God bless the homeless vets so when they get rid of his sign or keeps referencing the sign, just take off the top layer and expose the sign on your shirt😂

    Most cities and/or towns, do not have a constitutional lawyer on hand to see if their ordinances meet a constitutional criteria, and this is just one more reason why we need audits🤓👍

    The cop read the ordinance aloud and immediately misinterpreted it. “See, it’s talking about being on the street.” Yeah, that you can’t picket in the street! …which is also a violation of our First Amendment rights!

    How on earth does a cop not understand the steps of city hall is the quintessential public forum. The steps of city hall is one of the clearest litigated case law.

    They would enforce it if there was a policy saying no blacks allowed in front of the library, or no books of black authors to be stocked without additional tax/ permit fees 🙄

    That cop was trying to follow the constitution at first till his supervisor put pressure. The cop didn't want to ask him to stop, you tell in his voice.

    Sir I thank you for what you do. It seems like a lot of people, especially police, do not like Veterans. I work for the US Department Of Veterans affairs and this is heart breaking to see.
