We could expect some movement for EB1 India, but it may not be very aggressive. The movement will be largely dependent on the spillover of visas. Based on the trends so far, we could expect visa dates from 2022 to 2023, the priority dates might remain similar throughout FY 2025. Additionally, more upgrades from EB2 and EB3 to EB1 could also impact the movement in FY 2025.

Do you think the date reflected in this excel sheet should be compared with priority date for that month. For example, this sheet is for April 2024 and the eb1 priority date correspondingly is March 2021. Hence it is listed as available until February 2021.

I beleive the second excel file was released late July/early August. From that data, the visa dates went back to 2020. While the file released in June mentioned the visas are avialble till AUg 2022, and we saw the PD moved till Feb 2022. SInce we were at the end of FY 2024. They did not make any changes based on the July excel file. If we had time, I assume the dates might have retrogressed. But we are entering the FY 2025, new numbers are going to overcome the demand. But my assumption is that from July/Aug file, definitely there was possibility of no visas. The goal was to decode the numbers. Hope that helps. Appreciate your comment. Let us know what you think.

@@Nexus_Central. Thank you for responding. The newest file was released in July. If you look at the EB1 India tab, it says as of April 2024. I interpret this to correspond to the FAD of the April 2024 visa bulletin which is at March 1 2021. As such, the excel file shows that visas until February 2021 as available. All visas starting March 2021 are unavailable. If USCIS releases another excel file with a date in the file after April 2024, we may verify my interpretation.

@@Nexus_Central. Where is the data for August 2024 i-485? Why would USCIS update data in August with "As of Feb22" where as they already updated data in July with "as of April 2024"? USCIS has has been conservative in final action dates. Even though their internal visa availability showed Aug 22 in Feb 24, they set final action date for Month of April to April 2021. Final action dates are predictions based trends. Eventually when they inventory data on April 2024, their predictions became true. As the months passed on, they moved more Visa from ROW to India and that helped them move Final action date to Feb 2022. That is my speculation, we will know it in 2 weeks.

@@vijaykumar610seems to be like that. From June to August updates the visas seems to back log. Also uscis announced that they sanctioned all EB1 visas, which aligns with the Aug exile file. My take is that either they gave all
Gc upto 2020 or 2022 as per the two latest excel files. Have to wait for the new numbers and PD.

what do you mean by spillover here? Is it from EB5 to EB1 or from family based to employment based spillover? I believe the main factor to consider for forward movement is the ROW is current in EB1, so all remaining EB1 visas from ROW will be given to India in 2025 aswell....

Spill over from ROW mostly if any unused. Some from family based and asylum. Also last year there were around 20k new visas allocated to Ukraine new bill. So if the government can. They can send all unused to EB hopefully. Similar to 2020 where we got 100k+ visas to EB. What you think ?

@@sheshubms1 Yes Brother will do it soon. Based on the numbers from 2024 they are very off, do not want to throw some random dates. I would wait for the FY 2025 data if USCIS releases soon. So we can have atleast good projections. Thanks for checking it out, appreciate it.
