The police and the city, yes. The caller - I don't think so. "Suspicious behavior" can mean different things to different people, and other than that it seems the caller was truthful. You also don't want to make people scared of calling the police, otherwise they might not call them or delay calling when it's necessary. The fault lies with the police and the city for how things were handled once the call was made.

One thing I want to know is... How is it legal (let alone medically ethical) to inject someone with ANYTHING without their consent? They did not even have his health history or information. He could have been allergic or on certain medication where what they injected him with could have killed him on the spot instantly. And seeing as he had a heart attack in the ambulance...it seems likely they did, just not instantly.
Exactly! Kind of like what happened to Tony Timpa, checked his blood pressure while he was still breathing and calling for help. A few minutes later injected a sedative in the poor guy who was already dead from cardiac arrest in a hold by the cops, without checking him again / trying to get the cops off of a clearly unresponsive guy (and even though the cops said "he's out cold now" so it was unnecessary to sedate him). The cops also laughed and joked about Tony while he died.. The EMTs in these cases are horrible too
That was odd to me, too! Usually medics do an initial assessment before pushing any drugs. The initial assessment includes vitals and a medical history.

This very sweet introverted young musician who plays the violin to cats at the local shelter so they wont feel alone, was walking home with tea, that he had just bought. He told them that. As they were choking him, he threw up and then apologized for making a mess. He committed no crime. He was 145 lbs. Someone said he looked suspicious. All the police had to do was ask him what he was doing and why he was wearing a mask and he could have answered and made it all clear. But they tackled him; chocked him and when the medics arrived they injected him with a horse tranquilizer. That poor innocent young man suffered and was horrified, for no reason. He wore a mask because he had anemia and got sick easily and was always cold. He was a sweet, sickly, introverted young man. The people who called told them that he was a bit suspicious but they didnt think he was a bad guy. When the cops approached him he told them he lived right around the corner and offered to show them his identification. You want to get rid of the bad apples in the police department, start with these guys, now.

Please investigate the cops, but also the paramedics who injected a LARGE DOSE OF KETAMINE. This injection might have been the culprit too, as he was having difficulty breathing and vomiting.

Unfortunately, most (if not all) states in the US do not put funding towards civil services that would be much more appropriate towards situations like these. The caller did their part as a concerned citizen; but the city in their funding decisions sent the ill-trained police.

My son is autistic, he is also a talented musician and also a vegetarian. In fact he has so much in common with Elijah. My son wears masks or caps and autistic people do this to cover their faces because they don't always like eye contact etc. My son is 14yrs old. I don't think I will ever forget the Elijah McClain case, as long as I live. Because I know that could so easily be my son. My heart breaks for his mother & family.

He was called in as suspicious, suspicious is not a crime. You can be as suspicious as you want as long as you aren't breaking the law. They stated he resists arrest, resisting is a secondary charge. You can't be charged with resisting if there's no crimes committed in the first place. Even if police are called in for a suspicious person that person has no obligation to even talk to the cops. The police cannot lawfully detain you without a crime.

Unfortunately the only possible solutions I can see to end to these types of situation are the following. 1. Exactly what a Colarado state congresswoman stated: we need clear guidelines on what protocol needs to be and the limits on physical force both police and citizens should have clear rules of engagement. Chokes phyiscal combat should probably be allowed to aid in restraining unruly suspects for sure and there is a way to do it correct, see below. 2. End any type of civil suit immunity of the police and reward them by increasing officer pay dramatically to attract higher caliber candidates as well as increase the requirements nationwide to do this professional. Finally, require they be actively involved in BJJ so when these situations arise it can ideally avoid the need for lethal force. Or 3 and the least favorite of my ideas but a solution for several reasons: Legalize lethal force against any officer aggressively committing unnecessary force i.e. a blood choke, i.e. not getting the suspect medical attention as soon as it appears they are in distress. I hate to say that but the reality is the fear of a legally authorized carrying would keep a lot of the Barney Fife types either away from the force or make them check their attitudes immediately. So sad and very troubling that Elijah knew the law better than all those cops did. Right from the get-go, the cops failed to answer yes to the first gate in the process flow, which is simply “ is there a reasonable articulable suspicion that a crime is being committed, a crime has been committed, or a crime is about to be committed?” Reasonable means that there Hass to be some modicum of evidence, such as the collar would say I saw him trying to break into a door of a house. Secondly, articulable would mean that the cops have to know the law, and be able to cite what that law is. Neither of these gates could be answered yes, in the process flow, and therefore they had absolutely no right to put their hands on him to ask him to stop or attempt in any way to detain or harass him. How is it legal (let alone medically ethical) to inject someone with ANYTHING without their consent?
They did not even have his health history or information. He could have been allergic or on certain medication where what they injected him with could have killed him on the spot instantly.
And seeing as he had a heart attack in the ambulance...it seems likely they did, just not instantly.

A few minutes later injected a sedative in the poor guy who was already dead from cardiac arrest in a hold by the cops, without checking him again / trying to get the cops off of a clearly unresponsive guy (and even though the cops said "he's out cold now" so it was unnecessary to sedate him).

This very sweet introverted young musician who plays the violin to cats at the local shelter so they wont feel alone, was walking home with tea, that he had just bought. He told them that. As they were choking him, he threw up and then apologized for making a mess. He committed no crime. He was 145 lbs. Someone said he looked suspicious. All the police had to do was ask him what he was doing and why he was wearing a mask and he could have answered and made it all clear. But they tackled him; chocked him and when the medics arrived they injected him with a horse tranquilizer. That poor innocent young man suffered and was horrified, for no reason. He wore a mask because he had anemia and got sick easily and was always cold. He was a sweet, sickly, introverted young man. The people who called told them that he was a bit suspicious but they didnt think he was a bad guy. When the cops approached him he told them he lived right around the corner and offered to show them his identification. You want to get rid of the bad apples in the police department, start with these guys, now.
And those lying cops trying to justify why they beat him said he had extraordinary strength. I think they knew they screwed up and convinced emt to tranquilize him as if he was a powerful bodybuilder on pcp.

It was an EMT that administered the ketamine, but my understanding was that he gave an amount that you would give a 200 pound person...this young man appeared to be about 125 lbs.

He was called in as suspicious, suspicious is not a crime. You can be as suspicious as you want as long as you aren't breaking the law.
They stated he resists arrest, resisting is a secondary charge. You can't be charged with resisting if there's no crimes committed in the first place.
Even if police are called in for a suspicious person that person has no obligation to even talk to the cops. The police cannot lawfully detain you without a crime.

What is so suspicious about walking down the street at night , carrying your plastic grocery bag while wearing a ski mask in 15 degree Colorado weather? All those things are legal to do.
And people should check their bias and prejudice before calling - Does the person look suspicious because of physical attributes or what they are doing?
If he was peeking in windows and pulling on car doors, by all means - call! But, if someone is just walking down a public street (no matter the color) minding their own business, then the 911 call was unwarranted and actually a waste of police time.

the one emotion that any reasonable person would get after seeing that footage is fear: fear at the police for being able to kill a man doing nothing but walking around, fear that they have the legal authority to kill discriminately, fear that even if it's only one "bad apple", that apple might be the one to end their lives.

Maybe put police officers on foot once more to get to know who lives there.
Unfortunately the only possible solutions I can see to end to these types of situation are the following.
1. Exactly what a Colarado state congresswoman stated: we need clear guidelines on what protocol needs to be and the limits on physical force both police and citizens should have clear rules of engagement. Chokes phyiscal combat should probably be allowed to aid in restraining unruly suspects for sure and there is a way to do it correct, see below.
2. End any type of civil suit immunity of the police and reward them by increasing officer pay dramatically to attract higher caliber candidates as well as increase the requirements nationwide to do this professional. Finally, require they be actively involved in BJJ so when these situations arise it can ideally avoid the need for lethal force.
Or 3 and the least favorite of my ideas but a solution for several reasons:
Legalize lethal force against any officer aggressively committing unnecessary force i.e. a blood choke, i.e. not getting the suspect medical attention as soon as it appears they are in distress. I hate to say that but the reality is the fear of a legally authorized carrying would keep a lot of the Barney Fife types either away from the force or make them check their attitudes immediately.
Not perfect ideas but the most realistic ones I can think of.

He did dress with layers, he was vegan, he was gentle. He wouldn't hurt a fly. He wouldn't grab for gun, that was their way to be forceful. Worked with him for 6months as a massage therapist.
I am so sorry for his family's loss. He can't be replaced.

only if he was really in a psychotic break mode would this be an option. He obviously was rational to us, but if he were really fighting back, maybe it looked like he was. He sounds perfectly mentally sound and I think that anyone making a medical decision to inject a man with it sounding like this is off their rocker, tbh. Maybe the EMT are being paid kick-backs somehow. Btw, dosages for all are usually administered in hospitals and emergency situations for very rudimentary sizing charts. Adult/child. :(

So sad and very troubling that Elijah knew the law better than all those cops did. Right from the get-go, the cops failed to answer yes to the first gate in the process flow, which is simply “ is there a reasonable articulable suspicion that a crime is being committed, a crime has been committed, or a crime is about to be committed?” Reasonable means that there Hass to be some modicum of evidence, such as the collar would say I saw him trying to break into a door of a house. Secondly, articulable would mean that the cops have to know the law, and be able to cite what that law is. Neither of these gates could be answered yes, in the process flow, and therefore they had absolutely no right to put their hands on him to ask him to stop or attempt in any way to detain or harass him. I will repeat for the one millionth time “ suspicion” is not a crime
