  • Attorney Joe Zarzaur and Dr. Evan Malone conclude this three-part client case study series - from a car accident, ER visit, diagnosis, surgery, and how important it is to have the right lawyer to ensure that you are made whole. What seemed like a very simple “whiplash” injury in a car wreck (according to the ER) ended up being a herniated disc that required surgery and a lot of unforeseen medical expenses which totaled more than $500,000.
    CLIENT CASE STUDY: HERNIATED DISC FROM AN AUTO ACCIDENT - PART 3
    THE RECAP:
    1. Client was in a car accident (t-boned) and ended up in the ER. The ER diagnosis was cervical strain/sprain and discharge papers. When you go to the ER and you get that cervical strain back strain, whiplash diagnosis, do you need a lawyer? Most of the time you do.
    2. The conservative treatment phase (with a pain management doctor) and trying to figure out where the pain is coming from, how bad it is. An MRI reveals a disc herniation (a severe injury) on C6 and C7 in the client’s neck. This is six to eight months after the wreck. She did the epidural injections, trigger point injections, and radiofrequency ablation. Unfortunately, those were not helpful.
    3. The client was then referred to a neurosurgeon as a surgery candidate.
    A YEAR LATER - SURGERY
    So, all along before you get to the neurosurgeon's office, every doctor all along the way was looking to see that the disc herniation and pain line up. Many times, the neurosurgeon wants a different MRI because they're thinking about cutting on you, right? It is a very serious procedure that has a lot of risks.
    ANTERIOR CERVICAL DISCECTOMY AND FUSION
    The client was a candidate for an Anterior Cervical Discectomy and Fusion (ACDF).
    Anterior - which means that they operated through the front of the neck.
    Cervical - as in the cervical spine.
    Discectomy - they're going to remove the herniated disc.
    Fusion - fuse that part of the spine, some six and seven to get together, to hold it in place. Since there was not a disc in there anymore, the natural padding you're born with, a spacer will be put in its place. So, they are going to have C6 and C7 as one common joint now, which works.
    This client was in a wreck and she got a cervical strain, whiplash diagnosis from the ER, and here she has now a year later had this procedure.
    Post-surgery, the X-ray shows where the hardware and spaces are. The hardware, the screw goes into the cervical vertebral body folded in place. The herniated disc that they took out of there, is no longer pushing backward on the spinal cord, which is what was causing our client's problems overall.

    This is so accurate I was involved in a MVA in 2018 went to ER with a similar discharge evaluation and 7 major spinal and internal surgeries including fusions both cervical and lumbar and knee injuries inc surgeries which still in 2022 continue having surgeries related to the MVA in 2018, again ER is like he said a brief life threatening evaluation nothing more, that’s why it’s so important to advocate for yourself when pain persists and not just settle with the insurance company and the ER discharge findings, straight away so they can stop having to pay you what your injuries are actually worth, typically a tactic all insurance company’s will use to dilute the actual severity and value of your injuries.

It is certainly important to be an advocate for yourself (or have a board certified lawyer that understands the issues of dealing with insurance companies and can be an advocate for you) and have a voice in your treatment needs.

    I had to have emergency ACDF surgery C5-C6 from a car accident. i went to 15+ insurance examinations and every doctor told me that i was a big boy and it is ok if i lose a bit of strength. And that I was fine and they see nothing wrong. After my insurance company sent me to a specialist after 2 years said that the accident caused my injuries. I can confirm that this surgery is a hard thing to recover from.

      I 100% agree. Acdf c5 and c6 and few months later decompression and lamenectomy of c5 and c6. I am still a mess. May you be blessed to heal. My thoughts and prayers are with you..as a fellow injured person.🇨🇦❤
