Contractors Should Avoid Litigation With Insurance Adjusters

  • I am always looking to avoid litigation with insurance adjusters and insurance companies. I feel like insurance adjusters are usually trying to avoid litigation as well. They seem to want to always cover themselves. Contractors should always prepare for the insurance adjuster visit by performing a thorough and complete property damage inspection, solid and accurate documentation as well as the missing Xactimate line items identified. We discuss how to avoid litigation and instead be anti-litigation when dealing with insurance claim repairs.

    I'm a property insurance adjuster and found what you said really incredibly helpful. It helps me to know what the other side goes through so I know how to help both the contractors and policyholders. As long as documentation is sent to me, that is all I need. I don't want to try to "win" I want to try to come to get the home back to where it was before. Unfortunately we do operate a lot in the gray and that is something I don't always like. It sucks having to tell someone no to a claim when all I want is to the policyholder win. Government regulations suck, but I have to abide by them just as you do. It sucks that I have to say no to a policyholder for a code item just because the item is rusted or damaged. I try to tell the policyholder that we can support it as long as I have some form of documentation saying it is needed. There is nothing more frustrating then having a claim drag out forever. Policyholders also shouldn't be doing a lot of work until both us and the contractors are in agreement so we can support their items as needed. Otherwise, if for some reason I have to say no something, they are stuck with a stupidly large bill that they can't pay and no one wins. Being shouted at over the phone sometimes sucks, but when I am finally able to approve and help out all parties involved, that is what matters.

    So... I read "Delay, Deny, Defend" today.... I need to review and update my policy... Possibly change to another carrier... Lol.

    What really helps I’ve found is being reasonable with the adjuster.
