I did a transaction po for assume balance of my condo unit. it is under pagibig on my name and we did it by Deed of sale and also in the document I waive my rights for claims of the property if I die while the still paying for the amortization of the property. This is the scenario, the buyer paid only half of the agreed Assume Balance price and that she will pay the next monthly amortization and then after a month she failed to pay the 50% balance for the agreed amount. Also, she has not paid the monthly amortization to pagibig. I have no knowledge if she is still using my unit because i am now working abroad away from Philippines and she is in possession of my pagibig documents of the unit and the key. Now Pagibig is reaching me out for the unpaid amortization. What can I do or can I sue the buyer of my unit? What legal actions can I do? I want her to pay the pagibig monthly amortization she has not been paying under my name and maybe still get the 50% of the agreed amount she has to pay me from the deed of sale and assume balance transaction we had.

Sabi po kasi ni Pag-ibig, dapat daw matransfer muna yung title sa name ni seller bago ko po iprocess yung pag assume ng bahay. Yes po if you want to assume the unit. You pay what has been paid by the seller per the amount you agreed with the seller po. Then you continue that payment to the bank. But pls check den if nag allow c bank nyo ng pasalo and what are the reqs.

So dapat sa inyong internal agreement may provision doon if in case c buyer cannot continue to pay po para clear sa inyo on how to proceed. From Pag Ibig perspective, ikaw parn ung owner po so you need to protect ur self din.

Hi maam, first of all, it is unfortunate na the pandemic has brought a lot of difficulty for all of us. To answer your question. It's best to consult with your real estate agent first po on what are your available options. Sayang naman po yung investment nyo. But if ang ipa assume ang gusto nyong option, check with your developer on how to go about it because meron redocumentation charges ang mga developer if may change ng information including change of ownership. Some developers charge 20k while some up to 100k. If matagal2x na kayo nagbabayad ng equity at almost ready for turnover na baka meron buyer na interested. But if bago pa lang kayo nag bayad ng equity at mas mahal pa an redocumentation, baka mahirapan kau magpa assume. But check with your agent po on what are the options and how to go about the assumption process specific sa practice ng developer nyo po.

At pag tapos ng payment ay change ownership nlng ng title. But if hindi kayo comfortable is you do 2nd option which is change ownership right away.

Sir pa advice po. I have a condo unit which is RFO na ngayon. I got it back in 2017 and paid the equity for 18months. Supposedly, turnover date was January 2019. Due to issues sa developer side, November 2020 na nila na turnover. Sobrang natagalan and naabutan na ng Pandemic. My bank loan has been approved now and ready for release na to the developer kaso hinold off ko muna ang release kasi mahirap makahanap ng makakaupa sa condo these days. Kasi I will start paying the monthly amortization na after loan release, eh wala ako budget ngayon. Plano ko na lang ipacancel ang contract. Possibly kaya na ma refund nila ako kahit 18months lng equity nabayaran ko po? Salamat

after you assume the balance, and fully paid with pag-ibig, is the new name be in the TITLE?

Sabi po kasi ni Pag-ibig, dapat daw matransfer muna yung title sa name ni seller bago ko po iprocess yung pag assume ng bahay. Yung developer naman po ng bahay is pinaprocess pa lang daw and it will take 6-8months daw po kaya and advice po is mag internal agreement daw muna kami habang pinaprocess yung pag transfer ng title kay seller. By the way under Fiesta Community po yung developer and 3yrs ng naghuhulog si seller kay pag-ibig.

Yes po if you want to assume the unit. You pay what has been paid by the seller per the amount you agreed with the seller po. Then you continue that payment to the bank. But pls check den if nag allow c bank nyo ng pasalo and what are the reqs.

Sir, problem ko lote ko nabili sa golden city Taytay. Pang 3 owner kasi Po ako. Hi Oscar. Technically the property is still yours po until buyer completely pays the property po. So dapat sa inyong internal agreement may provision doon if in case c buyer cannot continue to pay po para clear sa inyo on how to proceed. From Pag Ibig perspective, ikaw parn ung owner po so you need to protect ur self din.

Hi maam, first of all, it is unfortunate na the pandemic has brought a lot of difficulty for all of us. To answer your question. It's best to consult with your real estate agent first po on what are your available options. Sayang naman po yung investment nyo. But if ang ipa assume ang gusto nyong option, check with your developer on how to go about it because meron redocumentation charges ang mga developer if may change ng information including change of ownership. Some developers charge 20k while some up to 100k. If matagal2x na kayo nagbabayad ng equity at almost ready for turnover na baka meron buyer na interested. But if bago pa lang kayo nag bayad ng equity at mas mahal pa an redocumentation, baka mahirapan kau magpa assume.
But check with your agent po on what are the options and how to go about the assumption process specific sa practice ng developer nyo po.

You have 2 assumption options po. PWd internal agreement lng na sa inyo parin ung ownership but c buyer na mag continue ng payment para wala ng hassle sa documentary changes. At pag tapos ng payment ay change ownership nlng ng title. But if hindi kayo comfortable is you do 2nd option which is change ownership right away.

Sir pa advice po. I have a condo unit which is RFO na ngayon. I got it back in 2017 and paid the equity for 18months. Supposedly, turnover date was January 2019. Due to issues sa developer side, November 2020 na nila na turnover. Sobrang natagalan and naabutan na ng Pandemic. My bank loan has been approved now and ready for release na to the developer kaso hinold off ko muna ang release kasi mahirap makahanap ng makakaupa sa condo these days. Kasi I will start paying the monthly amortization na after loan release, eh wala ako budget ngayon. Plano ko na lang ipacancel ang contract. Possibly kaya na ma refund nila ako kahit 18months lng equity nabayaran ko po? Salamat
