Regarding CGT, it's not just DMCI, it's happening to Shang properties too. There was no proper guidance from BIR or developer back then, so I think it's unfair na biglang maghahabol ang BIR otherwise the title won't be transferred sa buyer, especially if the seller is now nowhere to be found.

Hi Richard. Is CGT required if one is selling prior to turnover, since the title is technically still owned by the developer? Or will the transfer fee be enough? Seems restrictive that a person would need to sell for at least 11% more than their purchase price just to make a profit. That's assuming we allot 5% for the agent + 6% CGT on the TCP (which btw was a shock for me, I thought it was only on the actual gain, hence the name).
Yes, this is the reason why I am doing this vlog to spread awareness. I am pretty shocked people don't know about this. Though it depends on the developer, you can get away with some without CGT, but no guarantee that BIR will not come after you, just like the case I presented in this vlog

Nope wala, this is the first title kya nga DMCI is the one processing it. So from the Developer to the Pasalo Buyer they are charging capital gains. The Pasalo Buyer already paid transfer fees

If the owner took a loan to pay for the unit. and the first x number of yrs carry the highest interest rate. along with the rate fees that come with closing the deal. The real winner seems to be the seller. when actually most time your the one saving their butt from very high interest rate. Yes you get the unit at the old price. But you also have to pay them back all the high interest rate. when interest doest equal equality. How does this work in my favor?
In general you should not pay the interest you did not take. However if the interest is lower then the capital appreciation (lets say 6% per year condo price increase is at 10-12% per year) in general it will end up in your favor. Yes you earn less but you still win. Check your planned strategy when buying this unit

Both are completely different, Pasalo you usually you get little to no profit from it, and the intent of pasalo most of the time is to dispose the unit or at least to retrieve most of your investment. Flipping is entirely the opposite, you profit massively from it, usually 80%-200% profit within a few years or even less.

Question po sa pasalo condo. Meron po akong nakuha na pasalo na condo 1.2m ang balance sa PAGIBIG, 28 years to pay. Siguro po kaya kong i-fully paid ng 7-9 years, including na po ang interest. Ano po kaya ang mas maganda na gawin? I-fully paid ko hangang ma-transfer sa may-ari ang title para ang babayaran ko na lang ay ang transfer of title sa Pagibig at capital gains tax? How about the policy when you transfer your payments to another tower within the same project? My developer said only 70% of my total payments will be credited.
Should be fully credited as upgrades are always favourable to the developer. However, it would depend on the agreement written in the contract to sell.
@@RichardCarvajal I am a victim of that. I was even deducted 50 % . And I do not see anything wrong with the transfer since I acquired a bigger unit on the same project. Only reason was " management decision " daw but no clarification on what basis 🤔

Wala namang kaming binayarang 3months advance payment sa DMCI nung binili namin sa seller. Transfer fee lang. isa pa din sa pinakamura ang DMCI P50,000 unlike other developers
That's because the process of DMCI is to hold the postdated check of the original buyer for 2-3 months, even after you buy the property. Meaning di mo siya naramdaman kasi including yung advance sa payment mo kay seller. DMCI does not allow check pull out until the CTS of the second buyer is ready for release (which takes 2-3 months) so during that time check parin ni original buyer ginagamit but in cases the buyer has no money to shell out or nag bobounce na check niya you will be the one to shoulder it in advance
Then as per the release of the new CTS, DMCI will still use the one month check of the old buyer. If the CTS was released September 15, the new buyer would only start paying via post-dated checks by October 15 even if you purchased the property in July. Usually nangyayari sa pasalo for dmci wala na talaga cash yun seller so you will have to advance it

Why in the world would I pay the previous owner all of what they paid into the condo? So they pretty much lived there all that time for free then? Most times I thought pasalo is used when the owner, for one reason or the other, is unable to or having difficulty paying the mortgage. Flipping is a strategy you buy you earn, and you sell in a short amount of time. condo pasalo is selling at minimum gain, breakeven or getting your money back lang

Wala namang kaming binayarang 3months advance payment sa DMCI nung binili namin sa seller. Transfer fee lang. isa pa din sa pinakamura ang DMCI P50,000 unlike other developers
That's because the process of DMCI is to hold the postdated check of the original buyer for 2-3 months, even after you buy the property. Meaning di mo siya naramdaman kasi including yung advance sa payment mo kay seller. DMCI does not allow check pull out until the CTS of the second buyer is ready for release (which takes 2-3 months) so during that time check parin ni original buyer ginagamit but in cases the buyer has no money to shell out or nag bobounce na check niya you will be the one to shoulder it in advance
Then as per the release of the new CTS, DMCI will still use the one month check of the old buyer. If the CTS was released September 15, the new buyer would only start paying via post-dated checks by October 15 even if you purchased the property in July. Usually nangyayari sa pasalo for dmci wala na talaga cash yun seller so you will have to advance it

Why in the world would I pay the previous owner all of what they paid into the condo? So they pretty much lived there all that time for free then? Most times I thought pasalo is used when the owner, for one reason or the other, is unable to or having difficulty paying the mortgage. This is a foolish concept, hard pass- I'll just bid on it when its on foreclosure.

They started year 2007.I was aware that they don't pay on time ..and this year 202O pandemic to they missed paying for April n May.i ask them to pay but they threatened me to reported to Raffy Tulfo dahil ginigipit ko DAW cla .during that time the original buyer told me that she doesn't live in the property but her brother till now they have not yet paid the 2020 April n May ..and the contract will end on January 2023.Do U think they have the right to gain the property?,Because according to the contract they sign once they missed any payment will lose their right or option to buy the property n any late payment will incur 2% interest which is totally ignored by them.I don't know wat will happen.Pls Richard can U advice me.Thank you

Is condo pasalo same concept as flipping po ba? Or exactly the same po sya?
Flipping is a strategy you buy you earn, and you sell in a short amount of time. condo pasalo is selling at minimum gain, breakeven or getting your money back lang
