Im in a 30 year age gap relationship i know quite crazy and controversial but my hot take is there are no rules to life ,do what truly makes you happy .My partner and I are aware of the challenges we will face in the future when he's in his 70 and im no where close . We've had raw and open conversations about it .Our values align and we just get eachother.And i agree with Lydia being with an way older partner definitely ages you .But we have boundaries and im aware he can't be going clubbing with me and i dont join him for his old boring stuff .We do our age appropriate things separately. And meet at home later.We found a balance where i compromise and he does as well .

Political leaders are more likely to support laws that align with their own belief systems. Sometimes we forget that our religions may stop us from doing certain things but we have no right to force people who don't believe the same to not do those same things. On what Lyd is talking about there is something called the principle of presumption of marriage. The popular case of Hotensiah yawe v public trustee lays down the nitty gritties for that. The law doesn't automatically presume that you are married and thats why the parties need to prove that they intended to be married etc. It normally comes up during succession mainly and it's not a good place to be . The courts are starting to be very skeptical on marriage by cohabitation. So gurl just go get legally hitched or traditionally instead of being eternally a cohabitee. It's a dangerous place to be.
Marriage act did away with presumption of marriage. Murugi's position was correct. However there are rare instances where the court presumes marriage but the burden to prove is on the party alleging as per the recent supreme court decision

The recent supreme court declaration is that the principle is on its death bed and that is why I said the law will not assume you are married because you are a cohabitee but when raised in court then the court will determine if the principle is applicable to you or not but the onus is on a party to prove that.

I agree with Murugi about abortions. There’s so many situations that lead to one wanting an abortion. I was also in school in SA and I can say sometimes people have sex and live in delulu land by not taking any birth control and just thinking pregnancy is a myth. And with some it happens many times. Once is okay maybe they didn’t know about contraception but surely the second time? That’s ignorance to a certain extent. It’s also quite interesting how sometimes people choose which side they want to be on in such situations. The law or the religion you apparently follow🌚 or when the situation happens to you or someone you know the opinion immediately changes. There definitely should be more education on contraceptives and like Lydia said, people have access to google. Use it.

Cohabitation is no longer considered a marriage anymore in Kenya. After August 2017 I believe every person must register your marriage. Previously cohabitation was considered a marriage if you satisfied the ingredients of marriage.
I don't know about the adopted guy thing, guys. I think in the spirit of vulnerability, I want to know these little things that mean a lot to my partner. There is no rationalizing why its really important, cause in the bigger scheme of things its not, but just knowing what someone's upbringing was like is very important to some of us. There’s something called common law marriage where there’s a presumption that people are married after they live together acting as husband and wife for a certain length of time.
In Kenya the law is very clear. Marriage must be registered. Even Polygamous marriages must be registered with the registrar of marriage. Please be informed and always have a lawyer who you can consult on matters law. Many people assume a lot of things.
My apologies, I should have mentioned that the common law marriages are recognized in some states in the US jurisdiction. But I am glad to know that is not the case in Kenya. Thank you and Good topic to discuss
Common law is applicable in Kenya unless there is an express statute that deletes it. Presumption of marriage is still an applicable principle though the parties need to prove that there was intention to marry. The principle is on its death bed though ( latest assertions by the supreme court)
@ajehlenechoiga3023 also the parties must have capacity. A party lacks marital capacity if they have contracted a previous monogamous marriage. Hence there cannot be a presumtion of marriage where one party is already married either through church, civil or hindu marriage. However where one was previously marrried through customary marriage which is inherently polygamous then the person has capacity and a subsequent presumption of marriage can stand.
On the pre-nup issue, prenups are not only to protect wealth. That used to be the belief because of what we saw in celebrity divorces. However, it also includes protection against your partner's debt that they had before the marriage, inheritance they might get, protecting your children if you came into the marriage with them, some people even use it to include an infidelity clause - if you cheat, I get this amount of money from you.
The issue on adoption.. I would definitely tell the man it would really itch me, because of hereditary disorders, majorly about health that would affect the relationship and the family we want to establish.. Plus..I think it would pain the man more to know that I knew and I didn't feel the need to share..it's a whole different case if the man knows .I'd totally respect that
