The reason for Charlotte races to be mentioned is for jurisdiction. NASCAR must have ties to the area to sue them there. Likely the first challenge to the suit will be nascar wanting to move the venue to Florida.
From my understanding not only is that provision in there so that they can't make their own stock car racing alternative but it exists to make it more difficult for a team like Rick Ware to go race their Lamborghini Aventador. It might even make it more difficult for someone like Tony if he wasn't leaving the sport to operate his drag team.

Oh and the tax filings could get interesting, if it comes out that the books were cooked for years. In all likelihood, this case will eventually be dismissed with a big PR, egg-on-their-face moment for nascar. First, Jordan doesn't have an anti-monopoly case here, as Indycar does exist and has a decent niche in the market. Second, all these teams could have coordinated a mass protest by having no team sign the 2025 agreement, then nascar would have no teams competing next year (at least not the big ones). Nascar is in the wrong here, but this case should not seek to be the death-blow, but the opening shot in a case that will play out more in the court of public opinion. Once the case is dismissed with all the attendant bad publicity for nascar, cuz MJ can whip up publicity anytime he wants, then the joint suit gets filed. The initial claim is to try to get nascar to admit that the teams could have just walked away and not signed the 2025 contract. The joint suit is multiple teams suing nascar for entering a contract renewal/extension negotiation in bad faith. Meaning, based on the history of the relationship between nascar and the teams, nascar entered negotiations placing no value on the past good working relationship and even attempted to undercut the previous good will knowing that the teams have a lot invested in the endeavor. The teams would be more inclined to accept predatory conditions to protect their previous investment. This is a textbook example of negotiating in bad faith. If there is a follow-up lawsuit, nascar is in big trouble, which they have brought entirely on themselves. If Penske, for example, were forced to change aspects of their current business plan to comply with a predatory contract, Penske could sue nascar for ALL lost revenue. I could see a world where the France family essentially gives Penske a whole bunch of money which he uses to fund and promote IndyCar. 23XI could get a chunk of money and pair that with those Air Jordan dollars and buy nascar out from under the now financially destitute France family. Regardless, nascar f*cked up. The courts will likely side with the established institution, because the us court system is completely corrupt and broken. But, Jordan is not just some pleb asking for what's right, so who knows?
