- More than two years after a gun held by actor Alec Baldwin went off on the New Mexico set of the film “Rust,” Baldwin is preparing for his manslaughter trial. The bullet from Baldwin’s gun hit the film’s cinematographer, Halyna Hutchins, and director, Joel Souza. Hutchins did not survive. Hannah Gutierrez-Reed, the film set’s armorer, was recently found guilty of involuntary manslaughter and sentenced to 18 months in prison. Law&Crime’s Jesse Weber does a deep dive into police body camera video and interrogations from the day of the shooting, plus what we learned from Gutierrez-Reed’s trial and its possible impact on Baldwin.

I still don't understand how live ammunition ends up on a movie set. The whole thing is such a mess of a tragedy.
It got there because Hannah had live ammo from another set in her car, and she mixed the two together.
Seth Kenney supplied the ammo. When you watch his behaviour after the shooting & listen to him discussing Hannah it’s clear he is manipulating law enforcement. The photo evidence of his shop showed a chaotic & disorganized mess. He had no inventory system. IMO he played a role as well. David Hall as well. Ultimately it was her job & that is why she is in jail.
I don't understand how any one can't check a gun that is handed to them. It's literally the first thing you do.

There's no excuse for an actor to fire a gun at a cinematographer. Especially a gun that wasn't inspected by both the armorer and actor together. Alec felt comfortable shooting at Halyna, at close range, without knowing whether his gun was safe..
Exactly. That is the biggest question I have. Someone told me she brought it from another movie set. Which...again doesn't answer my question. I think she had a coke problem and mixed them together when she was high tbh.
Of coarse he didn’t listen to the safety meeting. He thinks that he knows everything. He thinks he knows because of all of the movie sets that he has been on. He is full of himself and doesn’t care about safety. He seems pretty selfish as a person for sure.

But he didn't load it, it is legal to assume the armourer was doing her job, as you would in the work place
No we have the "Alec Baldwin Rule" on gun ranges around the US. Be absolutely positive that the gun is not loaded and don't point it at people.

You might think the actor is an unaccountable victim in this matter. But in reality he is more of a licenced operator of a firearm just as you are a licensed operator of a motor vehicle.
Actors go through training courses and attend safety meetings. There are rules regarding safe conduct and operation of a firearm (live or not) and let's just say Alec violated at least 3 well known rules with his reckless operation of firearms.
You're supposed to treat all guns as if they are loaded (even if you think they are not) specifically to safeguard against this exact scenario.

The gun didn't just go off. He pulled the trigger.
As much as I despise Baldwin, I have to admit that he is an actor and not a firearms enthusiast, who knows nothing about guns. He, like so many other actors, hire "professionals" to insure the firearms on the set are safe to handle. Hannah was rightfully found guilty of manslaughter as it was her responsibility to keep the set (actors and crew) safe in regard to the firearms. Now if Baldwin is charged as being the producer of the film, that's another thing and it will be interesting to see how the case is tried.

I agree. I feel like this is wrong. I worked on sets, mainly theatrical propfire guns only firing blanks.
@@deborah3912 Some have said that, but many more said they don't even know how to check a gun. On the vast majority of sets, there is no live ammo anywhere around. That's a big part of what the armorer is supposed to assure.

Incredibly, after going back to work on Rust, after he pulled the trigger and shot Halyna to death, he continues to recklessly reject safety protocols. AGAIN. One time was just not enough, Alec?

It’s crazy to me how both of them are so flippant and concerned with themselves. If I found out I killed someone, especially someone whose safety was my responsibility and I considered a “friend,” I wouldn’t be able to be so calm.

What I feel it comes down to: Was there _already_ an established expectation (ie written rules) for actors to check the gun that is handed to them before proceeding? If yes, he is guilty of the charges. If no, then I think he'll be acquitted. After all, he was handed a gun that he was told was "cold".
There are written rules for always treating the gun as if it’s loaded and not pointing it at others. Both of which Baldwin ignored

I don’t see why gun shot residue would matter. It was never in dispute that he was the one who shot her, the question is if he should be held criminally responsible for it.

Hollywood does not make its own laws. If you are camping and your friend hands you a gun, says it has no bullets, and you point it at someone and shoot, you are lawfully responsible for that death, if one occurs. All seasoned actors will say, and are saying, that they check every gun first before firing it. That is their legal and moral responsibility. Alec Baldwin hired this reckless person and he continued to witness her shocking behavior. But since he was behaving the same, and never checking his gun, along with his other unbelievable behavior, it didn't matter to him... Until he shot Halyna and he was scrambling for a scapegoat. The two of them working together was a bloodbath waiting to happen. They are both responsible and neither one has shown an ounce of remorse. A 14 month sentence? What a cruel joke for the family. They should each get 15 years.
18 months is the maximum for involuntary manslaughter. It's New Mexico, where criminals get off easy. It would have been up to 15 years in Florida.
I don't care why the gun went off. It would NOT have killed anyone if it wasn't pointed at them.

@@warhammerfactionActually yes! Most scenes show the shooter firing, the scene shifting to the shootee reacting. When it is necessary to have both in the same scene, additional precautions are taken. None which were taken here!

You never wave a gun around or point at anyone with a finger gun made with your hand or a real gun everyone knows that. They should always be treated by everyone as they are loaded.

How does live ammunition arrive on a movie set? Why don't the actors check their arms?

It's not their job. Their job is to act and if they do fire a gun in a scene they get it from the Armour (usually with the words: hot gun!) Then they immediately shoot the fire scene where they do NOT aim at any person. When the take is done the armourer takes the gun back and hands it to the actor again for the next take. And as always every weapon is handled as hot at all times!
In the end if the armorer doesn’t bring live ammo on the set. Doesn’t load live ammo. This case doesn’t exist.

I dont understand why Alec Baldwin is being pursued in this sad situation. He was an actor who was handed a gun that was supposed to be fake or at least have blanks and it wasn’t. Actors shoot guns in movies all the time. He is an actor not a gun expert and just uses the props given to him.

Not only was it HIS production where many people quit due to safety issues, he was shown on screen being absolutely reckless with the gun pointing it at everyone! Not only that, you treat ALL guns as if they’re loaded. This is not the norm in Hollywood which is why he said he didn’t pull the trigger, however, he must have pulled the trigger in order for the pin to fire.
This argument is getting old. He is still required to handle the real gun responsibly. He cannot point it at crew members and pull the trigger. It violates safety regulations for film sets and NM law.

@@kazshaw3945 he refused to listen to firearms training. In fact there was an armorer before her that he refused to listen to so they left the set and got a new one. It’s common sense to double check if a gun is loaded especially before aiming it at someone. He should have known better and his bogus excuse about not pulling the trigger is a bit concerning. The armorer isn’t really to blame here. Baldwin thought he knew everything since he’s been in several movies and has used props but never did he think to actually take firearm safety seriously. Should the armorer lose any gun licenses they have and never be allowed to work in that field again? Yes, I would say so, but she wasn’t the one who pulled the trigger

It’s a bit like the Titanic. A series of mistakes and failed safety warnings led to tragedy. It took a lot of people doing the wrong thing for the “Swiss cheese holes” to line up. Everyone shares a small amount of responsibility.

Imagine another circumstance when a leader relies on the team to do each of their jobs correctly in order to do those, for example a surgeon, they rely on other people to clean their equipment, hold things etc etc. if something wasn't cleaned and led to an infection during surgery would you go after the surgeon? I think it's very similar. Quite funny when prosector asked if the boss was the boss basically lol. I don't think anyone should be put in prison really but if there wasn't live rounds noone would be no longer here quite simple. I would be looking into who made this happen not the end result

The armorer is criminally guilty, as is Alec. She did he job wrong, and handed off a hot gun. Criminal negligence on her part. Alec had employees quitting because of safety issues, and even named gun safety as one. That very well could indicate Mr. Baldwin was aware of a potential problem and chose to ignore it. Negligence that left a woman dead. Negligent manslaughter.

Halls took a plea deal. Baldwin grew up handling guns. Defense will have a hard time showing he didn’t know about guns.

It's not reasonable or expected for an actor to assume a prop gun on set has live ammunition in it as live ammunition should never even be on set. He will walk because there's no intent here. The armorer gets paid solely to prevent this from happening.

That's the most important thing in the whole case. Who placed a loaded gun on the set? Nobody would deliberately kill someone in front of everyone...🤔

Hana caused all of this. Had this person had any professional integrity in the slightest no one would have died, and we would all be enjoying this film in theaters. While yes Alec has Director credits, his job function at the time of the incident was to be in character. When you are an actor, in character, you rely on the crew to keep you safe.

Yes they do. If he was following normal procedures then he wasn't being negligent. On a set the armour is responsible for the weapons not the actors.
But it is required that he handle the gun safely. That means not pointing it at crew and pulling the trigger. Especially not pulling the trigger when special safety precautions haven’t been taken because they are only rehearsing and not filming. He violated safety rules for actors on film sets and NM law.

Alex should be found Innocent. It was not up to Alex to make sure the gun was empty. She the armorer should be held accountable on all counts.
She was already found guilty, this type of crime is unique in its nature so the jury gets to decide what the "norms" are for this type of crime. I think the actor needs a degree of caution when handling weapons, and if it is proven that he has already pointed his REAL gun at other people before this and pulled the trigger then he is 100% guilty of negligent manslaughter
The armorer has been convicted and sentenced for her role and crimes. But Alec must now answer for his role and crime as per the law and case law. The last person in the chain of custody of a firearm is always responsible for what happens no matter who handled the gun before him. He pointed a gun at another person, cocked it, pulled the trigger and killed her. He is guilty of a negligent homicide or a manslaughter charge...no doubts.

Both Hannah and Alec, in my opinion, are guilty because both of their actions (or inactions) contributed to Halyna's death. If ONE of them had acted more responsibly, the incident wouldn't have occurred. It took the negligence of both of them to get where we are today. Ironically, that fact also makes it easier for each of them to put the blame on the other, but they were BOTH doing something they weren't supposed to. I feel Hannah is slightly more culpable because of her role, but Alec should absolutely be held responsible for some degree of negligent homicide.
I absolutely cannot stand AB but this case is ridiculous. He's an actor that is depending on the armorer and the first assistant director to check the guns. Dave Halls should have gotten a much stiffer penalty. If the standard "don't point a gun at anyone that you don't intend to shoot" applies to movies then there would be no shooting of any guns in any movie. The fact that it is a movie makes it an exception, the fault lies with the TWO people who are supposed to check the guns, especially the armorer who was a hot mess.

There are multiple responsible parties. Regardless of what's in it, he had no right to point a gun at someone.
The one that truly deserves life behind bars is the armorer. At the end of the day she's the one that was responsible for all the weapons on set.

The bottom line to this whole story is why on Earth was there a live round even near a movie set. It's a f$$king movie, the comedy of errors leading up to this is quite long. Also, how isn't this manslaughter? It's in the definition of it.

For a long time i felt this was an accident and no one should be charged, but now i am not so sure it wasn't negligence because it seems like there is reasonable expectation that Baldwin was aware a person should not point a gun of any kind at anyone on a movie set.
That changes things for me when it comes to negligence, even though i believe it was an accident and he didn't intend to harm anyone.
Another relevant question prosecution might want to ask: "When do film producers, who are developing scenes where humans will fire at each other, ever stock live ammunition?" I don't believe the actor is at fault under conditions where no one should ever expect a live round to appear!

Why have we not heard of any effort to determine who loaded the weapon, and whether or not the angry parties who stormed off of the set were in a position to make contact with the weapon? It's a bit convenient that after a series of nasty posts on social media, regarding Alec Baldwin's safety policies, a live round appears on set which can't be detected by the emotionally-vulnerable armorer.
Hannah Gutierrez loaded the weapon and she got convicted. She's serving 18 months. Its fairly clear this is nothing more than incompetence on the part of Alec and Hannah
