Can I Apply for a Change of Status from ESTA to E2?

In this video, I discuss a recent consultation with a gentleman who is currently in the United States under the Visa Waiver Program. He wanted to know if he could apply to change his status to an E2 visa. Unfortunately, I had to inform him that it's not possible to change status if you're under the Visa Waiver Program. However, I explained that he can use his time here to prepare his E2 business, scope out business opportunities, and get his investments in place. I also mentioned the benefits of not being able to change status and the importance of the E2 Visa for retaining travel privileges and mobility / freedom.

Bitnlets say hé stays 91 days with a esta then hé can do the e2 right ? But hé have to stay 2 years in the us right ?
