I came here on B-2 in 2014 - I was allowed to stay here for 6 months, then I extended it for anothr 6 months, and then switched to F-1.... I am a U.S. Citizen now. Never had any issues with the extensions.
While inside the US? Where do you get this statistic, for any one who might be thinking? It would be amusing if an experienced immigration lawyer was wrong?
The only person who is wrong is the one who has NO education or extensive experience on the matter. I'm a professional. If someone tell me that to my face -without any evidence based research I would think of this person -who said wrong- as just a fool

My mom extended b2 visa during covid travel ban. My moms visa extension was approved and she stayed and stayed but later b2 visa expired so she applied for visa refused and given 214b saying no indian ties.
He was not wrong at that time. 2 month after he made that video there were some adjustments that allow people with b1/b2 visa to try changing their status without being outside of the USA
Great advice!! Just get the best attorney you can find at the slightest need, then listen to them. It is nearly impossible to go wrong with a great attorney. Treat your case like cancer. Hit it hard with the best possible effort immediately. Don't mess around. It can be very very very expensive, long and hurtful if you don't try the right way immediately.

This is my exact case. I filed for a change of status and it ended up being denied after 10 months. I exited the US soon after I got the notice and now two different embassies have denied my visa petitions. This is after a very long history of compliance. I was absolutely not expecting this to happen otherwise this idea would have never come to my mind. On the website at the time it said that the expected wait time was two months. It of course wasn't true. I kept calling USCIS telling them that my stay permit was expiring or had expired and they would keep repeating that my stay was lawful and there was nothing to worry about. There was a lot to worry about apparently. I am now paying for their false promises, inefficiency and false reassurances.
Yea, I can attest to that. I overstayed my visa trying to acquire at least 3 IT certifications for my job back home in the time given. Overstayed by about a week, going back home with 2 Certifications. 5 years later, I am now tasked to go to conferences in Vegas for the job, and even tho I explained what happened to the Boss, he said, nevermind about that, apply for your visa, and I did. Consular Officer had a field day with me on that one. Kept shouting at me, WHY DID YOU OVERSTAY YOUR VISA?? And I kept telling him I just got too ambitious and wanted those certifications. He insulted and berated me in front of everyone in that waiting hall, and at the end of it, he said, "You Visa has been approved! ..NEXT!!" Look, I'm not gonna lie... at that stage, I just felt like telling him it's ok, I don't want it again.

I'm an American citizen, 50yo, and receive SSDI income. I met my partner 6 months ago on Filipino Cupid match making site. I'm a paraplegic with epilepsy and unable to travel to the Philippines which is a requirement of the USCIS whereby I first travel to visit with her and then provide this proof to them upon my return to the US and then filing for the K-1 Visa (I-129F) form. I'm hoping my partner can come to the US under the Visitor Vias whereby she IS NOT my fiance (I have not asked her to marry me) but she is only coming to the US so we can spend time in person with each other. So if she would come here under the Visitor Visa whereby having informed the immigration officials of her intentions to come here to spend time with me and then we would happen to want to get married, will there be problems with immigration office

This is wild advice. There are many, many situations where it would be prudent to file to extend or change your status (or have a petitioner file to change your status) in the U.S.
Sure there are...most jim is spot on when he's saying some people do not have legitimate enough reasons to extend/change status, and it can hurt them later on. Plus, pending times for these b-2 extensions take forever (although the good thing is there might be premium processing for I-539s later on).
@@David-jv3dw Only if they are going for adjustment of status, which I was not discussing in my comment. There are many nonimmigrant status classifications to which an individual can change status based on a successful petition filed by a petitioner.
So essentially, besides absolutely nothing, what can a canadian do to be able to spend more than 6 months a year in the US if he is not going to marry, doesn't have a bachelor degree and is not a multi millionaire?

If nobody ever should file a I539 why does this option even exist. Im sorry but that makes no sense to me. You are the only one who is totally against it. Then why even USCIS recommends H1B who got laid off to file cos to B2 while looking for a new job.
Everybody's situation is different. Moreover, changing status is significantly different than extending status. I tried this for my mother-in-law. We asked to extend for only 3 months. I filled out everything per instructions, as well as providing a cover letter explaing the reason for extending. I believe we were granted the extension because not only we followed all the instructions, but I assured that my mother-in-law will continue to stay with us. No additional risks would occur because of the extension. But everyone's situation is different. I would love to see what they wanted, and/or how they applied.

Hi Jim, I have an H1B Visa that expires next year in July. However, I just quit my job and am leaving the US to pursue other career. Go back to your your country if you get Into a Pickle. And resolve your issues - From your home country. Then you don't have to disagree w the Attorney. It will be costly and time consuming. Absolutely. But it would be best. To stay credible in your promise- before you entered the US.
Hi Jim, thank you for sharing this info, now I do have a question coming up, my parents overstayed their B2 visa at the beginning of the pandemic 2020, they supposed to be here for 3 weeks and they overstayed for another 2 or 3 weeks because they were freaked out. @@moyathompson8884 I work with clients that do visa extensions and status changes all the time. approval rate is extremely high and those are very helpful tools for people that don't have American relatives. But Jim works mostly with family related cases, so I get it that he has not body of evidence for other situations.

My girlfriend applied for I-539 and we ended up getting married before her extended status would have ended if approved. Will this affect her green card application? Should she submit a letter withdrawing her I-539 as it’s still pending and say she is withdrawing it because we got married and she is applying for a green card?

@@jolandatombolinidellavalle8285 For her I-539, she received a RFE, saying they noticed she didn’t leave as originally planned and saying they saw she had an i-485 application now. The RFE said to either provide evidence she’ll be leaving if she wants to continue with her I-539, or submit a letter to withdraw and cancel her I-539 application… which she then did. Now I’m wondering if this will effect her I-485 application though. Any opinions are much appreciated here. Thanks.

No, if you were holding a valid status at the time you filed your adjustment of status application, you will be in a period of authorized stay (although, technically without status) after your status expires, until your adjustment of status application is adjudicated.

Hi Jim, I have an H1B Visa that expires next year in July. However, I just quit my job and am leaving the US to pursue other career. So, my H1B visa would no longer be valid even if it expires next year.
I would still love to visit the U.S. for tourism purposes.
How long should I wait to apply for B1/B2 Tourist Visa?
Would there be any problem if I apply right away after I leave the U.S. as my H1B visa expires next year even if it’s not valid anymore?

I filed for the extension and it was approved and I came back to home county within the 5 months of extra 6 months periods and now after 1 year and half I have applied for my F1 visa from the home , will it effect my visa or since it was approved it’s a good thing and I will get my visa??

False I've extended a lot of times while in the US and been approved. You just have to have the right paperwork, and you'll be able to do it.

Go back to your your country if you get Into a Pickle. And resolve your issues - From your home country.
Then you don't have to disagree w the Attorney.

Hi Jim, thank you for sharing this info, now I do have a question coming up, my parents overstayed their B2 visa at the beginning of the pandemic 2020, they supposed to be here for 3 weeks and they overstayed for another 2 or 3 weeks because they were freaked out. Is this gonna be a problem for them to come into the US to visit me? Should I prepare any documents or statements to show to the border customs for them to come visit me again in the future? @@moyathompson8884 I work with clients that do visa extensions and status changes all the time. approval rate is extremely high and those are very helpful tools for people that don't have American relatives. But Jim works mostly with family related cases, so I get it that he has not body of evidence for other situations.

My girlfriend applied for I-539 and we ended up getting married before her extended status would have ended if approved. Will this affect her green card application? Should she submit a letter withdrawing her I-539 as it’s still pending and say she is withdrawing it because we got married and she is applying for a green card?

I have the exact same situation, that’s what my lawyer suggested me to do at the time…now I’m trying to apply for adjustment of status through marriage and idk what my status is or what an I supposed to do with thath I539
@@jolandatombolinidellavalle8285 For her I-539, she received a RFE, saying they noticed she didn’t leave as originally planned and saying they saw she had an i-485 application now. The RFE said to either provide evidence she’ll be leaving if she wants to continue with her I-539, or submit a letter to withdraw and cancel her I-539 application… which she then did. Now I’m wondering if this will effect her I-485 application though. Any opinions are much appreciated here. Thanks.

No, if you were holding a valid status at the time you filed your adjustment of status application, you will be in a period of authorized stay (although, technically without status) after your status expires, until your adjustment of status application is adjudicated.

My dad has a b2 visa as a tourist and he wants to extend his time in the United States so he can apply to change his status by applying for the I 130 and since I am a US citizen I wanted to apply for him using the I 130 form. My question is, if he is willing to change his non immigrant status by using the I 130, can he still apply for the I 539 just that way he does not remain illegal in the country?
