      Them spitballing that Trump set up his business, in the eyes of Qanon believers, to hire people who he thinks would commit crimes (for him) to be locked up is what they sort of already did. When Trump fired one after the other in his cabinet, mind you him hiring them in the first place with the regular: "This is the greatest guy...blahblah" drumrolls when appointing them, they said that he was clearing the Deep State and 'dRAiNing tHe swAMp'

      @Peg M other countries have corruption but America is and ever since WWII, has been considered the moral compass of the world. The whole lie of American exceptionalism is that we're supposed to be the good guys (forgive me if you're not American). That blatant and unashamed hypocrisy is why the corruption is so damning. We're not living up to the ideals we tout.

    "Only when we recognize that the entire structure is a criminal enterprise"... Man, I felt that as someone who works in health insurance. We've been legalized and granted legitimacy, but at our core, we're a protection racket. "If you pay us every month we'll make sure nothing unsavory happens to your kneecaps, if you know what I'm saying".

      @@SuzanneWho You know, not that I know of as an in-depth dive on the subject. But they should, it's fascinating. My company is the one that engineered the concept in Texas, and did so in good faith originally before turning it into a for profit venture. Now, working on the inside and seeing the corruption and discrimination of the industry first hand, I can't fathom how an idea that's so blatantly profiting off of misery ever took hold.

      A man with a briefcase can steal more than 100 men with guns. All the talk about looting during 2020 is nothing compared to David Perdue and Kelly Lofler getting inside stock information about the pending shutdowns, and sold a bunch of stock and made millions.

      Yeah, because people who, for example, shop lift, don't have teams of lawyers and millions of dollars. Not to mention, shoplifting is much easier to prove in court. Enlighten me, what method of investigation would you go about to gather evidence for a white-collar crime? What type of white-collar crime is it? Who is the perpetrator? Who are the victims? And people say studying criminology/criminal justice is easy and stupid...

      It’s because for some people, criminal is always a noun, rather than a verb. The wrong kind of people? They’re criminals, and it’s just a matter of time before the law catches up to them, whether or not they actually break the law. Because they’re criminals, and if the law isn’t doing something about them it’s because either they’re so shifty to not get caught, or the law should be rewritten so it can go after them. Meanwhile, even if the right kind of people commit criminal acts, they’re not actually criminals, and HOW DARE YOU suggest that those fine people are criminals due to their actions.

    ugh I'm so glad you're making the connection of poverty and street crime to wage theft and white collar crime. Even more glad that you're drawing the connection to the trump cases. It is so desperately needed that we understand the gravity of white collar crime, now is such a great time for this conversation. I really didn't think anyone in the media would ever connect the dots like this, I am SO glad you did Jon, and brought these guys on!

      This was so well explained through this debate. They brought a major issue claimed by lowly citizens, on all sides of the fence, and tackled one of the major smokescreens in place to avoid not only the real solutions, but keep the narrative so they will be unwilling to see through them.

    I would suggest that we use the term "organized crime" for corporate crime, which is an entire system that encourages crime. "Mob crime" is a mirror image of corporate crime.

    This is brilliant. Under any financial page it would be incredibly dry but with Jon Stewart, with his intelligence and humour, it is very much very easy to understand and stick with. Keep going Jon.

      The real takeaway is the fact that 99% of well educated Americans know all this, even though their knowledge might be subliminal, but many ignore the implications and results as they feel they can avoid the downsides. The salvation is in the fact that the next generation will not produce enough blinkered individuals to maintain the critical mass of apathy required for this system to feed upon itself. Although you will have a larger oligarchy, the middle class will be smaller and will ally itself with the exploited masses, especially when they start lubricating the guillotines. Never forget, to gain power today the idiots in charge do not realise those people will still have their AR15s tomorrow.

    Walmart settled in the BILLIONS for their role in the opioid epidemic and no one was held accountable. But they’ll want to see your receipt upon leaving their establishment in certain neighborhoods.

      We, the people, don't stand up and fight anymore! We hear what is going on. Like Walmart, and we shake our heads and remind each other how greedy these people are and the system is one-sided, etc. Yet many people still shop at Walmart, they still keep their money in certain banks. They vote for those running for office when they know they are crooks. We don't come together anymore and oppose the system together. Boycott, sit-ins, etc.

    Everyone should be sharing this with the people they know. This stuff is at the center of all the issues we face. We’ve been in the middle of a class war for 43 years being fought by only one side.

      It's been on the internet for over 20 years. Nobody cares to look it up. Besides, this isn't compelling enough to be on CNN, MSNBC, or Fox News. Only violent interactions involving White cops and young Black men are. Enlighten me with your little brain though. What is the one side's solution to this class war? Ending capitalism? Instituting a socialist society where the merits of your work no longer matter? Should people just get paid the same for whatever level of contribution they make?     This is one of the best discussions I've ever heard. Seriously. I'm 65 and I've wondered why people are NOT held accountable for all the horrific destruction carried out against all of US and everyone all around the world.
    We must hold these elites accountable OR all will be for naught...

    In France, we have been struggling with president Sarkozy prosecutions and trials for more than a decade now. I would love to see you discuss the matter with the french journalist Fabrice Arfi, head of the investigation departement of the free journal Mediapart. His journal revealed some of the President affairs, he is a clear expert on the topic and he is an adorable human being.

      Ex--President Jacques Chirac was convicted for putting his party staffers on the city payroll when he'd been Mayor of Paris years earlier. His party repaid the equivalent of the salaries. Sarkozy's stuff is more complex.

      It seems there are healthy democracies (relatively healthy, there are major headwinds everywhere) that are willing to prosecute major politicians like France and South Korea. And there are also those who do not, usually for fear of bad outcomes. The US is attempting, seemingly, compelled by massive and obvious criminality, to transition from the latter to the former.
      I think looking at countries who do it without major breakdowns is informative, but perhaps not as much as looking at others who have transitioned.

      Non-violent felons in California don't spend time in jails. They are released quickly to re-offend. How's that sit with you Jon?

      But I’m curious to know what your opinions are on how well non-violent felons do when they are put in prison? After their sentence they just don’t reoffend?
      Or did it lower the chances of them reoffending when they are given probation and can still get a job and try to become functioning members of society?
      Perhaps corralling felons on the people’s dime so they can sit around not make money, be isolated from society, only have other criminals to converse and connect with, does not give them a great chance once they are released.
      But maybe I’m just a problem solving kind of guy rather than opposition for the sake of opposition. Can’t expect you to get it.

    Good education is the key. When I graduated high school MANY years ago, I not only had a mandatory government course to take in my senior year so I understood how it all worked but the class had any student who was 18 walk in a class trip to the town hall and register as a voter at the end of the school year. I still remember how grown up it made me feel and the responsibility I had to vote. I have never missed voting in an election.

      Graduated in 1986, senior year we had 2 courses in US History and Politics and Society, and we had to go to 4 (each) school board and city council meetings. We also were given extra credit if we went to the USPS to register to vote. Sadly, I was a newly turned 17 yr old senior. Our midterm was writing a Bill and trying to pass it as legislation. Our final was an essay…‘an alien being touches down on Earth and asks us to explain our government’…we had to describe, in depth, our 3 branches of government.
      I believe ALL American schools should have this as a graduation requirement.

    The Railroad that I worked for over 30 years constantly stole money from its employees. The Company would break the Union contracts and just do whatever they wanted. An Employee needed to monitor his or her wages like a Hawk, just in order to keep the Company honest. It was very frustrating to endure, year after year. If I or a fellow employee spotted a failure to pay services rendered, or he or she became a victim of some mistake, or a purposeful deceit on the Company's part, one would then need to file a "time claim" against the Company. Then the Union would try to get the money that he or she was owed by processing our "time claim" and presenting the claim and even to argue with to the Company to do the right thing. Sometimes it worked great and one would get the money owed. Other times one would never get the money owed. The Company would bargain for the "claims" instead of merely doing the right thing and paying what they owed. Also, they held onto the employees money, for as long as possible, obviously to draw Interest on the pooled money that they owed their employees.

    What happened to the idea that, "ignorance of the law is not a defense"? If corporations choose to delay prosecution to make it prohibitive for government to fight to the end, they need penalties extreme enough to coerce capitulation. It's a broadly embraced tactic when dealing with the poor. Confess or risk an overwhelming punishment.

    So - why isn’t corporate crime considered to be organized crime? (I know why) Corporations are highly structured and generally have a host of in-house counsel advising them on how to organize and structure their “criminal” activities.
    It would be interesting to know how much money is made as “honest” profit vs the amount made from twisting the system and avoiding investigation or prosecution.

    I got a deferred prosecution, for something I didn't even do. I got obstructing a felony investigation for telling the truth that destroyed the DA's case.

      @Martcapt , it's not that exciting. When I was 17, I sold a bag of weed to my friend. He was getting it for someone else who, in turn, wore a wire on him. Well, the police were targeting my other friend, whom he was supposed to get it from. The buyer lied and said it was my other friend who sold it to him (who wasn't even present, and he wasn't friends with). He literally had nothing to do with any of it. I didn't even buy from my friend.
      Well, I am around 21, and stop by my friend's house and he is freaking out because he being indicted. They investigated him for four years and had that one charge against him, but he had two from when he was 16, so this was three strikes and you're out. He was not guilty. I read the statement, and remembered that night exactly. Talked my friend that snitched, and he confirmed it was really me but they wanted my friend and he didn't want me in trouble (I may or may not have punched him in the head with keys, he was lying to put a friend in prison). Then I gave a truthful statement to the police against myself for selling the bag. The DA realized he couldn't win the case with my testimony, so he offered a plea deal to my friend that was nothing but a charge, no time, no probation, nothing. My friend took it.
      Then, the DA charged me with obstruction of a felony investigation. I had to write a letter to the DA every month for a year giving updates on my living status, occupation, and do 100 hours of community service.
      It was all pure corruption and bullshit. My friend they were targeting made it through the bullshit, works two jobs, owns his own home and has a fmily now. They would have ruined all of that, just for conviction rates.

    @ 18 minutes in - these same Hedge Funds that decimated the communities (via the mortgage backed securities) are now going back in to those same communities to purchase blocks of those properties so they can either charge high rents or flip them.

    JS these discussions need to become mainstream, I wish the podcaters among you can find a way to share the wisdom and hopefully also get paid or something. This is the elixir of modern day democracy and shield against despots that are prowling in the fringes awaiting to strike when the opportunity offers itself.

    To the point made towards the end of the podcast, the lack of elite accountability also encourages more bad actions by elite. If the consequences for criminal actions are minor or missing then many people will try to game the system when the potential upside (lots of money, prestigous university positions) are so great. We are, in effect, rewarding bad actors.

      we definately are and have a long history of doing so; Trump is the ultimate proof of that, remember him saying effectively that "only stupid people pay taxes" or that he'd be the first president in history to come out of the WH richer than he went in? he all but told us what he would do

    For so many years, I've been saying white collar crime is so much worse than any other crime. Perhaps with Trump's indictment, more people are becoming aware of how bad this is and how politics is so tainted by these crimes affecting your personal life.

      Seriously, Bookkeeping errors for hush money for affairs everyone knows about. Look at virtually every politician and Rich shrewd business people for worse crimes. Look at Trumps indictment as absolute political prosecution

    My biggest question is how can we reorganize people who have been systematically put into these corners that they don't even know they are in. What mechanisms could possibly in any way help break them out. Or do we just have to work with the next generation?

      I'm a young GenX. I'm also a black woman. I grew up in the 80s, and was under the impression that we were a post racial society. I attended well funded schools and graduated from a college prep high school. Often tested in the top decile on standardized tests. It wasn't until I entered the workforce was I aware that maybe things weren't so equal. I don't think any generation that is living while Trump is still alive will be salvageable. Honestly, I don't think the US of A will still be a first world country a century from now; the proletarian and middle class are delusional.

    I was a kid that got one of those "deferred prosecution agreements". In 1977, I was caught red-handed hitchhiking w/ a keg on my 17th birthday. I spent a night in the local slammer and mopped the floor in the police station four weekends in a row. my sentence was deferred.

    White-collar doesn’t want to sue white-collar.
    For over 30 years, I did expert witness work in the world of Construction litigation. I am (retired) a general contracting construction expert.
    Again and again, and again, I would see when the architect and their team had made mistakes the attorneys would “explain” why they weren’t as important to sue as the blue-collar guy who put the bricks in out of alignment.
    I pointed this out many times: the attorneys just denied it was true and smiled and the builders just “cried.”
