  • On January 30, 2024 in Florida, an officer responded to a call about a woman causing a disturbance outside a cosmetology school. The reporting party said one of her students was being harassed by her partner, and the woman needed to be trespassed from the property. This is body-cam footage of the events that followed.
    Footage on Body Cam Watch is for educational purposes only. All information has been supplied by local law enforcement agencies and is considered by law to be public information. The subjects in these videos are to be presumed innocent until proven guilty in a court of law.       There truly should be a written law regarding using cell phones during interactions with LEOs or other figures of authority. It's totally out of hand, even at times dangerous, and only makes a bad situation worse.

Difficult one, as people insist on their right to record, claiming they're "scared". They're wedded to their phones, hanging on to them even whilst fiercely resisting being cuffed.       She is cooperating with all lawful orders. The officer was not cooperating with the other citizen in context with the Constitutionally protected rights of the citizenry. The officer violated the law. She did not. The detainment was unlawful whereas a consensual contact would have been fine. The arrest certainly was unlawful and a violation of the ladies Constitutional rights to be free from government officials searching or seizing a citizen without lawful reason or cause, her right to due process, and her right to the equal protections of law.

      4th Amendment of the Untied States’ Constitution says she was in the right; as do many judicial rulings (case-laws) defining if and when a citizen is required to provide her identifying information to a government official. If no crime is suspected, then even in stop and identify states do not allow for detainment. For trespass notice, a description of her is sufficient.

    Ask once, ask twice, arrest her for obstruction of an investigation. Book her as a Jane Doe and she can sit there for several days until they are able to identify her. This is ridiculous! and a waste of his time. If I were the judge, she would sit in jail for 90 days just for this behavior plus other charges.

      Constitutional rights are not playthings, and the oft-shadowy war being waged by the enemies of the constitution is not a game. She was actually right on in her understanding of her rights, and the officer’s authority in context. The officer was in violation of the law. The detainment and the subsequent arrest were both unlawful. See my other comments where i provided ample case law and other citations of law showing how this is the case.

      To deny identification during a clearly lawful activity after coherent explanation is the act of a child.

      So true! I work as an in home caregiver. I have coworkers who care for a client 24 hours. We each have 12 hour shifts. We inform our coworkers when we relieve one another. I work overnights and have to tell my morning shift coworkers about any changes in care of our client...very IMPORTANT INFO. This one coworker would not even ACKNOWLEDGE my existence as I shared info. She just kept her nose in her phone texting..wouldnt look at me or even ACKNOWLEDGE she was hearing or listening to me. So happy when she quit. Some people are obviously just there for a paycheck and play on their phone their whole shift. Only coworker I could not stand!!!!

      @@nuttysquirrel8816 I think you are correct in your assertion because I have seen knowledgeable and experienced 1A auditors standing firm about not having to produce ID in order for a formal trespass to be issued. I say that in preface to my question so you know I am sincere and not trolling.
      If the person being trespassed isn't positively identified by name and DOB, how can the trespass be enforced? I know her face is on the body cam, but that seems like a cumbersome and practically unenforceable method to prove, if she returns, that she had indeed been given warning of the trespass. Thanks for your answer in advance.

      It’s not a game so much as a battle in a larger war being waged against life and liberty. Once captured, it stands to reason that some may negotiate with captors in an effort mitigate the losses while still asserting one’s rights. Sort of like how folks say that they will not do this or that unless it is under threat of arrest. Similar idea that is based in caselaw. Do you expect your fellow citizen’s to cooperate with ways and means adverse to life and liberty? Do you expect your fellow citizen’s to kowtow to corruption or to placate the will of lesser men?
      The latter is an allusion to a well known quote by Plato. Check it out.

      Edit: Charges were dropped! I've gotten a lot of push back on this so I decided to look her up then find her criminal history. Guess who agreed with me on this being an unlawful arrest? The district attorney who had her case and dropped the charges. All this women has in her criminal history is one speeding ticket. By the way, there is case law that says the officer would not get qualified immunity. She should sue him for false arrest and 4th amendment violation and teach him a lesson about the value of freedom.

      She had no legal obligation to id herself and ignoring the officer is part of the 5th amendment. Getting a trespass warning doesn't required a id. People only need to id themselves if they've committed a crime. She was just now told that she was trespassed and couldn't come back for six months. She has to get the chance to leave, but if she doesn't leave now or if she comes back within that six month time period is when a crime is committed and only then she must produce id.

If I'm told to leave private property I need to get the opportunity to leave without presenting id. If I don't leave or come back within the 6 mo. time period then and only then a crime has occurred. That's why you always record police encounters because you'll need for court.

      @@rbeprice1234 Per FL law, once the business owner asked her to leave and she refused to do so, it is criminal. At that point, the officer does not have to warn her at all, as she has already been notified and did not immediately vacate. Trespass warning may be common courtesy or department policy, but it is not legally required after the property owner asked her to leave or signage is ignored. Therefore, when she does not leave immediately, she is required to ID.

      look up the state statue and point to me where it says you are required to ID for a trespass warning. you won’t find it. because in this country you are not required to provide ID unless the officer has a reasonable suspicion that you have committed a crime. since a trespass warning is by definition not a crime, then there is no obligation to provide ID. hence why she wasn’t charged for it

      It's not her problem. He could have written her description based on what he saw, got the details from the business, or even taken a picture of her (she was in public) and attached that. It's entirely up to him. The well trained cops generally take the last option of taking a photo.
      It's similar to when an officer contacts someone because of just a call. Unless the officer personally witnesses something or the caller provides an articulable suspicion of a specific crime, there is no obligation to show your ID. A mere hunch or someone "not looking like they belong in the neighborhood" or "not being seen around before," isn't sufficient. Even if the police claim they need your name for their report/interaction, there must be actual reasonable suspicion. You have no obligation.
