    Persico, the Colombo boss, represented himself during the Commission Trial in the 80's and tried the argument that the mob indeed exists but being in it isn't inherently a crime in itself. The other bosses did not like the idea of anyone, much less a boss, going on the record that their organization exists, but Persico saw that they had no other avenue to try to invalidate the then-shaky RICO indictment since a RICO of that magnitude was a big deal at the time while being sort of untested.
    Persico's argument didn't work and all those bosses and underbosses took 100 years each like men. It wasn't even like Persico was stupid to represent himself against the feds, especially in a case like that, because even the judge went on the record during his sentencing to say that Persico was one of the smartest people he had ever observed in his life.... and. how it was a tragedy that he chose the streets than succeed in the legit world.

    What I don’t get is why did he testify against Vinny Gorgeous if he was confident in beating the case? Telling Vinny to take the 20 year deal why don’t you take your own advice and take the 20 year deal? The hypocrisy

      There wasn’t a 20 year deal atleast not in the beginning maybe after the first trial was a mistrial and the murders had to be retried but not when Cicale first decided to flip. Cicale knew they were done on that case and with Cicales record he was going to get big time that he didn’t wanna do in his late 30s.

    Actually RICO DOES make it illegal to be in the Mafia. It makes association with criminal enterprises illegal. That's one of the reasons why RICO is argued to be unconstitutional.

    Think about what he’s saying. Vinny wanted him to take the stand and Amit there’s a mafia. Let’s correct this. One he’s a convicted murderer from Florida a convicted drug dealer in New York. He was going to punch Vinny. He blames everyone like all the other rats for telling. Here it is guys. No one just turns rat. Nobody just starts telling on their friends. When someone cooperates with the feds it's because they are born that way. It just takes something to bring it out of them, like getting arrested with the chance of going to prison.
    There are no excuses for being a rat, but informants would like people to believe there are. Guys talk and say things like, "While I was in prison my friend fucked my wife," or "While I was locked up no one sent me money," or "While I was locked up they demoted me." All these excuses are bull-shit. A real man would never roll over.and tell on his friends ever it just doesn’t work like that. Go ask the guys who are doing 50 years or life. All excuses these rats. sammy the hasbeen bull set the precedents for all of them and the government knew exactly what they were doing by giving him 5 years for 19 murders.
