They have now also disabled their Facebook Page, after Stefan made a video about them CHANGING THEIR COMMENTS ON THE PAGE where they say that they dont sue people for bad reviews.

How is it possible to defame a product? These reviews critique a product. Not a person or group of persons. And how can one be sued for an opinion? Free speech, so to speak, is alive and well in Australia. This whole saga seems absurd. He is being sued for 'defaming a product' while using his opinion. Please someone explain what law he broke?

DCS is acting like the tRump Corporation, rip them off then threaten the person with court to shut them up or shut them down at the first sign of any complaint.
DCS was not able to cancel the reviewer to prevent them from telling others (such as Louis). Probably if they could, the would have requested an internet gag order against the reviewer. Some online companies do request gag orders and do get them as part of the settlement.

This is Ethan from good old down under - the land where toilets flush the opposite way, and we use the metric system. Firstly, I absolutely love your video! I had never heard of you or your channel before, but I found out about it through a mention on Auto Expert John’s channel. Well, you’ve got a new subscriber!
This situation between DCS and Stefan is a load of BS! In my opinion, Stefan’s video was absolutely correct and fair. Why, you ask? Because I also bought a DCS 75 AH lithium battery, and it failed within 9 months of use. Sadly, I purchased the battery secondhand without a receipt, so this matter really resonates with me.
I’m not an engineer or an electronics/lithium battery scientist, but from what I know and have researched, batteries and heat - especially lithium batteries - do not mix well. It makes you wonder why DCS, or any other company claiming lithium batteries work under the bonnet, would make such claims. It’s highly questionable.
Thanks for making this video! I feel a lot better and slightly justified in my frustration after purchasing a subpar lithium battery from DCS.

Lithium cells, like all other battery types, degrade faster when used outside their optimium temperature window. When designing a lithium battery package intended for use in higher temperatures, over 40*c, the Battery Management System (BMS) should use its thermal probe on the cells to ensure a lower discharge and recharge rate is adherred to. These lower rates should be sufficient to still power 4x4 accessories such as fridges and radios.
I suspect the issue was cheap / 2nd hand cells were used which explains some cells failing after short use, OR faulty BMS that dont keep cells balanced, or not ensure the cells are being used inside theire acceptable parameters. Probably more likely the latter at a guess but i'd ve keen to get my hands on a few failed batteries to dissect them

The high temperature problem is worse in batteries that use volatile solvents in the electrolyte such as lithium ion batteries use. But the DCS battery in question is lithium iron phosphate and those don't have to use volatiles. Thus they are better able to withstand high temperatures.

They can scrub their site, and they can maybe even scrub archive.org, but I wish them the best of luck scrubbing the archive links from the Australian library that I included in the video description. If you are a data hoarder, please save all of that before it goes away. It is critical to demonstrating that Stefan was NOT defaming DCS when Stefan claimed that DCS changed the terms of the warranty. It is the only proof there is besides his word and it needs to be saved before DCS potentially gets rid of it
Stefan did not have screenshots because archive.org did not have them and he did not know that the Australian library archives and snapshots all of their websites.

Warranty is a voluntary by the manufacturer, with rules specified by manufacturer (still - can't be changed whenever they want) BUT there is an additional thing here - "Non-conformity of the goods with the contract" (not sure if that's translated exactly in this way). This binds seller (not manufacturer!) and consumer for 2 years of kind-of-warranty thing, with rules described in law and that's indeed statutory right (in EU).
Not in Australia is isn't. It's an offer of conditions adjacent to sale. It is over ruled by Statute and case law as they may exist from State to State and at the Federal level. Failing to amend the date is trivial. *Citing* the date in a legal proceeding *might* constitute a fraud, if you can show intent and knowledge, but the fraud resides in the citation, not in the date itself.

Thankyou Louis. I'm one of the Australian consumers who will never use DCS products under any circumstances due to continuous failures of products that DCS refused to address. It took legal threats to acquire a full refund, that in itself taking several weeks to appear in my bank account. DCS are a untrustworthy company.
And I am there with you, scrapping my DCS gear never to see the light of day again. Looking to find an ethical manufacturer.

Updating the ToS without updating the last date of change can't possibly be legal. If that ToS is invoked in court, then the false date constitutes tampered evidence. This company is either criminally neglectful or criminally malicious.
In most U.S. states & federally, Destruction of Evidence is 10-15 years minimum.

I had an Australian company sell me a product that wasn't fit for purpose. When I asked for a refund, they updated the listing to change the products suitability to specifically exclude 99% of the things it was designed for. They did it within 10 minutes of me first putting the complaint up, but I'm assuming hadn't flushed whatever caching service they use so the original still listing was up for another two days.
I brought it up with their company owner, who began by getting incredibly offensive until I pointed out I had saved copies of the website before and after changes, and would be very happy to take them to our business tribunal over here and making sure all that information was public.
I had a refund within 10 minutes.
Absolute scum.
When dealing with an Australian company, remember that Australian consumer law trumps company's warranties/TOS, so notifying the ACCC could have gotten the company in a lot of trouble. They may not have been able to act on your behalf as a foreign citizen but they could act against against a company acting against Australian law on Australian soil.

Australia actually has pretty strong consumer protection laws. If this is reported to ACCC, they will likely take action on this. Also, our defamation laws have been modified in recent years, to protect people from vexatious SLAPP suits. They don't have a leg to stand on. Thank you Louis, you are a legend.
The ACCC is a toothless tiger and won't take action, they give multinationals a pass the vast majority of the time, and only prosecute around 1% of complaints.

Louis I have been threatened legally by LEGO years ago. The message I got was stop telling everyone how amazing LEGO is. I have had a eBayer threaten me legally because I exposed how poorly they packaged a rare toy. As I am currently having a close shave with Apple in trying to achieve a refund on a Studio Display that had a major malfunction it exposed me to how Apple in their stores have a ACCC brochure related to Repair, Replace & Refund. In Australia it's very straightforward these are the simple consumer laws related to a major problem. 1, If a product is unsafe 2, If a product is different to what's advertised or described. 3, Doesn't do as explained or can't be easily fixed. What I have learned to achieve a $2500 refund from a $3.4Trillion dollar company is not as easy as it should be. But hey I'm sure you fully understand as you explain that's how it works. Sadly being a little UA-camr means I have very little voice on this subject. Yep our toilet water does go backwards, spooks a lot of blow ins. Very sneaky how DCS fiddled with their terms and conditions. I bet they get fined by the ACCC

So awkwardly enough this is one of the very few videos where I'm like "he doesn't quite know what he's talking about" in Australia the defamation laws are way different. Like genuinely talking about a person can get you put in jail. The beard in a good or bad manner. Their lawsuit is not frivolous. It has quite a bit of grounds in Australia. Frivolous Lawsuit. Get your money back!
If I had a nickel for every time a company with the initials "DCS" sued or threatened to sue a UA-cam reviewer because they didn't like the review, I'd have two nickels. Which isn't a lot but it's weird that it's happened twice.
I was a bit shocked initially they would have the nerve to do this again after apologizing and retracting their lawsuit, but yeah, same shit somehow not the same DCS!
I also initially thought it was the same company. I actually saw this battery review whilst looking for an update from the headphone amp guy. Strange the companies have the same name but are not connected in any way other than dodgy ethics.

UA-cam is not a charity organization. UA-cam exists because it makes profit. It has to make profit. And how does it make profit? Primarily by advertisements. Problem is, UA-cam doesn't decide who wants or doesn't want to advertise on their platform, so their hands are quite tied because advertisers tell them how to dance, not the other way around.
All things considered, even with advertisers breathing on their neck all the time, UA-cam is a surprisingly neutral and open platform. Left-wing, right-wing, up-wing, down-wing politics... pretty much all allowed (with only the most extremist content removed). Many people working at UA-cam, even some people in positions of power, may be politically biased, but the platform itself is surprisingly open and neutral. This even though advertisers tend to be overwhelmingly radically left-wing.
(Also, UA-cam as a company has to obey the law. If DMCA tells them to do something, they have to obey, by law. Their hands are tied. Do not blame UA-cam for following the law. Blame the law.)

As an Aussie I've been following this, but i didn't realise the shady company had been playing shenanigans with the warranty policy.
Warranty policy is worthless much like extended warranty. Australian consumer Law all the way. What would a reasonable person expect? Not what the manufacturer thinks. I was looking at their batteries when I last needed batteries. I came to the conclusion that lithium in the engine bay just wasn't worth the expense and risk. Looks like it was a good call. With a turbo diesel in the outback I just thought that heat would degrade the cells. When I was looking there were very few lithium batteries that supported under bonnet mounting.

@@Mr_jz_12 they were getting a few reviews here on UA-cam. You had to be looking at 4wd and batteries. I think Pirahna Off-road were selling them too and I saw them in store when they had a store in Boronia. Over 1k for a battery when a top of the line Lead Acid was 500. That top of the line Lead acid lasted 8 years for me and has a 5 year warranty to boot. I was amazed they were doing lithium under bonnet. It's a really tough environment. With standard lead acid I'm lucky to get two years in my vehicle. Hence why I have invested the time to look into longer lasting batteries even if they cost more.

Company policy does not have any effect on Australian consumer law, DCS will find that out soon. One of the pillars of our consumer law is a product MUST be fit for purpose.
Technically a battery that has 50% capacity can be used so it’s “fit” for its purpose of powering stuff

In Australia, I have heard many times that the truth is no defence in a defamation case. But it might be a defence in the state of Queensland.

@@_BangDroid_ because laws are only as good as they're enforced, and our laws aren't well enforced. the ACCC doesn't engage in disputes. they only react to volume complaints. (like with Steam and the lack of refunds back then). beyond that it's a local ombudsman, and they're generally fairly toothless or unwilling to help.

Epic! Great to see the little man having a win! I had a similar experience with a company after taking $48000 for aftermarket parts and providing me with a unsafe/un-driveable vehicle. After finding out most of their customers were supplied the same product with the same results FOR OVER A DECADE I was shocked they continually denied knowing about the problem and did nothing to fix it which cost 10k out of my own pocket. He then threatened me with all sorts of ridiculous things. Insane companies can keep escalating it to a court level and knocking customers down because we don’t have the time and money to pursue them. Good on you mate. 🇦🇺

You already pay taxes and deserve rights, but when it comes to protecting your rights, suddenly you need to even more money, as if the court system is some private business that's not already funded by your taxes. One could potentially conclude, upon reading this, that they determine capacity during charging but not discharging. Whether that might lead to a different result or not, I won't comment about here but I find it important to point to this.

Australian here. Agency capture is huge. ASIC is weak. ACCC is weak. They pander to big business. The consumer is screwed every time. The only way to “win” is to take them to court, which very few people can afford.

Amen! Lawyer here, and I think that DCS's defamation threats are outrageous. In the U.S., that claim would be smacked down with a swiftness.
I remember fixing computers from a 3 letter company. At that time there was a known problem with capacitors. Seven of them were swollen. The system was having problems and I requested a MB under warranty. The system worked after that. Later I get a message asking me why I sent them a working MB. I said that it was not properly working and as can be seen that 7 caps are swollen. I also mentioned that the computer was working properly when the new MB was installed. They told me that I requested a replacement MB under false pretenses. Then I got an email stating that unless the capacitors show actual leakage, it is not considered defective. Was not long after that, that we no longer bought their computers.
I remember replacing sooooo many of those under warranty. Turned out to be corporate espionage (edit: SABOTAGE). Someone funneled known bad capacitors into the supply chain.

now, the formula you are talking about was actually just flawed from teh start even the major companies that developed it had issues with it, rubycon and nicon for example, i mea not as bad as knockoffs/clones but it was alot of work to push the idea it wasnt legit ones failing, when i can infact testify myself it was... confirmed legit caps with over a 20% fail rate in the first year.. worst in some cases... 20% was at the low end... it was a brutal time for electronics makers...
but the incedent the fellow above is talking about.. yeah sabotage.. i think you can find videos about it if you dig enough..
something similar happened with IBM branded "deathstar" harddrives, the hitachi branded versions of the same drives had VERY VERY VERY low fail rates in our exp, IBM branded became known as "deathstars" because they died constantly.. it was the cache chips.. cache chips with heat issues, would burn themselves out just from being powered on not even in active use... when hitchi tookover warranty service for them, they replaced drives with ones that had the correct cache chips on the controller board and refurbished failed drives by having the cache chips swapped, we did 3 drives for a client infact... they NEEDED the data off the drives.. and the drives didnt fail, i have one of them still.. its small but works decades later... the cache chips would f-ing burn you the moment the drive was powered on ffs..
i gather that was another case of sabotage somebody got paid well to dump bad cache chips on them, and since funny enough they provided the parts to make the controller boards for their branded drives.. yup.. shit show.. hitchi was tired of the bad rep... cant blame them.. heh..

This is the second company named DCS suing over bad reviews that I've heard about this week.
Very confusing, especially since the first situation was resolved by DCS (audio) firing the marketing VP responsible and making good on the issue so it didn't make sense until I realised this was DCS (batteries)

One of the things about this case is how DCS is able to sue an individual.
Here in Australia a company generally (note that word) cannot sue individuals, especially if it employs more than 10 people. But, I guess that still doesn't stop them trying it on.
And I'm really disappointed to hear that Stephan has taken down the "offending" videos. You're right, Louis, he needs to reinstate them.
They can't in the commonwealth or US, but the trick people into defending their corporate identities. Christopher Hauser has more info on this.
They had a "mentions" hearing in court recently and the point that I made about companies' ability to sue individuals came up. DCS is challenging this. It returns to court in October.
On its Facebook page DCS commented that it doesn't sue "genuine" reviewers. This is implying that Stephan isn't a genuine reviewer.
There's the Rule of Holes which states, "when in one, best to stop digging any further".

Changing warranty conditions after the fact of the sale is a truly evil practice. Having said that, the DCS warranty as you read out is pretty damn stupid for a deep cycle battery. And that is the real problem for DCS. They can't put a warranty together that is fit for purpose. But this is their (ongoing) problem. If I can find the original problematic video review from my fellow Australian I will elaborate on the problem with the warranty as presented here. I will also offer my support for the cause. I too am an Elec Eng with 35 years exp and significant exp with deep cycle batteries. It will be a pleasure to help bury DCS with the truth and solid facts.

That's how companies get us. We don't really take the time to read anything so we just click or buy away. On the same token, companies should honor their warranties of your item, to match what was in the conditions at that time.

Of course, that would either need to be government run (which opens it to lobbying against) or private (see Better Business Bureau and Yelp for the issues with that).
I cannot even tell you the amount of times Samsung has changed their terms and conditions of sale. I bought the phone a couple of years ago, I do not accept anything other than the terms stated from my purchase. I'm Donald and I live 176 km away from DCS, near enough to use them. Distance in Australia is bigger than in Texas. Must be our backward water flow. 2500 Km ( 1553 miles) of driving, and I will still remain in the State of Queensland.
