My father passed away less than 5 months ago. I'm one of the beneficiaries in a trust property. It's a duplex the garage was converted into a studio. And this is where my father was living before he passed cause he decided to rent out our house. That's attached to the same address as garage. He opted on, not picking it up from the beginning of the month, should the landlord inform us of him, hiring someone to act as a landlord we do not know the person who is bringing these notices. You probably have this figured out by now, but to start, did he pay your mom rent? If so is he paying you the rent that would have gone to your mom? He’s probably not paying you is my guess so you could start with a 3 Day Pay or Quit Notice. It should apply for the back rent due only, no penalties, nothing else except for rent owed. He probably won’t pay it so three days after he’s been served the notice and you haven’t been paid then you can file an “Illegal Detainer” notion with the court. This will authorize you to have the sheriff remove him and his belongings from the mobile home when the legal process is decided in your favor. This presumes you won’t get any reply from the guy, which can be typical in these things. You need to get started. Depending on your priorities of time and resources, you can usually do most of this stuff yourself if you take some time to carefully review the legal paperwork forms available. It can be intimidating at first as you will hear a lot of “consult a lawyer” stuff as you go along, like the guy in this presentation often says. They have to say this. Errors can be made, and some folks might be better having the whole eviction process done by “professionals”, but if you have the interest and time you will find that you can do it yourself. All the “maybe see a lawyer” cautions are in part due to the presenters (like this video) can’t have boatloads of do-it -yourselfers coming back on THEM in court saying “but he said if I did yadda yadda…”. You can probably do it yourself IMO. When it’s all said and done it’s actually pretty easy…..”.
@gabesmokeymartatom Thanks for the reply. To start, he was never paying rent and no rent amount was ever discussed. He freeloader off her for a couple years. I couldn't do a three day notice due to the fact that he couldn't pay and get current on something he wasn't behind on. I gave him a 60 day notice to vacate because he had been there over 2 years. I also had to continue paying all there bills. Gas, electric, trash because I was told if I shut them off I would be retaliating. They left alittle after 60 days and now I get to pay to have it fixed and haul everything to the dump they left. Landlord/Tennant laws need to change. People need to be held accountable for their actions. I wish I could sue but they have nothing.

Correct. You don't know how it's served until you serve it, so you mark your copy AFTER it's served.

Were you served the notice and didn't take it? Or not served? That's definitely important if they move forward with the unlawful detainer action.

Hello, I received a 3 day Pay or quit from a neighbor who usually corresponds between the landlord and tenants but I don't believe they are an official associate. My question is, the letter is not an official form but more of a hand typed letter with all the required info as stated in your video. Is that still acceptable or does it need to be an official form? I was served Monday the 10th. Do I have until Thursday the 13th to comply?
It may or may not be valid...it would be best to have an attorney review it.

My father passed away less than 5 months ago. I'm one of the beneficiaries in a trust property. It's a duplex the garage was converted into a studio. And this is where my father was living before he passed cause he decided to rent out our house. That's attached to the same address as garage. The income from the front house and the backhouse pay for the mortgage and for the utilities and that was the agreement. With the tenant tenants that we share an address with my Uncle served me a 30 day to vacate. So he could sell property? I've lived here 40 years. I'm not very mobile at the moment. I have a medical Condit so I have no money. Absolutely zero in my bank account. What can I do? Or is there anything I can do and I'm not allowed to? Contest the trust but nowhere in the trust doesn't say that I have to leave the property for him to sell it

The landlord is intending to sell the property, so he hired an agent. The agent served us a three day notice to pay rent or quit The rent was never denied. He opted on, not picking it up from the beginning of the month, should the landlord inform us of him, hiring someone to act as a landlord we do not know the person who is bringing these notices. We just know she is an agent..

Unless the lease says otherwise (which some do in rare cases), then a notice can be delivered any day of the month.

hi I was given the notice to cure twice for two separate reasons my landlord has given permission for both a/c installation and the door bell camera and now told I have to take it down after having it up for over a year because she's upset with me. can she do that? is that legal?
If you have proof of the permission, then it doesn't make sense that you'd have to remove the doorbell camera, unless someone else like an HOA is asking for it to be removed. Did she give a reason for asking for it to be removed?
No she never gave reason, she just said she was ok with it and now she’s not and that’s the reason I put it up in the first place. She was such an issue, I did myself the favor and moved out

You messed up the 3 day notice is for them to pay the rent so you have to accept the rent and drop the suit you shouldn't have filed until they failed to fix the 3 day

@@connectedcalcat7558 according to the law in California the tenant is protected for nonpayment of rent until Dec 31,2022 and after has 12 months to pay rent that is owed I would say work it out with your tenant and avoid the legal hassle your tenant has rights
I got a 3 day notice in Dec and a new one in Feb I filed my awnser March 8 and court in April 11 which 3 day notice am I suppose to respond too because apparently my evidence was not enough I attempted to pay multiple times even asked third party to help because he wasn't accepted my rent in the first week of Feb and they emailed me he denied rent I showed judge and still got eviction now I try to appeal because I attempted to pay on 3 day time frame for the latest notice I can prove in feb

You probably have this figured out by now, but to start, did he pay your mom rent? If so is he paying you the rent that would have gone to your mom? He’s probably not paying you is my guess so you could start with a 3 Day Pay or Quit Notice. It should apply for the back rent due only, no penalties, nothing else except for rent owed. He probably won’t pay it so three days after he’s been served the notice and you haven’t been paid then you can file an “Illegal Detainer” notion with the court. This will authorize you to have the sheriff remove him and his belongings from the mobile home when the legal process is decided in your favor. This presumes you won’t get any reply from the guy, which can be typical in these things. You need to get started. Depending on your priorities of time and resources, you can usually do most of this stuff yourself if you take some time to carefully review the legal paperwork forms available. It can be intimidating at first as you will hear a lot of “consult a lawyer” stuff as you go along, like the guy in this presentation often says. They have to say this. Errors can be made, and some folks might be better having the whole eviction process done by “professionals”, but if you have the interest and time you will find that you can do it yourself. All the “maybe see a lawyer” cautions are in part due to the presenters (like this video) can’t have boatloads of do-it -yourselfers coming back on THEM in court saying “but he said if I did yadda yadda…”. You can probably do it yourself IMO. When it’s all said and done it’s actually pretty easy…..”.
@gabesmokeymartatom Thanks for the reply. To start, he was never paying rent and no rent amount was ever discussed. He freeloader off her for a couple years. I couldn't do a three day notice due to the fact that he couldn't pay and get current on something he wasn't behind on. I gave him a 60 day notice to vacate because he had been there over 2 years. I also had to continue paying all there bills. Gas, electric, trash because I was told if I shut them off I would be retaliating. They left alittle after 60 days and now I get to pay to have it fixed and haul everything to the dump they left. Landlord/Tennant laws need to change. People need to be held accountable for their actions. I wish I could sue but they have nothing.
