  • The plaintiff says she rented an apartment from the defendant and soon found it was unsuitable for her and her son because the neighbors were partying pot smokers and mail thieves. The plaintiff was let out of her lease, but the defendant kept some of the deposit, so she’s suing. The defendant says she has every right to withhold the money because the plaintiff broke the lease.

      I know that poor lady probably works so hard to raise her son and I feel so bad that she ended up in that dangerous situation, it's not easy or cheap to move I feel like she should have gotten money for moving cost 😢

      Agree she is adorable! Defendant also seemed like a nice lady in the end as she wished she could have said something and obviously it’s because she is not the owner but labeled as a landlord. Such a cute episode!:)

    Omg, poor lady. Can't imagine the horror she and her child went through. I'm glad she moved out, and that she & her son live peacefully now.
    I think she was one of the most honest plaintiffs I've ever seen. I loved her accent.

    I’m always a little taken aback at what some people choose to wear to court, especially when you know you’re going to be on tv. The defendant is dressed like she’s going to a local bar.

    How heartless can the defendant be? Then to go into the hall and say "there's so much I want to say but can't..." stick to the FACTS lady. I'm so glad the plaintiff and her son weren't harmed. Sounds like a slum anyone can get into and I can imagine just how horrifying these traumatic experiences were. Literally being terrorized where you lay your head is just inhumane.

      It seems like the defendant wanted to give the money back but it wasn’t up to her it was up the actual owner of the property and her contract as a manager. She says to Doug when he say why didn’t you just give the money back and she say trust me as if she was going to say trust me I wanted to but didn’t. she just said there is so much I want to say but can’t. I think she was alluding to the contract she has with the landlord and can’t disclose those details on television. And there might be other things going on low income families maybe some of them gang involved and getting them evicted has also been a struggle.

      ​@@TheAray6omg thank you so much for saying this because that's EXACTLY how I read it too. I think she was the fall guy for the owner. To me it seemed like she wanted to give the money back and did feel bad for the woman but her hands were tied by the owner. Either way stinks it had to come to this, but all was made right. Plus besides the judgement she gets a free trip and they pay you for your appearance. Glad everything worked out for her. What a horror she went through. Doesn't seem like she has a stitch of entitlement in her either. I wish her all the best.

    I hope the plaintiff and her son live somewhere they have peace and safety. The landlord is too cheap to hire security to ensure that the tenants are safe along with the property.

      It was dispute here on UA-cam comments once, it had to do with JJ, when she told a defendant to cover up. I said what you said. Oh boy, I got attacked by some ladies. People don't understand that when you are in court, church go can't go dressed up like you are going to a club or a beach. It's 100% inappropriate and disrespectful to the judge. Those judges have earned the respect they deserve.
      JJ has made those comments for men too, when they go to the court wearing kneeless pants, shorts etc.

      Honestly what is wrong with her shoulders showing If people could go to church with his shoulders showing If people could go to school with their shoulders showing and people going to step outside with your shoulders showing you keep on forgetting what year yeah I live in right because that's what it seems like because if it's okay for a female to wear whatever they want for no one to touch them then it should be okay as long as it's neat how a person can have no clothes and still y'all will be like oh they have to dress professional how dare they not dressed the way that we want them to dress when half the time most of them don't have the money have the time that's how they dress over there half the time it's none of your damn business yeah I want to pick on people's clothing and shoes and hairstyles and not care about people's personalities or what's in their heads yeah I care more about how people put on their bodies like as long as that person is not naked I don't see what's wrong with it sad that most of your females who say this when y'all could go outside and dress however you want and then when someone says something to you I want to be like but it's my body I can wear what I want I bought those clothes but once it goes to anyone else you are the same females who want to start talking mess about someone else who does the same damn thing you have to be ashamed of yourself for talking like that about other people if you don't have nothing nice to say keep it to your damn self

    That lady is so cute she is just so grateful for anything that she is given and that is how you should act even if it's as little as 300 bucks she is thanking everyone and has a huge smile on her face even after all she has been through. i bet she is also a great mom to her boy.

    The landlord/defendant likes to act like she is doing low-income people favors, but then looks for excuses to keep their much-needed money. Hypocrisy and greed at its very best. Pathetic.

      @@gutwallst6645: If it wasn't enriching, no one would do it. Unfortunately, poor people - because of their circumstances - are the easiest to take advantage of, and the easiest to make money off of without as much work. A bit of Socio-economic education would really benefit you.

    Poor woman was terrorized . My dad had two apartments years ago in CA. Some do trash the place when leaving after sitting there for at least 3 months rent free because evictions take time. In CA the courts are pretty much for the tenants. What could have been a decent investment gradually became a nightmare. Not charging a security deposit is on her. I’ve never heard of such a thing but she probably thinks no rent is better than nothing. Ridiculous. I am 52 now and I remember when dad finally sold those two buildings. When the last one went through escrow the look of relief on his face was priceless as if 1000 lbs of weight fell off. People assume the owners/ landlords are rich and can take the blow. They are wrong. For many this is what puts food on the table, pays the taxes and fees just having rentals, etc. For some it is a life’s dream to acquire a rental property….

      Many landlords take in monthly income and do very little work, other than calling the plumbing every once in a while. It is by no means like a refular 40 hour a week job. I feel little sympathy for them

      Landlords take on ALL
      the risk. The average landlord doesn’t come from a wealthy background, and many are from very humble beginnings. Many work very hard to save up the down payment for their first rental and often do a lot of DIY rehab on their properties, often on nights and weekends while working a regular 40 hour week at their day jobs. They and their families often live frugally for years in order to save for down payments on future rentals, because their rentals are an investment for their retirement, in the same way that IRA’s and 401k’s are. But a lot of landlords are people who prefer owning actual property rather than stock market funds because they feel like it’s safer. (I don’t necessarily agree.) At some point they are able to ease up on saving because they’ve (hopefully) built up some equity in their first rental units, so they use that equity to put a down payment on the next rental they want to buy. Then they repeat the process until they have enough to retire. And retiring doesn’t always mean that they just sit around relaxing. Many do all of the property management:
      all of the repairs & improvements inside and out, landscaping, collecting rent, book keeping, finding & screening prospective tenants, etc. They have to pay the mortgage even if the tenant doesn’t pay or if the rental sits empty because there is no one renting the unit. If a tenant falls behind in rent it can take months to evict them and the landlord might not ever get paid back for the missed rent. Some renters cause a lot of damage that exceeds the damage deposit. Or even if the damages are covered by the deposit it may take extra time to finish them, along with any cleaning to get the place ready to rent again. So again, no income during that time.

    The defendant is heartless this poor woman and her son went through too much after only living there for 3 months I’m glad they made it out safely 🙏🏿 I agree with Judge Milian give her all her 💸 back not a portion of it 🤦🏾‍♂️ the plaintiff should have sued for pain & suffering,emotional distress and mental anguish. Her & her son shouldn’t have to live like this 💯

    I think the defendant took advantage of the plaintive because she is a Hispanic woman, and her English is not very good. So I feel like the defendant tried to take advantage of her and think that she wasn’t going to make it this big of a deal and actually take her to court. Smh

    It’s the landlord’s fault. Your felon tenant kicked down the door after pointing a gun at her and threatening her. Instead of caring about her safety and replacing it immediately, you leave it. Clearly the residents of that building are criminals. They stole her mail. They kicked down her door and stole her appliances once she left.
    How is she responsible for the theft that occurred due to the landlord’s negligence after she turned over the keys?
    Clean that building up.
    Sounds like a fucking dump.

There is Hot Bench from Judge Judy franchise. And divorce court, and others still on television. The other court shows leaving is Judge Mathis, but he has another court gig coming besides his reality show with his family on cable.

    I could barely understand the plaintiff. I just watched another People's Court case with people who were American and spoke plain, understandable English. Judge Milian acted like she couldn't understand those folks! But she sits with pure patience for this woman. Wish I she could have extended the same patience and kindness to those litigants.

    The plaintiff was so sweet and caring the defendant wanted to change her mind because she doesn't ask for the bond money upfront.... and if the defendant wants damages covered sue the bloody other people who have been hounding the poor plaintiff

    Defendant’s logic makes no sense. She says it’s not worth it to collect security since it’s too much trouble to chase them so she just asks for first and last month’s rent. But, she could have asked for first and last month’s rent and security which is very common.

      I believe she said she rents in low-income areas, and tenants are unable to come up with 1st, last, and security. So she just does first and last because it’s a 7-month lease which then goes to month-to-month. Unless they fulfill the 7 months and then give 30 days notice, she gets to keep the last month’s rent to pay for damages. That’s much easier than tracking them down and getting them an itemized list of damages in the allotted time (which is only 14 days in Florida, I think?).

    There should be transparency when leasing apartments they always do inspections when everyone else is at work or school then you move in and the upstairs neighbours is a giant who stomps and likes to rearrange furniture as a hobby and the kids next door just screams all night lol

    Why didn't the Plaintiff sue for the cost of the appliances? It was because of the Defendant's negligence that she lost them.

      How was the defendant negligent? The defendant can’t control the neighborhood. People broke in and stole appliances, but there wasn’t any indication that it was one of the other tenants. And even if it were, the landlord isn’t able to control the tenants to that degree.

    Yo....this plaintiff went thru so much. I felt so bad for her hearing that story. Guns from a gay bf of the tenant next door,getting robbed,knifing her mailbox open....I mean dayum. Glad she's outta there

    The defendant is gross. Not compassionate at all no empathy over $300 she's nothing but a scammer. How can you not charge a security deposit yet hold her rent as a security deposit for damages she didn't cause ?

    this whole thing with needing the tenant to be making 3x or 4x the monthly rent is ridiculous and just bizarre anymore. It wasn't like that years ago, and I'm not going back decades here. It was always a month & a half, you handed that over if you liked the place, there were no credit checks, you didn't have to hand over any paperwork or anything like that, just hand over the month & a half and that was it. No one checked your income or anything, in fact any landlord that requested bank info or to see your pay stubs or your social security number was seen as a scammer, you stayed away from people like that. Whole thing is dumb, especially right now when people are struggling and they want people to be making over 5 or 6 grand per month for a tiny little shithole. They need to regulate the rental market on a NATIONAL level.

      They have made renting an apartment as hard as buying a house now.
      My apartment required me to earn 3x the rent, provide 3 months of bank statements and paystubs, and pay the deposit, first & last months rent upfront. It is ridiculous!

      It has been like that for years. I have been on this earth for 60 years and believe me, little one, they have always wanted people to make 2x, 3x not 4x the monthly rent. And they do credit check on the poorest people. And they do check income, especially if you are disabled and on SSDI, or SSi, or employed.

I've been on this earth for half a century and in the NYC tri state region NO ONE was demanding social security numbers or pay stubs in order to rent an apartment. Absolutely NO ONE. They have also not required 3x or 4x in income. I lived in rentals in the 1980s and 1990s, it was neve required, ever. Not to mention a credit check is not necessary, credit checks were made for lending institutions, no one should also be handing over their social security number to a stranger. If any landlord today wants this then they better be prepared for the prospective tenant to also run a background check on the prospective landlord, works both ways. If anyone demands me to be bringing in over 5 or 6 grand per month for a small apartment then that screams REO to me, it screams landlord having trouble paying mortgage, it means stay away. I have owned rentals, I have lived in rentals and I have owned my own house, none of taht is necessary and anyone who tells you it is is bullshitting you.

    I can't believe the plaintiff went through so much trauma living there and the defendant has the audacity to try and take more from her. Just wow.

    Too bad Judge Milian didnt ask the plaintiff to speak slower. She speaks a different language, Spanish I think, and her English is very heavily accented. If I cant understand half of the case, Im bored.
