      It's not terminated. Smith has found a route to attack her now. Trump's rhetoric about the FBI "raid" has gone too far and Smith has filed for an immediate gag order. If she denies it he can get an official appeal against her which allows him to motion to recuse.

    There are two ways this case can show the president to be above the law. 1) If her is found not guilty, and 2) if he is found guilty, but not sentenced to jailtime.

      There are 2 attorneys from business specialties (I believe) that are on the jury. Trump received not only attorneys that will argue his case while during the trial but also during the jurors deliberation. I believe Leeja is right, at best, mistrial or hung jury.

      Don't think that military people were ever not right wing. They can fight against a foreign force that invaded them all they want, that doesn't make them holy or means they were proud defenders of democracy before the war. To defend your own soil is a pretty natural response no matter who the attacking party is.
      I do think it's something that's pretty easily forgotten when you have such a prominently evil opponent like Nazi Germany, and as a German child it was confusing to me why Hollywood was so obsessed with making war stories, after all it was a horrible time and who would wanna see that for fun, but it does make sense to me now 😅 to most people, if there's someone shittier and you remind people of it constantly, they forget all the things you did
      Now back to my point, the hell's angels in Europe were always a mob like group of gun nuts and definitely not democratic. It also hasn't become that way recently, it's been like that for decades

      Even if he's found guilty, this is considered the crime that's unlikely to result in prison. However, it's very likely that could happen with his other criminal trials.

      The thing is, each count is basically the same. Just a different installment of the reimbursement. How can he be found guilty on some, but not all? I think that once they decide on one count, the rest will quickly follow.

      That is the case when there are a lot of different charges, but a lot of these are the same reimbursement split up so as to not look as bad. This probably will take a couple days, but likely not a week.

      Slow your roll there, cowboy! Due process is important, even if it does take some time. We are a country of laws, and it's important to have a fair trial - even if it's clear from the start that the person is guilty - because it must be documented properly for posterity.

    10:18 According to the transcript, apparently Judge Merchan had sent the jury back earlier in Costello's testimony. He was already being admonished when he stared the judge down, at which point Merchan cleared the courtroom altogether (save for court and security personnel, the prosecution, and the defense, if I'm not mistaken).

      He's probably not going to prison for this one, but here's hoping it sways enough people that he loses in November and *maybe* the documents case continues.
      The Secret Service have already made plans on how to guard him in jail if he was thrown in jail for contempt, so if he goes to prison they probably will still have to guard him.

    If I understand correctly, the Jury evaluates each of the 34 counts individually. If they find him guilty of 33 counts and 1 not guilty I assume he is still guilty of 33 counts and of the crime, the crime being falsifying business records to cover up an underlying crime.

    If found guilty does the judge have the courage to put him in prison? He also should not be given the privilege of remaining out of jail while appealing a guilty charge. So far we've only seen privilege prevail. If it was you or me we would have had been put in jail after the second time we violated the gag order

    I'd be interested to hear why you think it will be a hung jury and a mistrial. Are there parts of the prosecution case that are too much of a stretch? Or does it just require too much inference - lack of a smoking gun?
    Personally, I wouldn't be surprised if they only convicted on the counts where Trump himself signed the cheques. Also, people in the court have been saying that the jury is not looking at the defendent at all when they enter and leave... It's all a bit ominous for the Trumpster, I think.

    The commentators (not Leeja) describe the trial as a contest between two evenly matched foes and a case that could go either way, a nail-biter. I've read the transcripts, and one thing is sure: the attorneys are all pros-better than good. However, the prosecution built a strong case, and the defense is handicapped by not having one; Michael Cohen did air his sordid history and casual relation with the truth, but every salient point he made was corroborated in triplicate. If Donald Trump falsified business records intending to influence the election, he committed a crime. He did that.     Do we really think he will even be found guilty? And lets say he is will he even face in appropriate consequences? I cant help but be cynical and feel that nothing will occur. He wont be found guilty, but, lets say somehow that happens, he wont face in appropriate consequences, instead he will essentially walk away with a slap on the wrist. Wealthy and powerful people don't deal with consequences.

      I genuinely don’t think he will, despite how much I hope he will.
      I just don’t see a world in which someone so powerful, popular, and wealthy is *adequately* punished for their crimes.
      I can’t think of a time in recent history where a world leader has been found guilty or anything but I would be happy to be told I’m wrong about this!!

    As of 18:02 that was a very good summary. I can't even try to guess what the jury is going to do with this, but it seems like the jury selection was thorough enough. But the payoff is not the only thing which was an alleged attempt to influence the 2016 election. What about other things like the engineering of those tabloid articles ?

      that's true, but I doubt any of his rabid fans WOULD care to read the court documents. Plus they'd have to silently sound out the words, probably re-reading those difficult words with more than one syllable, several times, their greasy finger stabbing at the page. Words are difficult, man. There's all those letters you need to know. There's like, what, 50 letters? And jeeze they dance around into who knows how many words. There's thousands of words. Nobody even knows what they all mean, much less how to spell them. And ffs, reading is for lib-tards anyway. Real Americans don't have to read shit. Probably, Trump's base would just say "Yes! that proves it!" without actually reading anything. Kind of like they do with the Bible.

    I have noticed something that no one ever discusses regarding pregnancy and abortions:
    The world seems to have forgotten that the only way a woman gets pregnant is when a man leaves his messy semen behind.
    MEN ARE ALWAYS RESPONSIBLE FOR PREGNANCY.
    ALWAYS.
    Trump said that women who have abortions should be punished.
    If anyone is punished for an abortion, it should be the man who left his bodily fluids inside of a woman with or without her consent.

    Yet women are STILL being blamed for pregnancies that men cause.

    NY criminal attorneys are saying there are 3 possible underlying crime cover-ups that can lead to a felony conviction, one of which is tax evasion, rather than just election fraud. The case will be decided based on general intent rather than specific intent. General intent is easier to prove. Under NY law, the jury has to decide whether there was any intent to cover any of the 3. They do not have to agree on which one. Additionally, the cover up need not be the only intent. So if they believe that even part of the reason was to cover up a crime, my understanding is that would be sufficient. This leans toward a conviction on some of the counts.

    My exact question before you answered with your prediction: how likely is it that we have a hung jury? I know impossible to say one way or the other, but boy oh boy will it be a tough sell getting all twelve jurors on board to convict with how much the case relies upon conjecture and messy witness testimony, especially having Cohen as the prosecution's star witness and YIKES for the Costello shenanigans as well. How I wish I could've been a fly on the wall for that staring contest and admonishment he received after clearing the courtroom! And thank you for the fun new word, eleemosynary. ✨

    Great analysis as always! It's my understanding that not all 12 jurors have to find him guilty of all 34 counts of business fraud, and that if any of them find him guilty of any of those counts, the election fraud kicks in. I think I heard that on Ari Melber's show on MSNBC. It sounded like even one or more but not all of the counts of the jurors found him not guilty, the Election Fraud charge would be active but need all 12 to find him guilty. Your thoughts?

    Thank you again for your analysis. I agree about the potential mistrial due to a hung jury possibility. Fortunately it seems that the defense made a lot of strategic blunders that seem to show they are far from being siding with the truth. Hope they reach a verdict sooner than later - it will be historical either way.
