I saw some lawyer saying that the penalties might be reduced if NJs lose the case because it could be deemed excessive. But given the fact that they rebranded so quickly, and everything appears to be pre-planned, it doesn’t feel like “the girls were naive and brainwashed by MHJ”. The court might not be lenient on them
100% the penalty would be reduced as it's a crazy amount of money. But a 10% reduction is more money than they have. Even 1% might be beyond them depending on the assessed penalty and how much they've saved vs spent. Also worth pointing out that there's usually individual contacts with a group contract on top of that so... they will be begging for mercy if they don't pull out a smoking gun
i dont think itll be reduced. I believe their exclusive contract has an explicit provision stating a specific formula/calculation for penalty. the signed notarized contract agreement between parties will always prevail. I do however believe that the court will lay down the settlement arrangement ex installment etc.

The main thing that keeps kpop from really taking off in the west is the fact that most idols aren't involved in their own craft. As far as I know, NJs doesn't write, produce, choreograph, etc. That's why BTS was able to succeed, they're active in making their music. Plus they have a very solid underdog story. NJs came from unheard of privilege, and are pretty much just glorified influencers at this point. They're trying to spin it so they're the victims, but like this video says, how many times can they say "we were mistreated :( " before people start questioning it.

Well it is their legal right. Contract law is one of the most important things that upholds business. Without contracts having value and being enforceable, you would have no guarantees and could not operate. It just amazes me these girls think they are above it all. I don’t think it is going to end well for them. If they were that unhappy with ADOR and HYBE, then it would be better to pay the payout to get out of their contracts. But making decisions without considering the legal consequences that could backfire for them. They may not want to think about it, but they need to start thinking about what to do if things don’t fall in their favor.
My thoughts are they’re dragging it to let the court decide, maybe have the court lessen the costly blow, and trying to make at least some money and keep working in case they lose. Nobody ever wants to admit they’re wrong before the court does.

But if the courts decide that they were wrong, a major concern would be if the work they do to earn money is not enough to cover the costs of the legal fees as well as what the company states for them to pay to get out of their contracts.
@L77knightstories if they can't pay, which is 99% the case, the company will possibly let them go for free, but they have to sign a non-compete for idol/pop work that likely will last the original contract term. A 4-5 hiatus would effectively be the kiss of death.

I’m intrigued by their alleged new music. Clearly they are not musicians, writers, arrangers, producers etc so these individuals/firms would have had to been contacted. Multiple songs might have been submitted and then whittled down to find the one. It’s the timeline that is important as I highly doubt that this all happened after November 29th.
I don’t understand the mistreatment complaint. MHJ has completely influenced these naive, entitled individuals, making them believe they and MHJ are inseparable. Even if they attend concerts and conventions to perform, HYBE has a strong international presence with labels in the U.S. and Japan, where legal action could be taken if they attempt to perform under the name NJZ, which is derived from New Jeans.

Many say they're well advised but one wonders to where this is true. They are convinced that by changing the name of the group, everything was solved and although they're not using a registered trademark such as NewJeans, they are forgetting the small detail that they are subject to a valid exclusive contract until the Court says otherwise. But it would be easy for any artist to change his name and continue singing. I'm surprised by the attitude of "what I say is the truth and the rest doesn't matter." Who pays for their staff and everything that surrounds their activity since it should not be cheap? There are no lawsuits filed against them. There's a contract review and an injunction filed as part of that contract review. There are lawsuits filed against MHJ. That they are unaware whether they're being sued or that they consider MHJ lawsuits as lawsuits are against them is insane.
Also just missed your live, but I'm glad you mentioned the earnings outside Korea. My question is: even if Ador were to win their injunction how are they going to enforce it? These girls are obviously getting advice from their lawers which seem to be a reputable company, so they must be reasonably certain that they can continue to function with impunity. Listening to them talk and justify their statements without any arguments, hesitating and with those nervous giggles only makes me think that they are finished and they know it. MHJ told them to step on the accelerator and fall off the cliff, they know that there is nothing else they can do. I'm positive that the court will side with ADOR, they haven't made any stupid move, they are letting the girls and their mama make a fool of themselves. If the contract is deemed valid they will have to actually file for termination. That's the scary part. Their case was thin to begin with but everything they've done since MHJ was demoted is just making Ador's case stronger. Ador could easily have filed an injuction to hault all of their activities but they didn't. (They only protected the advertisement side of things likely to avoid having conflicts with brands down the line.) They are happily watching the members further complicate their situation in a possible terminatiom dispute. The more I watch these girls speak, the more they sound like they are trying to convince themselves things will be ok. They sound insecure and tired. They are debuting a new song at a food festival in China. This doesn't make sense and deep down they know.

i dont think itll be reduced. I believe their exclusive contract has an explicit provision stating a specific formula/calculation for penalty. the signed notarized contract agreement between parties will always prevail.

The main thing that keeps kpop from really taking off in the west is the fact that most idols aren't involved in their own craft. As far as I know, NJs doesn't write, produce, choreograph, etc. That's why BTS was able to succeed, they're active in making their music. Plus they have a very solid underdog story.

Without contracts having value and being enforceable, you would have no guarantees and could not operate. It just amazes me these girls think they are above it all. I don’t think it is going to end well for them. If they were that unhappy with ADOR and HYBE, then it would be better to pay the payout to get out of their contracts. But making decisions without considering the legal consequences that could backfire for them. They may not want to think about it, but they need to start thinking about what to do if things don’t fall in their favor.
My thoughts are they’re dragging it to let the court decide, maybe have the court lessen the costly blow, and trying to make at least some money and keep working in case they lose. Nobody ever wants to admit they’re wrong before the court does.

I still remember the big push during BTS online concerts giving them a huge platform advertising them trying to catch Army’s attention. They were provided beautiful penthouses with view of Han River from the start. Great pay and benefits. A huge difference for any new Kpop group including even BTS at their beginnings. These girls are spoiled and ungrateful. Not even in the US you will get such an amazing treatment from the beginning. The question is, what sane investor will take a chance in them? Who ever tries to do business with them will be on a short term. NO ONE is going to take this girls seriously. This girls have let people influence them the wrong way and have crossed some serious dangerous lines. Lying and defaming people left and right with a strait face. I have ZERO respect for them.
Complexcon is a convention for different entrepreneurs. And big restaurants stylist and music. It’s too far from being a concert. When it was held here in Las Vegas. People are more busy eating trying different food and having fun in other activities. Once again it’s a convention.

I don’t understand the mistreatment complaint. MHJ has completely influenced these naive, entitled individuals, making them believe they and MHJ are inseparable. Even if they attend concerts and conventions to perform, HYBE has a strong international presence with labels in the U.S. and Japan, where legal action could be taken if they attempt to perform under the name NJZ, which is derived from New Jeans.
At this point, HYBE just needs to let them go and collect their penalities. If they do sign with another company, the contract will be far stricter and worse. No company would be dumb to give them the same benefits as HYBE.
I'm sure Hybe is just waiting for the court to make all of it's rulings before moving on to the next step. Smart on their part.

When you see the group giving interviews as if nothing happens you realize that they're totally convinced that saying that they no longer work for Ador was enough to continue their lives. Many say they're well advised but one wonders to where this is true. They are convinced that by changing the name of the group, everything was solved and although they're not using a registered trademark such as NewJeans, they are forgetting the small detail that they are subject to a valid exclusive contract until the Court says otherwise. But it would be easy for any artist to change his name and continue singing. I'm surprised by the attitude of "what I say is the truth and the rest doesn't matter." Who pays for their staff and everything that surrounds their activity since it should not be cheap? In the end, all "their struggle" for the alleged mistreatment received is in the background and all they seek is to continue in the news so as not to lose the support of the people who see them as defenseless girls. Obviously that more than one prefers to believe in this because "the companies" with their power and money will always be the bad ones of the film but no one considers the fact that they acted badly for impulse to follow their beloved MHJ and turned their backs to a company that believed in its potential and invested in its careers. Also just missed your live, but I'm glad you mentioned the earnings outside Korea. My question is: even if Ador were to win their injunction how are they going to enforce it? These girls are obviously getting advice from their lawers which seem to be a reputable company, so they must be reasonably certain that they can continue to function with impunity. As outrageous as it seems to us, it seems that they are not too bothered by the fact that their contracts are still binding, and are continuing to work quit hard to garner public opinion. I believe that their attitude is strongly influenced by their western born members with an unbalanced view of their own entitlement . Can you perhaps look into how Hybe will be able to re-coup any penalties from the girls if they are earned outside of SK. Also if rumors that they have joined a Chinese Company? It is highly likely that MHJ will turn up there as well, and their choreographers who have resigned from Ador etcetc. Is this not what MHJ had planned from the start, which is why she has been so quiet lately?

Their case was thin to begin with but everything they've done since MHJ was demoted is just making Ador's case stronger. Ador could easily have filed an injuction to hault all of their activities but they didn't. (They only protected the advertisement side of things likely to avoid having conflicts with brands down the line.) They are happily watching the members further complicate their situation in a possible terminatiom dispute. The more I watch these girls speak, the more they sound like they are trying to convince themselves things will be ok. They sound insecure and tired. They are debuting a new song at a food festival in China. This doesn't make sense and deep down they know.
