    A tax clearance certificate is issued by SARS to certify that the entity is tax compliant; in other words that all their taxes due are up to date. However, your tax compliance can change in a matter of months so in 2019 SARS stopped issuing paper based Tax Clearance Certificates, which were valid for a year and introduced an updated validation system called Tax Compliance Status. It has the same requirements, but the compliance status is verified continuously throughout the year and the process is much quicker.
    There are two types of tax compliance statuses applicable to your company, namely, Good Standing and Tender. Good standing is applicable for COID applications and most corporate procurement departments; while Tenders, as the name suggests are for Government tenders.
    The verification system works by SARS issuing the entity a PIN which can be forwarded to anyone requesting your company’s tax compliance status. The PIN, together with your tax number is all that is required by the viewer to verify your tax status on e-filing. ONLY your tax compliance status is visible to the viewer and no other confidential tax information is displayed.
    Your PIN lasts for a year before it expires, and you have to reapply for a new PIN. Assuming your tax affairs are up to date the process is very quick. We will gladly assist you with this process.
    The status results are colour coded; green meaning your company is fully tax compliant or red meaning your company is not. Your company’s tax compliance status is dependent not only the company’s tax being up to date but also the individual directors in their personal capacity. Therefore even if one of the directors is not tax compliant then the company too will not be compliant.
    If your company is not compliant owing to outstanding tax filings of either the company or any of the directors, SwiftReg is not able to assist with this process. We have however partnered with the MST group who can take care of this for you.
    Remember SARS tax returns are completely different to your company’s Annual Returns which are submitted to CIPC. I have made a detailed video on this topic.
    So how do you apply for your TCS? Just log on to our site and request the one page application form which will automatically be emailed to you. Complete it, sign the SARS Power of Attorney and return the documents. We will take care of it from here.
    We will create and capture the information on your Efiling profile, SARS then takes 3-5 working days to verify the information before they issue the PIN.

    Thank you. How does SARS determine how much tax you have to pay? I am registering a tutoring company and I don't always make money, I am wondering how the tax to be paid is calculated.

      Hi Luthando There are many different types of taxes, all with different names , for example: Company Income Tax, VAT, PAYE, Dividend Tax etc. The main point is that you must remember is that company tax is 28% tax on PROFIT. This means if your expenses were high relative to you turnover resulting in no profit. Well, then you will pay NO tax. You will still need to submit a return to SARS (Even if it is a nil return). There is a small business tax which you should enquire about as it is only 10% of profit. My advice would be to keep meticulous records of all your income and expenses and then get an Accountant to help you with your SARS tax submissions.

    Not sure you still read these comments...but anyway ....I got a tax clearance certificate in 2019 I think ......I believed I was up to date ...yet I got an email stating I owe Sars......this email was today 01 10 2023 ......the amount goes back to before I even got clearance......so not sure if it's legit or not ....

      Hi there, you need to submit returns to CIPC and SARS every year to avoid penalties even if your company has not traded and was dormant during this time. My recommendation is that you get a tax practitioner to assist you with your SARS returns. I would recommend our accountants the MST group who is based in Brackenfell Cape Town. It is always easier to use a tax practitioner situated in your area.

      Hi Thulani, Tax Compliance is standard across all companies in all sectors regardless of the industry you are in. The tax compliance status is determined by SARS not the industry governing body. The CIBD which is the regulatory body for the construction industry requires tax compliance from SARS for registration with them.

      Hi Raymond, the process is the same as a PTY which is the company must be registered on E-Filing and be tax compliant.

      Hi Zanele Tax compliance is managed by SARS and the CSD status just links directly to them. This means if you are non-compliant you need to resolve your tax status with SARS and not CSD.

      Hi Panama you need to log on to eFiling to activate the tax compliance verification service. Then you would require the PIN and the tax number of the company in question. Once this information is entered the results are instant. I hope that answers your question.

    Your company is so unprofessional. Inconveniencing me when I'm already inconvenienced by sars is no joke. Why not be honest with me that it takes you a month for one to get clearance?

      Hi Blitz I am sorry you are having a frustrating time with SARS. Our office only received your tax number on Monday 21 Dec 2020 and we submitted it to SARS on the same day. That was 3 days ago. SARS usually takes between 3 to 5 working days to complete the tax clearance so we are hoping we can get a result today, but it will most likely be in the new year. Please bear in mind that SARS is working on a skeleton staff due to COVID and year end. Our offices are closing at 12h00 today and opening up on the 4 Jan 2021.
