  • Chilling video shows a Texas man fatally shooting his wife in the face. Carey Birmingham says he was in a state of rage because he learned his wife was allegedly having an affair, a claim her family denies. The evidence was presented to the 12-member jury, which consisted entirely of women. They allegedly sympathized with the wife killer and sentenced him to 10 years instead of the 20 years prosecutors wanted. The slain woman’s sister says the family was shocked at the jury's decision.

      and theres way more than that, only the jury got to hear that none of us know...trust me it had to be brutal all she did to him because an all women jury would normally love to hang a man out to dry,,,and then theres this act of passion law that texas and other states have to consider,, so all the wannabee keyboard judges can get over it because he will be out in 5 yrs. and to the spouses that want to cheat, steal money and humiliate their spouse, i suggest you be mindfull of the laws in the state you do these nasty things to your spouse,,,men and women both

    She was shamelessly filming the encounter to use in divorce court for even more of his money, assets, child support, etc. She didn't think he would actually pull the trigger. That's why she kept taunting and filming him. She assumed he would he would drop the gun and then the courts will award her everything.
    Little did she know just how dangerous a man with nothing to lose is.

    She stole $120,000 of his money and gave to the guy she admitted to having an affair with. She then proceeds to taunt and humiliate him on video and pretend like she did nothing wrong. This mans world fell apart and acted in blind rage, not a justification but understandable. Jury understood this and gave the correct sentence.

    They left out the part where she stole 120,000$, cheated on him, and gave the 120k to the man she was cheating with. And the part where she admitted to the affair...The husband told her multiple times to leave his house, and she didn't leave and just kept taunting him, she was gloating.
    No saying she deserved death, but she wasn't no innocent sweetheart.

It never crossed my mind to do revenge. My house was worth way more than what he lost and I saved up for it over yeeeearrs of long hours working. You have to forgive and move on.       You're right, she was videotaping because she wanted to use it against him to get full custody of her child (she was building a case against him in divorce court), after already stealing 120k and giving it to her new man (also proven by the defense). I don't condone the murder, but I also think it's INCREDIBLY idiotic to call out somebody's bluff when they're in that state with a gun and you're ACTIVELY trying to make their life much much harder than you already have. Every person has a boiling point. Unfortunately for her, some lessons can only be learned once.

      I truly hate this crime and believe he should get the life sentence, however, I am a human being and I can fully understand those jurors. Thats an all female jury! That means at the core we all know the court system when it comes to divorce, child support and custody is completely unfair. A woman can cheat on her husband and still get the rights to take most of the money, the house and his child, WHY? Because while she spent most of the time with the kids, he was the one sacrificing his body and time to allow her that priviledge. We need to reform the laws!

    Edit: If she did cheat I'm not excusing that behavior that's a horrible thing to do to someone. However he took someone's life and even though he's an older guy he could possibly put other people in danger.     Those women jurors definitely saw what we can’t explain, even us as women, in that video. They definitely saw a husband who didn’t stand a chance against a manipulative wife. They recognized that the wife had turned on the ‘female turbo power switch’ …that allowed her to gaslight and manipulate her husband at will, and get away with it🙄
    Only fellow women can recognise the hopelessness of the husband’s reality.
    Each of these jurors will recognise this female ‘power’ intuitively, and none will confirm to the other what they’ve witnessed with their 3rd eye. But they will all in silence, append their unilateral decision.

    There's a reason people warn you about an animal with nowhere left to go. This was a man who lost so many things: his wife and the love of 20 years, his life savings of $120k, and soon his daughter being taken away by divorce settlements and a custody battle. The reason that woman was there was to win the custody of their daughter fully, she was taunting him in the video because she thought he might have a little care left. He didn't. He was lost the minute he had nothing left and to him it probably felt like salt in the wound for her to show up and film him.

      Guys there is way more to the story. The wife insulted taunted him for not being rich enough and for not being able to sexually perform....She stole money from him.....The guy went through a hell of a depression looks like in the video he was under the influence, but he did tell her to leave she didn't leave so technically she was trespassing and she followed him recording illegally on his property....Not saying it's an excuse for murder but she provoked her own death............Also if I were him I'd get a dna test...he should find out if the daughter is really his....And stop saying "affair allegation" There's a recording of her admitting to it the media and the sister should just admit she did cheat.....and who knows for how long she was cheating....Again the father should get a dna test that daughter may not be his.

    My nephew got 35 years in Virginia and didn't pull the trigger and wasn't at the murder scene either and he just turned 18.On ly in Stafford County Virginia. That old boy would have got life here in Virginia. Damn.😢😢😢😢😢😢

    One look at that man and you can see why anyone would cheat him. The fact that there was no evidence of cheating but all the evidence he murdered her point blank under the influence only to get 10 years with eligibility of parole in 5 is sickening. I'm even more shocked an all female jury sympathized with Jabba the Hut to give him this sentence. He seriously looks like that guy from Dune in the chair. I have a hard time believing if he was any other race it would be as lenient.

    My cousin got 25 years for being the middle man in getting marijuana to an undercover cop. The worst part is the actual dealer with a lengthy record only got 12 years, while my cousin who had never been in trouble and being his first arrest got 25yrs. Supposedly because my cousin was the one who transported the weed in his car even tho the dealer was in the passenger seat. They said since its his car so everything in the car is his and thus is responsible for it. This was 9 years ago so he still has 16 more years to serve.

It’s not comparing Patricia robbing Carey to his actions, but comparing a simple statement you made to facts of the case.
      He won’t get out in 5 years. In Texas, even for minor crimes, you almost never get parole on the first chance. He’ll do 8 minimum, and that’s only if he gets out on good behavior. Considering he’s never had a violent crime charge, and the only charge he’s ever had on his record is a DUI in 2008, he most likely will.
