      I have a pick-up with a utility body ( built in tool boxes, like you might expect to see an electrician or plumber driving ). So, I am wondering if the Cops could go into each of the locked compartments. The issue being that many of my tools could be misconstrued as weapons, especially my two machetes. Many other cutting implements, you could stab someone with a screwdriver. Hammers could be bludgeons. And so forth.

      ​@@OpenCarryUSMC It depends on the circumstances. I suggest you check out his video on police accessing your phones. If the safe uses finger prints, face recognition, or other biometrics. They can always push your finger to the touch pad for example.
      Otherwise they can't make you give them a code, combination or password. That requires you to choose telling them. Outside of that, they'll have to get in using other means if they really want inside.

      @@MrPingn yeah I absolutely will not use biometrics for access to anything. Phone, tablet, safe, nothing.
      Nor will I use any safe that has a key. I’m strictly manually applied combination to a security locking device. If it’s just to “keep honest people honest” then a cheap lock with a key or biometric is fine. But if it’s for actual security from bad actors (including police) then it’s manual only and a locking device known for its security such as Sergeant and Greenleaf.
      I’ve see officer force a finger print or facial recognition unlock as well as taking the keys off an illegally cuffed citizen to open the gun safe in their home. And keeping the key somewhere else isn’t helpful as picking a keyed lock is quite easy.
      And it’s for exactly those reasons.

    Maybe we need to change things. Perhaps cops should no longer be allowed to do searches. Instead they must report their suspicion's to detectives and in turn obtain a warrant from a judge within a certain reasonable time frame. .Asset forfeiture should be illegal and only used after a trial as part of a conviction. Highway police robbery and searches are terrorism. This must stop.

      We could radically restrict these opportunities for illegal searches by outlawing police from searching during victimless crimes. Most of these violations occur during accusations of loitering, "being suspicious", unlawful driving, walking too fast or too slow, and so on. Require an actual, tangible victim before (i.e. murder, rape, robbery, etc.) an arrest is permitted; Government can't be a victim without actual damage to persons or property.

      Laws, rights, etc., exist, but will THEY recognize it to be so. Kind of like, you're NOT recognized, even, if you're stating, proper laws in court, but you didn't pass or take the bar, most of what you say, WON'T be recognized, even if it's true, simply because you're not a "legitimate" attorney in their eyes. It's a way to monopolize and control with tyranny. Remember the U.S. CONSTITUTION limits the power of the government, do you think they want to adhere to and recognize that.

      If you didn't pass or take the bar exam, you're not recognized, as a "legitimate" attorney, even if the laws you're stating are legitimate, they'll pretend, said laws don't exist and not recognize it because it doesn't benefit THEM.

      No, not innocent. If they found contraband during but there was a technicality that should "invalidate" it as evidence doesn't automatically make a person "innocent" given the correct defense. The person still committed the crime, they just aren't convicted of it.

      It will specify what they hope to find, not individual things they can search. As this attorney said, if their warrant orders them to search for a thing, then they can search any place where that thing could be found. If they’re ordered to search for something that fits in your safe then they can search it, and they will force it open if you don’t open it.

      If they’re looking for documents and there’s your murder victim in the room and 10 kilos, that’s valid evidence. They might have to update the warrant or get an additional one from the judge.

      If the search was performed by a department which has a written policy then SCOTUS says it IS authorized. I think their mojo is greater than yours and you will lose that battle if you choose to challenge it.

      obstruction is a physical act, withholding information (4th and 5th amendment) isn’t obstruction.

    An easy way to prevent police abuses of Impound Inventory is that anything found during that inventory cannot be used as evidence, or the basis to get a warrant. If you want to search the vehicle for impound and use anything found as evidence, you must get a warrant.
    Watch how quickly the numbers of these inventories plummets.

    A cop was towing my car for no insurance. He said he was going to inventory my car. It was full of tools and supplies for remodeling. I told him it would take him hours. He then declined to do inventory.

      So Cal Deputy here. No proof of insurance is a ticket. Cars are impounded/ stored when the driver is arrested, the registration is expired over six months or for excessive parking tickets. So what were you doing because your statement is a flat out lie. Thanks

      ​@JB-mo8rs The rest of the country is not your CA district. Most states will impound an uninsured or unregistered vehicle. Does not necessarily entail arrest of the driver. But the vehicle is not legal for road use.

      The officer teaching my gun class said he took the key to a locked box in the truck of a pulled over person and opened the box without permission. He found drugs inside. The person got off because he didn’t have permission and no warrant. Lucky for the person the cop didn’t lie when asked if he had permission.

      ​@@gregfarnsley3851The warrant has to specifically mention the lock box/safe, and specifically what they are looking for in it. No different than a warrant to search you home, must specifically state what rooms they intended to search, what applicable objects in that room they intend to search(dresser/cabinets/storage tote/etc).
      Basically, if the warrant doesn't specifically say what is to be searched, it is off limits to law enforcement. Under just the plain text of the 4th ammendment.

      @@James-t6q8x If the warrant is to search building A for an item that that is the size of a shoe box. They can search anything inside building A a shoe box could fit inside. On the other hand if they are searching for a stolen 55" tv they could not search the oven because it won't fit.

    Sorry, they're not searching my vehicle without other non officers present with cameras filming everything. Maybe 6 or 7 years ago or here in Florida there was a sheriff's deputy by the name of Zach Wester that went to prison for planting drugs and ruining people's lives.

      They already have it in their possession and so your ‘reasonable expectation of privacy’ is already gone. If you had a Rolex in the glove compartment, wouldn’t you want that inventoried just to make sure it doesn’t disappear. Supreme Court has ruled it for everyone’s protection.

      There are still limits, but a lot of frauditors and SovCits end up in jail through their own stupidity and their vehicle seized. You do have to produce license, registration, proof of insurance on demand, there are no exceptions to that in any state, and you have to have all 3 to legally drive on a public road the whole "traveling not driving" line that SovCits use is bullshit. Beyond that you do not have to answer any questions and for a legal search the officer has to have a warrant or PC that a crime was committed. A mere traffic violation is not sufficient grounds for a search incident to arrest unless it's something criminal like DUI or Reckless driving.

    I see an issue with what he said. He said that you should say that you do t consentvto any search beyond the scopebof the warrant. Im concerned tgat if the warrant is later found to inproper, they will argue that you consented voluntarily to the search of as listed on the warrant. Because thatswhat you said. I would say "i do not consent to any searches, but i cant stop you from executing the warrant. So do what your legally entitled to do by the warrant, but understand that im not in any way giving my consent to anything you do.
    Make sure you dont say or imply that you consent to anything. Period.

      I mentioned about police dogs and their credibility. I mentioned the false indicators and triggered indicators. That gunpowder is, itself, an explosive and if the dog indicates on a gun safe, or any container in a car, that gives cops grounds for opening the container. That the articuable situation can be falsely contrived. And has in innumerable situations. So, even if it's an illegal search, it's buried in the legal linguistics.

    I work on safes and vaults for a living, and I've assisted law enforcement with warrant searches on a number of occasions. One particular case, I was asked to open two safes in a bedroom closet. (the warrant was for documents) Right before I started, the wife gave up the combinations. Don't know what the outcome was, but the defendant lost the ability to contest the validity of the search.
    Recently I helped execute a warrant in connection with a murder investigation. The warrant specifically called for a search of the gun safe for guns, rifles, shotguns, ammunition, holsters, and any mail with the suspect's name on it. I think they were most interested in a holster associated with what they suspected was the murder weapon. Got it open without any damage, and one of the detectives thanked me for ruining the confidence he had in his safe's security.

      police will handcuff you and put you in a patrol car for "interfering with the search" if you record them and there has been multiple times when officers went through a home with security cameras and "knocked over" the server rack or DVR where the cameras record to causing the drives to receive a major shock and be destroyed that's why only cloud-based recording ever survive, and now some police units are bringing wireless jammers so "suspects cant use remote tools or alert other people via wireless means" that also just so happens to jam the cloud-based services like nest and ring

    @ :57-(dont think this doesn't apply to the first :56 of the vid)- the vid shown was made on 9/24/2022. Stretch wrap became available in the 1950's. Crime scene tape became available in the 1960's. Writing on plastic was definitely possible in the '60's and printing on plastic was possible in the early 2000's. The police (all jurisdictions, Everywhere) have, and have had for decades, the ability to fulfill the requirements of the burger court procedures of 1976 without violating the 4th Amendment of the Constitution of the United States of America. The cars (with a nominal cost compared to law enforcement budgets) can be secured using numbered, printed wrap on the vehicles that would secure said vehicle to 1-protect the owners property while in police custody. 2- protect the police against claims/disputes over lost/stolen property and 3- if the police are worried about the danger of the car driving off on its own or blowing up they wouldn't be searching the car pursuant to arrest. They would be calling the special tactics unit. Bottom line. The police have the ability to secure a vehicle WITHOUT the need to search it, and WITHOUT violating the 4th Amendment to Our Constitution.

    My son had an accident in my truck, I was unaware his license had been suspended.
    They were going to tow the truck and i insisted on an inventory search since i had thousands in tools in the truck. The cop told me to get everything i wanted out of the truck.

    I don’t know about you. As far as I am concerned a search is a search regardless. The police was able to convince the SCOTUS to allow this kind of loophole. There’s just too many leeway for the cops to find excuses and too many gray areas.
    Assuming the inventory search was done in good faith and they discovered drugs or illegal contraband in the vehicle. What do you think they’re going to do? Look the other way and pretend it never happened.

      Actually, I know a prosecutor and we’ve discussed search warrants and he said he gets calls all the time for vehicle search warrants when the cops could use the ‘motor vehicle exception’ to the search warrant requirement. He has no problem getting one because he doesn’t want any evidence being suppressed.

    They did this to my friend. They had a Warrant for his wife who had committed fraud at work. They arrested her on the side of the road. They went to their home and broke into his gun safes while he was at work. He had no idea it happened until he was on his way home and turned his cell phone on. They Ransacked his house and took all of his firearms and ammo. He finally got his guns back with one box of ammo per fire arm. They kept all of his accessories. Scopes, vest, extra mags, cleaning kits.

    I have never heard of anyone being allowed to take video of the police conducting a search warrant. Most of the time they are either held outside, or locked up in a police cruiser. If there is any court cases specifying it is allowed, please get it out here for all of us to have.

    The law should say that the inventory MUST be done in FULL VIEW of the Owner of the property and they MUST sign off on the list of inventoried items. Any dispute or failure to do so will be seen as a violation of the law by the police.

    I can see that going only one way..... The officers order you out of your own home while they conduct the search.
    Twice in my life did I deny Law enforcement entry into my home. and both times I had 6 or 8 officers stacked up on my stoop.
    They absolutely do not like being denied,,, and made multiple veiled threats (like... we will remember this next time you need help)
    So I can easily see your demands to video them (how do you video when there are a dozen officers all searching and tearing apart your home)
    your demands ending with you face down hogtied in your front lawn.

    I look at it like this. My gun safe was literally purchased with the sole idea of keeping anyone that I dont want having access to my stuff from getting my stuff. I want them to have to work REALLY hard to get whatever is in it, so if that means them destroying my safe then GREAT, thats the whole idea behind locking something up in a safe. So if the cops want access to my safe then they will have to destroy it to get inside. I absolutely will not just give them the combination. My safe is not digital either so they cant just easily bypass it with a phone call to the manufacturer. Warrant or not, they are going to have to do it the hard way.

    My neighbor where I live went through a similar situation. He was pulled over for a plate light being out ( plate lights make plate visable at night) the officer after running license registration and insurance wrote a ticket for the light. When the officer returned he had my neighbor step out of the car then asked to do a search of the car. My neighbor let the officer search as there was nothing illegal in the car. The officer during his search found a receipt for a store that sells archery supplies such as bows arrows and parts for bows and fletching supplies. The officer returned to his vehicle wrote some notes down on a pad then spoke to someone on the radio for a few minutes. The officer then exited his car handed my neighbor a warning/fix it ticket told my neighbor to get the light fixed then got in his car and left. Two days later the same cop now with 5 other cops show up at my neighbors house at 6 am with a search warrant to look for illegal "Ghost Guns" since buying a new bow string and arrow rest and 6 arrow shafts is apparently suspicious and means you are making ghost guns. They found nothing since the reciept was not his but was mine. He gave me a ride to the shop to get my things one day we also went to Cabela's for some new fishing gear. and stopped at LL Bean as well. The reciept must have fallen out of the bag. My neighbor does not own any guns or bows only fishing rods and fishing gear. My lawyer is dealing with the situation since a reciept for archery supplies is nowhere near making "Ghost guns" But the real kicker is I live 50 feet away from my neighbor and have guns ammo bows crossbows and all of it is legal including the guns that were made from parts kits and the ones with 3d printed parts all legal in my state. Maine has very few gun laws.

    I’m a retired cop. When I first started it was standard operating procedure to search all cars incident to arrest. The laws changed on that because it was based on a pretty stupid officer safety justification. However, after we were no longer able to search incident to arrest we just started doing inventory searches. They are pretty easy to justify. It’s just stupid bureaucracy.

    I've seen videos where the cops say they have a search Warrent but refuse to show the Warrent to the homeowner. Some said they'll show it after they're done. Some also had lied and never had a Warrent. Others showed the cops saying its on its way but they don't have to wait.
    My point is the Warrent let's us know if indeed they truly do have a Warrent AND importantly tells us SPECIFICALLY where they can search and WHAT they're searching for.
    So my question is do the cops have to show us the Warrent prior to begin searching if we request it?

    Tell them with or without a warrant they aren't going into your safe. With or without a warrant they are not going into your house. If the judge wants to see inside he can come see for himself, he just needs to leave the cops outside.

    what if i have like 200 boxes of jewelery, just metal and silver, but they all in individual boxes on loose, some closed and some opened, they have to inventory each one? and write whats written outside in case its closed and if open describe it? or what, in case someen complains the items are missing, changed or somethiong, they so lazy and dont care they wont do anything of that, someone may do that in case a weapon or drugs inside, they cant just describe to the book what they interest and leave the other 200 boxes aside because its a lot of work, that might prive they just wanted to search for weapons and drugs, cause they are lazy af

      @@jeffreyplumber1975 in the backseat of your car, that was the case cause they didnt search the car for the inventory, just for the drugs and weapons, so they dismissed the case against him, they dont make inventory of your whole house hahahaha but like he says, they do for a car, with certain procedure, guess thats not open toi the public, to avoid exploits

      It depends on the infraction. DUI, Reckless driving, driving with a suspended license, speeding beyond a certain threshold are criminal not mere infractions. The usual way a traffic stop turns into an arrest other than DUI is people refusing to provide license, registration, insurance, though the people who do that usually have a suspended license.

      In some state they made failing to use turn signal a arrestable offense and those laws are enforced until challenged and overturned by people that usually do not have the $$ to challenge.
      I don't recall which state the video was made but was verified by the on scene Supervisor but told the cop to not arrest the woman as the cop had a history of harassing her.

      Some states class all traffic violations as misdemeanors instead of civil infractions. Any misdemeanor is generally considered "arrestable" if the cop "feels" like the person won't pay the fine or show up to a trial.
      There are so many loopholes intentionally included on the lawbooks that We really need to start over.
