If the suspect is claiming a conflict of interest, why would you risk it, it is in the interest of the state, the tax payer and everyone else that this does not become a problem. He is also giving misleading instructions (since the police officer does those tests regularly, to them every step seems obvious, but the instructions need to be absolutely clear for the suspect, or you get results like this. This is double true if your suspect is on the spectrum). And apparently even the legal system agreed this was dumb.

Combine that ego with having, allegedly, dated the suspect's current girlfriend and proposed to her, only to be rejected. You can imagine the power trip the guy was riding, being able to potentially ruin his ex gf current bf. Not to mention, a lot of departments and squads kinda rally around this "it's us vs them" mentality, especially with recent events involving police. So even if they know for a fact their partner is doing something incorrect, many officers tend to just allow it to happen because it's us vs them. Don't bite the hand of the person you sleep in the same bed with. Or in this case, don't bite the hand of the person you share a locker room with. No one wants to call out a fellow officer, mid-stop with a civilian, and undermine/second guess everything they are doing. Civilian goes home, likely to be never seen again, meanwhile you have to go back the station with that officer and potentially write a formal report, betraying them.
The second there was a conflict of interest it should have been handed over. 100% Even as a youth worker I was given extensive training on how to spot and address COI's. I refuse to believe that a cop wouldn't get similar training.

@@lunatic5162not really, they still have some inique qualities. They are great for dealing with large crowds. The officer has an elevated position and can see whats going on a lot better. They can also herd crowds quite well because of their size. If the officer needs to move through a crowd, a horse makes that a lot easier because on foot it could be hard to do, in a car its assault, but on a horse you should mostly be fine. Horses are pretty quick too, and they're more intimidating than just an officer alone. In the netherlands (where i live) police patrols on horses are still actively used (depends on where you live though), and their main purpose is actually in riot control now.

We will never know. What we do know is that man was absolutely DUI and should have been convicted, but this officer refused to recuse himself for another DUI officer, so it crumbled the case. The suspect even tried to tell him. He should have listened.

@@MrLanGT exactly. But it doesn’t change that I’m correct on the fact that the arresting officer acted on emotion and not protocol which is why they had to toss it out. I wish he allowed another officer to do the test and arrest him because I too believe he was a DUI, even at the start dude said he couldn’t tell. But once he found out it was him it literally didn’t matter if dude was sober or not he was going to arrest him. And that is why it was thrown out.
