Unless I am mistaken, officers discharged on misconduct are either not authorized to work in law enforcement again or, worse, ever again. Additionally, it all goes on record and again, unless mistaken, that never goes away. In terms of kidnapping, not quite. Kidnapping is not as simple as just being taken against your will, though in lighter cases it may be labeled as such for the sake of simplicity. However, the definition of Kidnapping is a bit more savvier. To be considered a kidnapping situation, someone has to be taken both against their will and with intent to inflict harm or abuse on the individual. Now, technically, the definition is a bit more specific but to avoid being flagged by YT's TOS, I will not go into specifics. Just look up on google "what defines a kidnapping charge" and you can get the specifics there. Some states may slightly change their wording. Do do not take this as being 100% universal. Conclusion - If my current knowledge of all this checks out, the officer who arrested the boyfriend and took his daughter should have been discharged from their position, put on record, and given a few years before he could attempt to rejoin the force at a minimum. I personally would make it permanent but I am not the judge so, meh. Secondly, while he did take everyone against their will, there was nothing in the situation to imply an intent to do harm or other extreme offences against those who are taken. That said, the daughter may also have simply chosen not to press any charges. Same for the boyfriend. But I was not there or involved so I can not speak to the specifics of what did or did not happen. That is just my understanding and of course, if anyone knows more and is open to politely correcting anything I have incorrect, you are welcome to say so. Just be nice.

What’s crazy about the second footage with the excavator is that I looked up these people and they look like a seemingly normal family. For those of you who wonder why the first cop didn’t go to jail, you need victims to press charges to do that. In this case, it’s his own daughter and her boyfriend so it’s unlikely they would send the dad to jail.
That’s not true at all. Some municipalities will take the victim’s wishes into consideration when deciding to charge someone, but there is no place in the US the *requires* victims to press charges in order for someone to be charged. A crime is a crime is a crime regardless of whether the victim wants to press charges.

I don’t have proof, but on a different video that covered the same clip paperwork was provided to the channel that showed he did in fact handle the previous charge and pay fees involved to have it closed. So with that in mind I can totally see why he considered it confrontational and adversarial that it’s being used against him again when it had already been handled. From the family’s perspective it looked like textbook harassment, especially when the claims are flimsy like “not a complete stop at stop sign” which are hard to prove and are often circumstantial evidence based on simply the cop’s discretion.

Officers found to be guilty of misconduct usually at the minimum will face a demotion and possible department transfer. In worse cases, they are terminated. From an outside perspective, termination sounds like a light slap, but its almost akin to a military dishonorable discharge. Unless I am mistaken, officers discharged on misconduct are either not authorized to work in law enforcement again or, worse, ever again. Additionally, it all goes on record and again, unless mistaken, that never goes away.
In terms of kidnapping, not quite. Kidnapping is not as simple as just being taken against your will, though in lighter cases it may be labeled as such for the sake of simplicity. However, the definition of Kidnapping is a bit more savvier. To be considered a kidnapping situation, someone has to be taken both against their will and with intent to inflict harm or abuse on the individual. Now, technically, the definition is a bit more specific but to avoid being flagged by YT's TOS, I will not go into specifics. Just look up on google "what defines a kidnapping charge" and you can get the specifics there. Some states may slightly change their wording. Do do not take this as being 100% universal.
Conclusion - If my current knowledge of all this checks out, the officer who arrested the boyfriend and took his daughter should have been discharged from their position, put on record, and given a few years before he could attempt to rejoin the force at a minimum. I personally would make it permanent but I am not the judge so, meh. Secondly, while he did take everyone against their will, there was nothing in the situation to imply an intent to do harm or other extreme offences against those who are taken. That said, the daughter may also have simply chosen not to press any charges. Same for the boyfriend. But I was not there or involved so I can not speak to the specifics of what did or did not happen. That is just my understanding and of course, if anyone knows more and is open to politely correcting anything I have incorrect, you are welcome to say so. Just be nice.

That first "cop" is an excellent example of a dirty cop. As a Police officer, your duty is to protect and serve, not ignore a literal patrol call in favor of terrorizing his daughter, her boyfriend and their friends just because you don't like the boyfriend. What’s crazy about the second footage with the excavator is that I looked up these people and they look like a seemingly normal family. It’s just wild to me that it got to this point and all three were arrested (including the mother for impeding an arrest). I love my kid too, but sometimes you just have to be patient.
For those of you who wonder why the first cop didn’t go to jail, you need victims to press charges to do that. In this case, it’s his own daughter and her boyfriend so it’s unlikely they would send the dad to jail.
That’s not true at all. Some municipalities will take the victim’s wishes into consideration when deciding to charge someone, but there is no place in the US the *requires* victims to press charges in order for someone to be charged. A crime is a crime is a crime regardless of whether the victim wants to press charges.

I saw that one too. The dad handled it well, but I ended up thinking that the cops who initially responded allowed him and the daughter far too many "professional courtesies". It struck me that they would have arrested any other woman her age much sooner, and without allowing the parent to drive out and be present. Nor would they have waited so long before performing a sobriety test. I don’t have proof, but on a different video that covered the same clip paperwork was provided to the channel that showed he did in fact handle the previous charge and pay fees involved to have it closed.
So with that in mind I can totally see why he considered it confrontational and adversarial that it’s being used against him again when it had already been handled. From the family’s perspective it looked like textbook harassment, especially when the claims are flimsy like “not a complete stop at stop sign” which are hard to prove and are often circumstantial evidence based on simply the cop’s discretion.

@@DalesDubs Most definitely if he was off duty the problem is he did it as a illegal traffic stop illegally detained her boyfriend and then illegally detained and pushed her into the vehicle then proceeded to lie about suicidal ideation. Various other charges could most certainly be brought upon by the boyfriend or daughter but i dont think any Prosecutor and Internal Affairs worth theyre weight in salt would failt at locking him up for SOMETHING
