- A local locksmith says he was tipped off by something very strange at a recent job, which led to him helping a woman escape from a kidnapping.

With your comment you seem to be suggesting that kidnappers and stalkers with money should be allowed out to finish the job. What California is saying is that a judge should consider many factors to determine if a suspect is a flight risk not just how big their wallet is. It about people getting charged with small crimes having to stay in jail, possibly losing their jobs and homes, because they can't afford bail. While richer people can walk Scott free. This guy shouldn't have been allowed out bail or no bail.

I'm not sure in this case the justice system is at fault. He wasn't let out by the judge, he was forced to bail out. The justice system cannot prevent all crime. It cannot predict what criminals are going to do. We don't live in a perfect world, humans and our institutions will always be fallible. The only one to blame is the individual committing the crime.

They get called back to cover for other judges. It's not unusual to see dementia, alzheimer's on the bench here. Saw an old female judge give $1000 fine to an 18 yr old girl commuting from college with no previous record, for forgetting to take her cruise off from 65 to 55. The cop was even shocked, so she kept asking him, 'Are you sure there was no previous record'? At the end of it, the judge said, 'You're certainly welcome to get a lawyer', and laughed. Watched another 'retired' judge let a s€x trafficer walk with the sweep of his hand. Our tax dollars at work.

@@TruckTaxiMoveIt people are held in jail for lesser crimes such as drug possession or burglary (different from robbery, burglary occurs when no one is in the home that is broken into) until their court dates. this is done when people are either likely to commit more crimes if released, or likely to skip their court dates. In the case of domestic violence, the likeliness for more crimes to be committed during the time between their release date and their court date is extremely high and happens all the time. Therefore people who commit domestic violence should be held in jail on higher bonds which they are less likely to be able to pay, and therefore less likely to get out before their court date. However, often times that is not the case.

When someone posts bail and re-offends, the judge should serve time. It happens far too often and victims are the ones who need protection, not criminals.
this sounds good in reaction to this particular news story, but if you imagine how that will look in two or three years.... It means that effectively, bail has been eliminated. I think that having smarter judges might be helpful. Some of these legal system will just trust anybody who talks "right"

Bail is a right that has been around since Pre-Independence America. It is not the judges decision outside of flight risk factors.

@@snowflakehunter Bail is not a right (8th amendment). Nor is it guaranteed outside a flight risk. There are a multitude of factors that come into play when determining whether a defendant is eligible for bail. And it is the judge who determines if one is eligible for bail.

I called our neighborhood locksmith to keep out my abusive husband. While he worked on my front and back doors, my 2 daughters and I packed my exes clothes in boxes, put dowels in the windows, and packed my car with camping gear. I wrote a check to the man for changing my locks, put all the boxes in the front yard and went camping for the weekend to hide. The locksmith never cashed my check. I never got a chance to thank him for his kindness as he observed 3 girls scared to death of a man, trying to make it out alive.

Maybe the locksmith deserves a tip....if you know what I mean... ok lady? We can't go around not rewarding GOOD MEN for their good deeds...because good men can just as well turn bad, and TAKE their reward instead of waiting invain for it to show up on its own. Or that I had learned the locksmith closed the business and moved out of state to live with family after his wife passed away. Exactly what I was thinking. Thank God she had the good sense to at least make the appointment.
According to the news report the woman called the locksmith and made an appointment for the next day. The locksmith met his obligation and showed up as scheduled. Everything else we know nothing about except for what the sheriffs told the reporter second hand and she then related to us third hand. Although unfortunate that she didn't have her locks changed sooner, it is very possible that the need to have her locks rekeyed came up very suddenly.

If he would've changed the locks a few days earlier, that guy probably would've broken in or forced his way in and held her there. Considering how far he took it, I don't think a locked door would have stopped him. And then she wouldn't have had the locksmith to help her. So maybe it's not "too bad" but "Thank God" the locks hadn't been changed yet. ☺️

Why bail out? I hate this. How many times does this scenario end with them getting out and murdering the woman? I can think of a few cases just off top of my head.
@Esoteric x That is a good point, yes i made that comment assuming he was guilty, but you are right sometimes an arrest happens based only on the word of the “victim”, who is lying. I wonder how common that is? That would be interesting to know. OK, so to protect a man (there are exceptions but for purpose of this example, i will use most common) who may have been falsely accused, bail is permitted. However, it is alarming how many times an actual abuser gets out on bail and kills his partner. Do you have any suggestions? Only thing I can think of right now is to make sure the perceived victim is notified upon bail release, so she can take necessary precautions.
PS If a woman lies about abuse or rape and is caught lying, I think there should be a substantial punishment. Sometimes you have a crazy ex determined to ruin a man’s life and he has a right to defend himself, clear his name, and continue living his life. It is a dilemma for sure.

While we know more from an unbiased person and the fact that he was at HER house with HER phone, you are absolutely right. Another woman in the same situation could've invited her ex over to "talk" and then lured him in to have rough sex. Yeah her ex, that scumbag who slept with her best friend? I asked him to come over thinking we could talk through it. He got angrier and when I mentioned my best friend and counseling, he snapped. He was laughing the whole time he was hurting me, raping me, saying it belonged to him. Thank God, that locksmith saved my life.

It happens here in England all the time - 'the offender was given police bail' - and then 9 times out of 10 they don't turn up in court ... or worse!

I have said it many times. We do not have a justice system. We have a legal system. A court of law. Justice does not get a peek in the door. And its not always the judges...bail may be set at x dollars based on the offense, and if you can post it, off you go. That's when government tries to make sure "everyone is equal". Everyone is; every (alleged) crime is not. Friend of mine had her ex flip out, he barged in the house, ripped out all thd phones and took her cell. Threw it all outside. She didn't say what else he did, but I doubt it was a discussion of how to patch things up. She managed to get away, ran to a neighbor, who called the cops. Eight cops showed up, and all 8 walked her back to her house. She saw the guy's car was gone and told the police it was okay, he was gone. Cops were, "No, ma'am. We are not leaving you until we check the house." You guessed it, dude had moved his car to bait her, and he was waiting. Cops made his acquaintance and carted him off. Dude faced charges much like this guy's, except he was already on probation one county over, and they welcomed him back until his new trial could be arranged. No bail for parole violators.
Bail has been around in America before our independence for a reason.

Same folks complaining here about bail might complain in another case that some spent 8 months in jail, unable to afford bail, only to be found not guilty. But...put an ankle monitor on the perp set to alert police if the accused gets within a certain distance of the accuser. There is no solution thst makes everyone happy.

Just saying something to someone in a manner that might be perceived as threatening is more than enough for an overzealous cop to charge someone with "assault," whether the cop witnessed it happening or was miles away from the scene at the time. Many here are confusing battery (a physical act) with assault (a verbal act). If battery HAD occurred, it seems certain that it would have been included in the charges against the alleged perpetrator. It was not.

Only the judge can answer that question. It is obvious however, that he/she believes that the accused is entitled to the Due Process guaranteed to him by our U.S. Constitution that so many of our military have fought for and died to defend.

Always err on the side of caution. I’d rather be wrong about something, than living with a tragedy I could have helped prevent. Doing the right thing isn’t always easy, but as far as I can tell, the only thing I can take with me when I die is my integrity.
Yes this exactly!!! It’s like the news story where the neighbors heard the angry family member, they heard the mother threaten him to leave immediately. They heard fighting, and then the man left. Not one person called 911, he came back a couple hours later and ended up killing the little girl in the house. And I truly believe her death is on the neighbors, if they had called 911 she would still be alive. That man would have been arrested, police would have been waiting for him.
