With all the emotions, who could stop at that moment to think maybe one day that might land THEM on the wrong side of a lawsuit?? Even if we all knew that, it still wouldn't stop most of us anyway!! It's actually wild that not only did she have someone actually advise her to sue Ariana, but the fact that she's legally suing someone she did something even more horrific and spiteful to repeatedly for months in the first place. This legal system is broken its become all about money and who's willing to sell their souls for fame, money, and greed. Obviously, I'd be a horrible lawyer because I'd only want to represent people who aren't going to hell and taking me with them, and well, that's not too many people these days. You can sue anyone for anything, and if your lawyer is expensive enough and good enough, you have a chance at any dollar amount you can squeeze from honest, hard-working people.
Arianna is kind but it’s also a matter of being smart, had she done that she’d have lost a lot of money in a law suit and possibly have had a minor arrest to deal with, so for everyone’s sake I’m glad she didn’t do that

there's a legal theory that can protect Ariana in this situation - as she sent the video to the person in it and nobody else, the judge will likely use that theory to dismiss the case against Ariana. IF SHE HAS A GOOD ATTORNEY and a judge who understands it. neither of those things is guaranteed.

I am absolutely Team Ariana for the affair and the fallout. That being said, it isn't illegal to have an affair with someone. Sending an explicit video to another party in the manner it is being reported is. It's like Rachel has proof that Ariana sent it to someone else - or at least her phone was used to do so. (remember how James took Faith's phone with the Jax cheating debacle?) Tom is to blame for all of this and he never takes responsibility for anything. He almost does, then we get the 'whataboutisms'.

When I got a bf cheating, I took pics of the texts so he couldn't delete them & gaslight me! He'd done it once before & I believed him because we were wasted when I saw the original texts. It's a terrible feeling to know you've been betrayed and you're not thinking clearly. I get why Ari took recordings, but if she did show them to others, she should be held responsible.

Ariana sent tvideo to Raquel but Tom grabbed phone and thoroughly deleted it. So, she had no time to show anything to anyone else in person. Phone company records (upon subpoena) could show who she called or texted and if anything was sent. Raquel is still horrible and only Tom should be sued. Bravo is not responsible for anyone's behavior. The affair only became part of the show in its aftermath.

To be labeled an unwilling pornstar would be if those recordings were ACTUALLY LEAKED to persons or websites that allow the general public etc to purchase or view them! They're not LEAKED! While one MILLION percent, Tom needs to be held accountable for recording her without her knowledge, the use of the words "unwilling pornstar" and "leaked" are beyond a stretch! AGAIN, one of my questions is IF the big plan had gone off as planned and she and dillweed Tom ended up together - would she be suing?? Those recordings STILL would've existed! Tom is wrong for recording it to begin with but Ariana didn’t have permission to go through the phone, she took it into a stall in the ladies restroom, went through the photos and sent it to herself. Then she sent it to Rachel so technically she was wrong. I totally understand why she did it but it’s illegal
If Ariana only saw the video because she went into Sandoval’s phone and Sandoval did not voluntarily show Ariana the video, they would both be in trouble, but fortunately it would more so be Sandoval, for taking the video of Rachel without her permission and for not protecting Rachel by allowing Ariana access to his phone via allowing Ariana knowledge of his password. However, unfortunately, and I wish it wasn’t the case, Ariana might have some consequences if Sandoval wants to sue her back, but it’s unclear, since he had voluntarily given Ariana is password and didn’t do anything to change that. The law says that the person who publishes a private video to a 3rd party can get in trouble. But the 3rd party will only get in trouble if that 3rd party publishes it to a different 4th party. So if Ariana went into Sandoval’s phone and only sent the video back to Rachel via Sandoval’s phone, then there would be no reason for Ariana to be in the lawsuit, because nothing was published to a 4th party. I am an attorney in California just so you are aware I am not just stating opinions. Love you, Adam!

If I knew someone had a video of me, I'd never feel comfortable with them having it on their phone and especially if I wronged them. I researched the FaceTime video call Re:Rachel and it said there’s several signs to look for to determine if someone is screen recording: if you notice sudden changes in call quality like freezing, also some devices provide a notification or indicator when screen recording is in progress, icons, screen alerts, the list goes on and on! Now I’m done with the gnat that won’t let go of VR-

Whosoever distributed the tape, is the point. To distribute a sexual tape, without the person's permission by law is not legal.
However you want to slice it up. It's the law plan and simple. I believe it was sent to others. Allegedly that's what I heard online, from many podcasts if I am not mistaken. No shade intended just the law.
