When I visited Australia (in-law works there), one lad I met took the piss because he recognised my Yorkshire accent (which was sharp because my accent is relatively soft) and a few others tried to poke me with the Queen's death, but they realised I was indifferent and then every other sentence started or finished with mate and I didn't have to buy my own drinks. I enjoy Australian banter and humour because it aligns almost perfectly with British sensibilities - Australians can be self-deprecating and see the absurdity in something they hold dear at the same time. I struggle with American culture and humour but that's by-the-by.

Most divorces don't go to court, but get settled out of court between the parties. The reason you only hear about the drag-out divorce fights in court is because it's more spectacular. This is probably just an agreement between the two parents.
A judge doesn't know your kids. If both adults in the situation tell the state "This arrangement is in the best interest of the kids." they will take their word for it and do that. (unless it is something obviously stupid like "It is in their best interest to be sold into sex slavery.")
