      lease Help 🙏🙏My employer file a case under 37 cpc for breaking employment bond can anyone guide me?
      Whole situation-
      I joined the company at x salary and after 6 months I wanted to leave company because I got better offer and I file a resignation.
      They asked me they can give me same offer and can push my growth in future as well… they said you need to email us that you are ready to sign 2 year bond. But They didn’t provide any training
      After signing the bond everything was good but after 7-8 months of signing the bond the work getting affect my personal life and I offer them that I want to resign
      They accepted the resignation but didn’t pay salary of that month when I ask them they said you need to pay 5 lakh as mentioned in the bond
      I emailed them that I cant go further with you because of work pressure and you can take my one month salary as a good will but I am not able to pay full 5 lakh
      They didn’t agree and I left the company now I get a summon for the civil suit

      write mail to the company and warn them if they do not provide experience letter, I will file a lawsuit against them most probably they will give if not then send a legal notice.

    Don't work a single minute. Sit idle. You don't have to resign. Company will terminate you it self. And don't go home without getting termination email.

    Vyom Labs Pvt Ltd is one of those employers which recruits candidates and directly outsources good candidates without training, signing 2.5 years bond. If bond is broken, they ask to pay 2.5 lakh rupees. If one does not pay, they don't give exp letter.

    So basically we can fight and max we can loose is that amount only.
    I was very worried after seeing many high bonds like 2-4 lac for packages of just mere 5-8 lac and period being so long of 1.5-2 years.

      They obviously can stop giving the experience certificate which is the real issue. Cause the next employeer always ask for it. Even some companies ask for previous 3 months salary slip with bank statement which is such a shame in India.

      @@SaurabhSarang It depends on company to company basis. Most of the service based companies always ask for experience certificates and payslips whereas good product based companies don’t ask for experience certificate provided that employee is not lying. Moreover denying experience certificates is a criminal offence and if an employee forcefully challenge and say that I will go to court then company will definitely handover the certificates.

      Bonds are mostly illegal. They will never stand in a court of law. India abolished bonded labour long back. You can actually file criminal case against the employer and HR.

    I knew this and signed bond with a smile, left the company on my will and owner of company was pissed. He even threatened me by saying he will not allow me to work in NCR, but nothing happened.

      relieving letter: discuss with you next employer if they need it.
      PF goes to your account monthly or quartely, once its in your account dont worry, if you are pissed with a bad employer you should not care for Pf of a month two.

    Not applicable in case of PSUs and Govt. jobs IG. Because until you pay, your relieving letter won't be given.

    What I do Should I join ?
    my employer conditions : Note: There would be 18 months bond in which first four month of training period we will provide you stipend of 1.92 LPA CTC all inclusive, after that based on performance evaluation, your CTC would be upto 3.6to 4.5 LPA inclusive of association bonus which will be released post 6 months on bond completion. Also you are required to submit non refundable guaranteed cheques of 1 lakhs, which could be from your zero balance account, company won't encash it and return back once the bond period will get over

    IT companies new grands ko MS karate hai bit pilani ka. Bond for 5 years. You have to perform up to a level and also score well.
    Salary 5 years ki fix hoti hai before joining.
    You cant leave for 5-6 years and no option to select kya kaam karoge.
    If they go to court, they show k woh bits pilani se masters karwa rahe hai, so uska kharcha lakho mein hai. Toh banda 5 saal ka pay bhi gawa dega.
    Aur real mein woh degree ke basis pe koi job nahi deta market mein. Years of experience ka he value milta hai.
    They found a loop hope 15 years ago for labor laws.

    Rajasthan government bound his employees such kind of bond.
    If employee resign from his govt. Servics, he should return 1.5 L rs to rajasthan govt if he resign within 3 years.
    Means he had to work free for three years if he resign in first 3 year.

      BONDED LABOUR is completely illegal. You can go to any labour court / Labour commissioner office. They are quick and no employer can win such cases against employees. Don't get bullied by their money or power. It never helped. Employees always win.

Maybe to avoid legal battles many employees pay the companies what they ask, to avoid hassle and lifetime savings employees agree to their demands even after knowing what u told since we know how fast judicial system in our country is! 🙏🏻

    Im being harassed by a company for HEAVY recovery. There was a bond that was signed however due to mannnyyy reasons we do not wish to continue employment in this unprofessional company. Now the company wants 3 months salary in addition to the relocation cost. We have already served 2 months notice WITHOUT PAY which is more than 3 times the relocation cost however they are still harassing us for an additional month’s pay and relocation. The leader is an egoistic person who can not bear the fact 5 people have already breached this commitment he force people to sign. Now he is taking it out on us. We’re going through mental trauma. This person has made our life hell. The amount of distress he has caused us beyond explanation. Can anyone please help us? What legal action can be taken against him and the company?

      you can file a case against company , if they don't give you neccessary documents. but in the india you will go to court and you will get tarikh pe tarikh.
