The rape had already taken place, the hate crime didn't escalate to murder, but the orange man has killed and had taken hostages, which made him a current threat. In terms of the rape, he couldn't prove it aside from the visions, the same for the hate crime.
Since you pointed that out, watch carefully before he backs into the orange man. The look of disgust and fear on his face. Imagine how overwhelming it must be to see the horror of human evil.
This scene is great because the colours are muted in general but when he touches someone who has done something wrong and he "senses" them they're suddenly vibrant to him.
