'ARCHITECTS: HOW TO NAVIGATE LEGAL CHALLENGES IN CONTRACT AND TORT?’

Architects today are confronted by various legal challenges, both in contract and tort. This seminar will tackle these issues head-on and cover :-
1) the law on negligence claims against architects (i.e. the scope of the duty of care owed by architects, causation, recent amendments to the law of limitation of claims and possible defences for architects);
2) crucial contract law for architects (including on Letters of Appointment, the recognition of oral contracts and Whatsapp contracts in Malaysia and recent developments on illegal contracts under Malaysian law);
3) best practices to minimise legal issues (including proper documentation, professional liability insurance and continuous professional development); and
4) an introduction to the Court process and alternative dispute resolution methods (including under the Agreement And Conditions of PAM Contract 2018).
