The defendant offered to sell his property for 280 Euros. Plaintiff sent 80 Euros and promised to pay the remaining by monthly installment of 50 Euros. The defendant gave no reply. So plaintiff sued for enforcement of their agreement. However, it was held that no agreement was reached between them as the exact amount fixed by the defendant was not paid by the plaintiff. And silence by one of the parties to the contact does not amount to acceptance. Hence nothing here can be enforced.
