      @@WholesomeMilk Actually a handful of states permit the same behaviour. New Mexico, Nevada, and Alabama for instance have no laws protecting a rape victim, even with a conviction for their attacker, from seeking parental rights. Many states only adopted some legislation in 2016 to protect victims. Several dizen states require a full conviction of a first degree sexual offense, so plea deals can give a rapist parental rights, and some other states require the victim to apply for termination of the rapists parental rights, which they get to contest. Forcing them both into court again.

    How. In. The. HELL does a convicted rapist not automatically have all parental rights terminated as part of their sentence? I think there's similar issues here in the US. This loophole needs to be shut. NOW.

    Any man who has a child through rape should have absolutely no rights to that child, especially not this guy. If the woman decides she wants her child to meet her rapist that's her decision, it should not be up to any government.

      @@bubblyblondebrunette_1581 it's a messy situation and no way you handle it is going to please everyone, but the most important thing is the welfare of the child and the mother. If the family members are decent people then maybe they develop some kind of relationship and work something out, if the mother doesn't want that she shouldn't be forced into it. They could possibly have someone other than the mother take the child to see them. There's many different ways it could work out, it's not really the center issue though.

    Honestly I think it's absolutely appalling that a rapist has any parental rights to a child. That weighed on my mind very heavily as I had to make the tough decision to get an abortion. Seriously something needs to change to keep these monsters aware from these innocent children. Please I'm Canadian so no comments about my story and the hard decision I made I'm just sharing to add awareness to the serious problem going on and how scary that can be for a victim after everything they've been through it's scary to think your rapist could ever get any type of rights to the child.

    This is my personal life I won't even bother looking at comments dont care. My birth dad beat and molested and allowed rape to happen for myself, my younger bother, and younger sister. CPS came time and time again then would talk to us only in front of him, all younger than 10, and never did anything. We ran away once and eventually got back to our moms house, the police came and used the court mandated order to say if we didnt get in their car and go back, our mother will be arrested. Then eventually he got actually caught molesting my sister, then the courts took her to our mom, but said my brother and I could still see him as "he is only a danger to girl children".
    So yeah that whole system is absolute trash.

      My sister ran away from home to a friend's family and called a run away national hotline (this was mid 1980s) and the local social services. My dad was a known abuser to mom and all of us kids we were in and out of foster homes (more so for my siblings) and they made her go back. He beat the immortal hell out of her. She was 15 I was 4 it was so messed up even then. It makes me sick what little progress we have made in the last 30 to 35 years is sickening. This was in USA btw.

    People honestly give Payless such a bad rep. You can literally get the same shoe in Payless that you can get at Dillard’s or DSW and pay half the price not including the amount you save by getting free discounts from their reward system. Don’t quote me on this but I’m pretty sure Steve Madden runs one of the brands that are Payless exclusive. But sure go ahead and pay $80 for a pair of shoes you’ll beat up anyways

      Yeah, everyone craps all over them as a store but I grew up on Payless shoes and I never once had somebody make fun of them or anything when they were on my feet, and they were super affordable for my family so I would sometimes get a couple at a time if they had a sale. As a teenager, the most I ever got a comment on were "cute shoes" or "hey, new shoes?" and life goes on. People who buy an $80+ pair of shoes just for a name and expect people to fawn all over them definitely are the kind of people who are out of touch with reality. The only time I ever spend that much or more are for high quality work out shoes or warm winter boots, and even then only once every few years. Functionality over looks/brand imo.

      Make it like a mafia where you coerce burger joints into selling the place/recipe and keep it to yourselves or charge exorbitant sums of money for a chance to eat the burgers.     That Payless prank is my favorite kind of marketing. I grew up lower middle class and can remember when Payless was the most expensive my family could afford for new shoes. I mainly shop at DSW now, just because I have a rewards card with them and get a lot of coupons through that, but I'm probably going to check Payless for some new boots after that ad.

    Unfortunately, even in America, a rapist can have some sort of custody to a child that was conceived during the rape that the person was convicted for. It is outrageous and absolutely stuoud.. But unfortunately they still have "rights" even if the other parent was under 18 when the rape happened which is even more appoling to me.

    Anyone with a child related crime has nothing to do around children. This law needs to change. It’s alarming that this child could end up in the hands of his relatives or even be forced to see him. The system is wrong in many ways just like where I live where children are sent home/forced to meet their addict parents yet taken away from mothers who are minutes late for pickup and put in foster homes.

      I would just like to thank Phil for covering the Sammy Woodhouse story. I commented on his video with the UK school bullying story, a couple of days ago, saying the bulling story was only reported to overshadow and bury the Sammy Woodhouse story on our UK national news, which it did, with fake outrage over this 2 month old bullying story.
      Nice to see he covered it, and I totally agree with his sentiments on the story and her rapist.

      Ilja xox could not agree more , if we are talking about convicted felons with certain crimes against children, and as long as it applies equally to men and women. Also not all the crimes. A drunken driver that kills a child on the sideline can’t get custody but can have supervised visitation. It’s just changing the law in a rational equalitarian way.

      Jaime Duncan Yeah, the laws need to be catered for the children not the parents. It’s not in the best interest of a child to have visitation with child sex crimes etc.. Visitations are meant to be in the childs favor but with the laws how they are in many countries it’s more for the parents to see their kids and/or manipulate eachother using the kid. If she got pregnant at 15 with the child and is 33 now than that child is damn near an adult already so why would they even bother trying to place the child in someone elses hands? Depending on where this is at wouldn't that child be able to file for emancipation as well?

    Phil, the account of the mother and child is quite disturbing and disgusting as you so stated. Here is the sad truth. For the last 8.5 years I have been in and out of the court here in the US because the man who held me captive overseas has “visitation” rights. I have been living the same nightmare as this woman because of our laws. He is the one who keeps bringing me in and due to the fact that the assault and captivity was never convicted he gets to do this. It’s absolutely abhorrent and court ordered abuse to not only the survivors but now also their children whom they chose to keep. We must make a change. I’m a big proponent that we together can move mountains and bring hope. I personally have chosen to take make greatest Hell and help others.       At this point, re-traumatization is almost inevitable for most survivors of some form of abuse and its just heartbreaking. Survivors should NOT have to deal with this on a daily basis while trying to move on with their lives and heal, its absolutely absurd and incredibly damaging to our mental health.     The final story absolutely shocks me. How does anyone with a shred of human decency not see a fundamental issue with allowing a rapist this form of legal control/influence over their victims and a way back into their lives when they want nothing more than to move on and put it behind them? The fact that this even needs debate and isn't immediately changed makes me sad for humanity

      While it is appalling, look at all the legal precedent when it comes to parental rights it isn't surprising. For example: if a woman has a one night stand with a man, pokes wholes in the condom to get pregnant the man has no legal right to remove himself from being legally responsible for the father so he has to pay child support etc. The legal system just looks at DNA, ignoring other factors. The whole family court system including divorces really needs to have a massive overall.

And now he is in the same situation as a woman getting raped and becoming pregnant. It is still absolutely horrid that both case victims are forced into parenthood and such and I believe in both cases the rapist shouldn't have a right to even speak to the victim or child.

      That was my point, when the court views situations like these there are no victims and no criminals, only DNA. I was just pointing out how this is a systemic issue that the court system when it comes to family/divorce laws are very archaic and only look at DNA. It just takes a situation like this that really points them out. As a Canadian who knows multiple people who work for the government in different aspects of child protection, similar cases are heartbreaking and occur very often yet never get discussed or the outrage which they deserve.

And right now all it does is destroy what little mental stability that is left for Tue victim and the child. Think about the child for a sec. They know that one of the parents (the father in this case) is a shitty human being and is the reason for their other parents depression, PTSD, and other potential mental issues. Or worse, they don't know and now they have to be told that. I don't care if he is a particular race. He is a shitty human being and this needs to change.

    Yo alaska is in a state of emergency. We had a 7.0 earthquake. All of Anchorage is pretty much shut dowm. Theres talks of them killing water to the city as well. I'm out helping people at the moment. But anyone in town that can help needs to get out there because there's gas leaks all around town. You can smell it in the streets in some areas.

    Just thoughts from a Law student living in Rotherham. Unfortunately, this isn't a "loophole" as some comments have described it, rather just an extremely devastating flaw in the law and the council's processes. While it is extremely unlikely the English Legal System would ultimately allow for Sammy Woodhouse to see the child that he is a parent of due to such a horrific crime, it's still disgusting that this enables a convicted rapist to continue to hurt their victims while behind bars. I believe the MofJ is correct, and that it would've been possible for the council to avoid this, should they have been aware of and/or acted upon the route to prevent this happening.
    And as Phil touched on in the PDS, this is not a new sort of area of law/by-law for the council. Back in February of 2015, the Government revoked many of the powers and control of services that Rotherham Council had, after they failed to act appropriately into sex abuse scandals. These powers have only recently been returned to the Council in September of this year when it was believed that the Council had put enough work/effort into restoring children's services.
    However, after an event like this of Woodhouse, which has reached such tremendous public interest, it wouldn't be surprising to see these powers revoked early next year when a scheduled review is expected to be completed. While it's essential that these powers are handled appropriately and used to their greatest extent in protecting our children and victims, I'm concerned about the pain and damage that could come about as a result of a constant flip-flop of power and control. It seems like the victims of the various sex scandals in the town are constantly being reminded of the past and events that they had hoped to be able to put beside them. The Council needs to step up and take accountability for their actions, and call for a change in the law and their systems, both locally and nationally.

    I love how you covered the Payless thing. Most people don't realise how much perception affects the price of things when it comes to retail. Rolex used to sell watches for pretty much the same price as Timex. The company wasn't doing so well and they tried a last-ditch desperate manoeuvre to save the company and rebranded themselves as the "high roller/top notch" brand. Same quality of watches, same watches in fact, just for hundreds of dollars more expensive... and the rest is history. Moral of the story, stop spending crazy amounts of money on stupid sh*t. Shoes, purses, clothes even jewellery are not worth a fraction of what people pay for them. They only cost that much because you are willing to pay that much. If everyone just stopped, we could get the same stuff for WAY cheaper. Now go look yourself in the mirror and feel shame ;)

      I once bought a pair of Pumas and they lasted 6 months then I bought a pair of shoes from Walmart it has lasted nearly 9 months now, though neither lasted as long as the boots I bought for work, I wear them 5 days a week and they have lasted nearly 2 years now, though they are really starting to get worn. (the boots were Wolverine brand and cost me over 200 bucks) though honestly this is one of the few times I believe the thing was worth more then I paid for it as those boots both lasted forever and are also the literal most comfortable thing I have ever worn on my feet.

    I used to work in one of the super touristy Payless Stores. People visiting from South America used to buy in crazy bulk because they said that in their countries Payless was considered a high end brand. Also depending on where your payless is, you get shipped different types of shoes. So touristy ones get more like Steve Madden heels while others get mostly regular sneakers

    What happened in Rotherham is disgusting and what continues to happen is horrifying.The part about rapists having parental rights particularly struck a cord. Wherever you are in the world, you should look into your local laws to see if something like what happened there with the rapist having rights to their child is legal. The state I live in within the United States that recently (within the last couple of years) passed a law that would prevent a rapist from having parental rights, but ONLY if there is CLEAR AND CONVINCING evidence that the child was conceived through sexual assault. It's something I feel everyone should know for their area, and as a previous assault victim, it's something I've had to look into personally, just in case.

    Background in UK family law. So the issue here is that different pieces of legislation add additional requirements. It is true that with the goal of ensuring fathers don’t get frozen out of proceedings this law was implemented. It is also true that “parental responsibility” (PR) is a huge legal deal. Mothers automatically have it, fathers only if there name is on the birth certificate.
    The council in question (and I’m guessing literally one person) didn’t read enough of the law to get the context that this rapist wasn’t on the birth certificate and so didn’t have PR.
    My best guess is one well meaning person was mindful of including the father, didn’t get to the part about PR and birth certificates and made an uninformed decision with partial information.
    The law likely doesn’t need changing, it needs reading!!

      Well there are rights that rapists should have, as any human should, but as in this case, this right should be revoked until either the victim or the child agree to see him which is not likely considering the circumstances

      Rapists are one of the crimes where I believe the death penalty is viable. For the sake of everyone's conscience, it could be reserved for people caught in the act. That way, there's no risk of it being the wrong person, just in case.

      Kasia there was a case similar to this here in America recently. The rapist wasn't running a child rape ring, but he was a serial rapist, and one of the young girls he raped (I believe she was 13 or 14 at the time) got pregnant from the rape. Even though he was convicted, he kept stalking her somehow. She even had to move out of state to avoid him. So, he decided to file for full custody of her child, to force her to move back to his state AND have contact with him. It was sad reading about the story because you could feel the terror this young woman was reliving over and over. Her attorney even broadcast it all over Twitter to try to garner support for her clients. I don't know how it ended, but it's disgusting it should be allowed to get to that state in the first place.

    There needs to be more information around social media and internet safety. A lot of people don’t realize how active their kids are on these sites and simply saying “we’re visiting family in the Midwest next week”, as harmless as it sounds, could be inviting a problem.
    I mean that just an example but there are a ton of vulnerabilities to all this technology...
