It's a total setup. I was arrested for DUI in Arizona. I blew a 0.0 and was still arrested. It took 2 months to get my blood test back. And I had no drugs in my system. It cost me thousands of dollars and I was innocent. They towed my truck and impounded it. I had to hire a lawyer. I had to post $5,000 Bond and didn't get it all back. Total scam and rip off. It's happening more and more.
The SFST always seems a little weird. Properly trained officers are presumably looking for certain “tells”; it’s not just about balance etc but also about jerkiness of movement, understanding instructions etc. as a Brit I always wonder why American cops don’t just use roadside breathalysers. She seemed to do quite well in the tests (but did she skip from 1003 to 1009 or was the film edited?). But she did fall asleep at a junction 😂 I would say that I’d probably fail the SFST when sober. I’m fit and healthy and play a lot of sport but I have hopeless balance so wouldn’t be able to stand on one leg or do the toe-to-heel walking without wobbling 🤷♂️
Her friend said she is the designated driver for the evening. I'm not sure they get the definition of that. She admitted to drinking the infamous "2 drinks". See the issue?
Why does it matter if it's 5 in the morning? If you're too sleepy to drive you could be a danger to the road. If you're so sleepy you miss an entire light YOU SHOULD NOT BE DRIVING.
Well there's nothing illegal about being tired. Yes it's probably just as dangerous but it is not something that you will be charged with unless you end up hurting someone. That's why he's trying to make that distinction.

If an officer is ever in doubt about the suspects intoxication after the FSTs, drunks will always show their true drunkenness when implied consent is read. 😂
How do you have a license & not know these laws? If you refuse, it's a year guaranteed loss of license. If you take the test, it's 90 days & may be up to a year. If I was in this situation, I'd at least pay attention to what the cop was reading.

In a normal first world country, the cop would have a handheld breathalyser, you blow in, and 5 seconds later, you have proof that driver is over or under the limit. But in America, it has to be a soap opera and it seems that's how everyone wants it to be.
They collect multiple datapoints because a lawyer could argue that the machine was defective, or hadn’t been calibrated, or the batteries were low, or she had just used listerine, or, or, or… They don’t rely on a single metric because it’s too easy to overturn in court. It may be different in other countries because the burden of proof is different, or the presumption of innocence is different. Don’t blame the cops, blame the constitution.

People should really look into the DUI laws of their state especially if they are going to say have a beer or a glass of wine with dinner. The field sobriety tests arent really made to prove you are sober. They are made to help the officer prove you are intoxicated in court which is why in alot of these videos you hear the officers quietly voicing every mistake the person testing makes. Before he asks you to perform the tests he/she has pretty much already decided you are going to be arrested.
