- The plaintiff brought her car into the defendant’s shop for repairs after a car accident. However, the plaintiff says her car sat in the defendant’s shop in limbo. She got frustrated and wanted to bring her car elsewhere, but the defendant still won’t release the vehicle. The plaintiff is suing for car damages and pain and suffering. The defendant says the plaintiff retracted the insurance claim, so he doesn’t owe the plaintiff anything.

If she retracted the claim, nothing to be had by the plaintiff. She is at fault in pulling the claim with the insurance company and she owes for the repairs of the car.

The deal was that the shop would be paid whatever the insurance company paid. No one is in the wrong because they have no control over the insurance company’s determination.

Judge ruled correctly. Defendant is a liar. And the defendant said that he’s not doing that at the end, after judge ordered him to release the lien. Not sure if anyone else caught that.

As someone who has worked for a major insurance company, which I will not name, and who has been in an accident the judge hit the nail on the head. I have had a repair shop inflate an estimate so that I would not have to pay the deductible and being 20 I didn't know what that was but when I was in my second accident I made the other insurance pay as their insured hit me from behind being on the phone. When I worked for an insurance company glass companies, repair companies etc would say "hey you throw us business we'll throw you business", and for that guy to start working on that car without getting an approval from the adjuster and the amount and then say he's going to use aftermarket parts make it cheaper. That is something that they do. He was completely in the wrong.
If a repair shop is willing to pull a fast one on the insurance, they're willing to pull a fast one on you.

Totally agree with the judge. I was an auto claim adjuster for 31 years, now retired. My particular area handled 14 states. We ran into 2 shops like this one. One in Portland OR and one in PA. Never chose shop recommended by tow drivers, especially they have shop’s business cards. Don’t choose shop where they waive your deductible. I know it’s good you don’t have to pay but shop has to make up the difference somehow. These shops don’t have your best interest at heart.

It sounds like his assistant, who was passing herself off as the boss, told him a load of lies and perhaps was hoping to pocket the 'storage fees'. Either his assistant is crooked all on her own, or perhaps his assistant is his girlfriend or whatever and they were in this together, but all his information is hear-say from his assistant...
Geico is the worst insurance company to deal with, my truck was hit by someone that had Geico and they were trying to say my truck was totaled. A broken leaf spring, wheel cap and a dent in the bottom corner of the cab is not a total truck. They actually already submitted claim to total the truck before even speaking to me, first mistake. Then adjuster said frame was bent with out even inspecting it, second mistake, it wasn’t ! I came down to the repair shop and told them give me my truck and drove away.They told me I could buy the truck back and I said why would I do that , I already own it. Went to a friends shop made and estimate of damage and made them pay it , and it was more than what they wanted to give me for the totaled price they offered originally but because I had adjuster over a barrel because she jumped the gun thinking they were going to bully me into accepting their pay out. If you get hit by someone with Geico never let them take it to a Geico repair shop !
A car can be drivable and still totaled. That just means the cost of repairs are more than what the car is worth. Usually by a certain percentage.
Lol you just don't understand insurance. I'm an adjuster for a different insurance company and that's exactly how we'd handle it too
I've had Geico for 19 years and they've been amazing. Honestly some of the best customer service I've gotten from ANY business, insurance or otherwise. What you described isn't really that abnormal.
All I got out of your whole story was you (or whoever) paid more in repairs than the value of the car. Totaling a car isn’t based on damage specifically, it’s based on the value of repair is more than the value of the car.

My auto shop has a sign that warns customers about "burying the deductible." It says insurance companies use the same estimation software so they will probably know and if your repair shop does this they most likely are giving you aftermarket or used parts to make up the difference. They posted this warning because they are an honest shop and were losing business to other shops that would "help" the customer burying the deductible.
Oh my!!! I feel like I got whiplash from this case! I’m so friggin confused & I’ll have to re-watch this. They are talking too fast & over each other. I just had to deal with our insurance in February & last 2 days of March due to two car accidents!!! One by me & one by my husband. And I hate them!!! Screwed us over big time on the one in March.. I don’t know why I watched this & re-watch it after our insurance nightmare!

I think it's because the defendant or plaintiff are too slow and not following. Nothing they say anymore is going to matter than what is specifically asked because she already studied the case before hand. This is just clarifications and cross examination.
Heard the ending of the case where he blatantly says he's not giving it back after the judge ordered him to return her car I just hope that she received her vehicle and it was completely repaired as it should have been since he jumped the gun

I'm an autobody mechanic of a 30 yrs, never had a problem with insurance companies. The big problem are the greedy body shops and their double dealings and cheating customers.

Your individual insurance rate won’t increase due to this unless you have a high risk score. She’s not guilty of anything, as she upheld her part of the contract, hence the ruling.
Years ago when i was a new driver someone hit my car and i took it to the shop their insurance advised me to go to. I needed something that i had left in my car days after I dropped it off and it was wayyyyy more damage to the car than when i’d left it My side mirror was ripped off my windshield cracked. and some other stuff…. it freaked me out so bad i told them i didn’t want me car there any longer and they ended up having to pay for the damages they did

It's not real court its arbitration, they are not obligated to pay. At least that's my understanding based on google

This is what body guys do- they promise you no deductible or that they will replace a part that wasn’t damaged- and they take the difference from the insurance company.
The fact that this lady doesn’t understand that so she sues, and he doesn’t just pay her a settlement to go away…..

She asked him for proof. He had none. There's no such thing as a verbal supplement. Insurance companies don't work like that. If it's not in writing, it doesn't exist. The shop would have to show pictures of what couldn't be fixed and prove their costs in writing. The defendant has no proof he requested a supplement. That's his problem.
These places and insurance companies have a contract, so they accept whatever the adjuster says the damages are worth UNLESS they discover damages that aren't visible after taking the car apart. That's called a supplement.
Not a fan of the defendant, but it was agreed that the deductible would be waived if the insurance paid, but the insurance did a $369 check and plaintiff would have to cover the $500 deductible.
So the plaintiff is getting a car repaired for $369.51 since insurance nor plaintiff are covering the deductible???

I had a company actually damage my car because I refused to sell it to them. The damage was on the passenger side. When my insurance company looked at it there were 47 dents on the driver's side. That car and never been in an accident before this one. It was wheel damage but my passenger door clearly had someone take a crowbar to it. It was such a scam.

Don't go to real court then. I've seen judges rip people a new one for not directly answering the question they ask. A trial isn't a conversation. It's an interrogation. Don't say what YOU want to say. Answer the specific questions asked directly without hemming and hawing.
If you've seen the after show with her husband, this is her nature. She cuts him off halfway through his sentence every single time.

As a GEICO customer who's had an accident that they paid for, I can say that they won't pay for after market parts. I have an older Jeep Wrangler that was rear-ended, then broadsided by another vehicle. That day, over 200 accidents happened in a few hours after a freak daytime snow storm. My Jeep was in the repair shop for 6 weeks because they had to wait for the Jeep parts to ship during the holiday season. Ugh!
Those after market parts are the problem, which is now *his* problem. And GEICO won't pay if they're faulty. I wish her good luck.

Not sure what is so difficult. If insurance isn't paying, then the owner of the car needs to pay. The shop was shady though for basically charging insurance for OEM parts but using NAGS parts. That's fraud. (I've been in insurance for 20 years)
That's not fraud. I'm an insurance adjuster. People do it everyday. You can definitely get your car fixed cheaper than what insurance company says the repairs are worth.

If she were on a month to month plan I understand suspending it. However, most companies allow you to also pay 6 months at a time or a year at a time. You can't just suspend that 6 month to a year payment.
Would she then be able to collect that insurance if she was out for one whole month unable to suspend because she was smart and paid ahead of time?
100% agree. Another reason as to why she couldn't suspend her insurance is that some states will actually suspend your car's registration and prevent you from re-registering the car if you have a registered car that doesn't carry insurance.

He & his employees were being shady AF. She probably told her insurance what he said, the adjuster didn't accept his inflated estimate so he was out. Then they tried to bully the money out of her. As an afro-latina myself, there isn't enough bullying that's going to make me come out of pocket when I'm not supposed to, much less a signed contract stating such. And I dare you not to fix my stuff right. 🤨
The adjuster can only write up what he can see the shop then takes the car apart and the body tech writes a supplement the adjuster will then go over the supplement with the body tech once the adjuster agrees that is a legal binding contract the shop has no right to use after market parts or make any changes. If a tech misses damage it's not a good idea to hit the insurance up for more money as they grade the shops performance and may stop sending the shop work. Also the tech if he misses damage can lose his job.
Hopefully he didn't do something to the car before having to return it since he's lost the case... That evil smirk and laugh at the end from him don't sit right with me.... It's giving both are sneaky
