  • The plaintiff brought his car into the defendant’s shop for a muffler repair. When the mechanic lowered the lift, the plaintiff says the car crashed into a welding tank, damaging the fender, so the plaintiff is suing. The defendant insists the plaintiff was the one who placed the car on the lift and lowered it himself, and the plaintiff is just a “money-hungry ingrate.”

    I feel bad for the witness. It was very clear the way he was hesitant, that he did not want to get caught lying to Judge Milian, but also did not want to get fired like the other mechanic.....

      I am sure any judge in any real court sittings would've reacted the same way. How can you provide justice when there's no order. You are entitled to your views on this matter. Sorry, we don't agree.

    So the plaintiff starts off by boasting about himself and denigrating the defendant, all before presenting a stitch of evidence. Let's see what he has to show, rather than tell. ---- An estimate. No picture.
    Later: These two guys together give auto shops a bad name.
    And I'm dead certain this plaintiff is a misogynist. He talks over and talks down to the Judge. He insists the Blue Book value is $2,500 and tries to bulldoze her into believing it.

    Both the plaintiff and defendant are liars. The plaintiff spewing out all of his credentials in the beginning, who gives a crap about that. It isn't relevant to the case. The only one I had sympathy for the was defendants witness.

    JM sure likes to point out to the guy defendants or plaintiffs that their phone's camera is not only for taking "nasty pictures." LOL.
    There's something odd about the worker mechanic's testimony. I don't think I can chalk his hesitation to answer JM's questions as simply nervousness or not having the command of the English language. He seems like has to think very carefully about what comes out of his mouth.

    Homeboy walked in as if he was on a modeling runway. He's dressed for the television audience. His open line was full of garbage. No photographs and I do believe he did operate the lift because it was something that he was allowed to do all the time. Who would allow someone to come in and operate their machinery without knowing that they knew what they were doing or how to operate it?

      No, I don't think so. It doesn't make sense. Also, it's clear the defendant's employee was lying (as otdered by his boss) and wasn't comfortable about it. The defendant couldn't even get clear the details around him supposedly raising the lift, which also points to him lying. Although, it doesn't matter for the case either way. The defendant was negligent, and therefore liable, either way.

    I used to work for a small printing company and there was another small printing company next door. We had a large Polar Paper Guillotine that could cut upto 92mm wide paper, other company had a guillotine that was much smaller. They often brought stuff into us to cut which I often cut for them, but there were a few occassions when they did it themselves. I think the Judge will find that a lot of companies do this sort of thing and I believe that happened in this case, but even if that did happen, the defendant would still be responsible.

      Yeah, at my job we occasionally let other people who are around often enough help out with little things we know they can do because it saves time, but at the end of it if something goes wrong it’s my responsibility because it was technically my job. If the defendant let a customer do something at the customer does it wrong, that’s still on the defendant for allowing it in the first place.

      @@ashb7846 Of course you will be responsible for any accidents, but at the same time you expect the other person to responsible as well, responsible to operate it in the correct fashion and not trying to bypass the safety features. In a previous job had the same guillotine, it was 92cm/36inch wide not mm like I put in first comment. We had a guy who just did the basic general duties, I was told to teach him to cut his own paper, I refused because he was uneasy using it. Also had people coming and using it because someone else told them they could, they only needed to be caught once by me and they never did it again.
      I might need to explain, the guillotine I am talking about is an industrial machine, capable of doing some very serious damage to your hands. Safety features are 2 buttons need to be pressed together that are about 2 feet apart and either a guard that comes down or light beams crossing the table which automatically stop the blade if broken.

    The witness was most definitely told to lie by the defendant. The defendant is hilarious, from his first sentence of testimony and kept saying that's what I'm talking abt lol man be quiet 😂...fair judgement. JM ran up out of her own courtroom lol

    The defendant is a knucklehead if he allows customers to operate any equipment in his shop. It doesn't matter if the customer happens to be a certified mechanic, if the non-employee (customer) is injured no workers' compensation coverage and the defendant opens himself up to a major lawsuit.

He kept saying, he's a mechanic, he's a mechanic, in court and again to Doug. That doesn't mean he's automatically allowed in the shop just because he's a mechanic. This was the strangest case.
