Shah was arrested because there was a case of killing in judicial custody . Also you can check there was much stronger evidence against him which was presented by CBI in that case.

Law states, "innocent until proven guilty". ED needs to present evidence and make a charge sheet against Kejriwal. This case is going on since past 18 months. Why is ED not making a charge sheet. These are just political games. Modi & BJP is rattled by the stronghold of AAP in Delhi. The game is to topple the governments in opposition states whichever way possible.

Justice Lokur objectively examines every aspect of how legislation should be applied, avoiding unjust application or as a weapon against Kejriwal to his detriment. The scope of the Enforcement Directorate's suspicions and presumptions, lacking supporting reasons, is void. Kejriwal is lawfully entitled to defend himself against these suspicions. The notion of constitutional morality regarding resignation is not binding, especially given the flawed enforcement of legislation against the defendant. People are being incarcerated for long periods without framing chargesheets and trials. Such detentions are illegal and courts must come down heavily on high handedness if any. Kejriwal being the accused , his interrogation pending, recording of statement and confrontation with other accused, and unearthing the electronic evidence - all this has to happen.
If he has responded to summons , went for questioning in the first place and co operated in the investigation, all these things wouldn't have happened.
If he has given correct information regarding the crime, when the first summons were issued, by now chargesheet could have been filed and case trial would have started.
This is the making of Kejriwal himself, as he wanted to become Martyr and pull down others with him.

Technically, Much like in US constitution, The Indian Constitution also gives an accused person The Right to remain Silent. So ED can't force Kejri to make confession. It is ED's job to investigate and bring evidence.
In unrelated matters, any competent advocate or judge can straightforwardly state that the file is not within their jurisdiction. There's no necessity to speculate or provide hypothetical statements to the media. In connected cases, advocates or judges should express themselves appropriately within the courtroom. Democracy shouldn't be misused to undermine institutions for the sake of garnering attention.

Technically, This law was created to deal with drug Cartels. That's exactly why it's provisions are stringent.
In an interrogation the accused have the right to be silent generally but not under the PMLA act. Under this act one's silence itself may prove to be perilous. It's like auto-immune disease, where in one's immunity itself aggravates one's problem.
Secondly, these are hardcore politicians with a lot of legal help and so cannot play a victim card. They should be able to not only counter the arguments put forward by the enforcement directorate but also may turn the tables, if they are genuine.
So a sympathy shown to an ordinary citizen cannot be extended automatically to a political leader.
The case has come up in so many so many judicial forums, India Today is not satisfied with so much adjudication and brings tha matter before Likud who is not so much a juda as a a political leader working for opposition
