    Great candid advice. Some lawyers upload these videos and they're doing nothing or advising about nothing but just trying to get your business. On the other hand your advice is very candid and very good. I would always hire a very straight forward attorney.

    This is good advise I have no clue why people r advocating u speak with the police during an investigation after all they r investigating for a reason and there is no reason to help them make their case ... If u haven't had a sip of alcohol I would still refuse the field sobriety because the tests r difficult to perform and it can not clear u of wrongdoing only hurt u ! U r forced to take a breath test but not the in the field test and no reason to get it over with your levels lower over time may as well wait as long as u can !

    Good video, good advice. But if you have consumed alcohol responsibly, and are very likely under BAC .008% and you think you are not impaired whatsoever and can pass the tests, you may want to consider doing the roadside tests, or else pay hefty fines and impound fees. All the lawyers I've talked to say if choose to not do the ROADSIDE tests, you will be taken downtown almost 100% of the time even if you had just 1 drink. one things for sure, never admit alcohol consumption no matter what.

    Saying "nothing". Not quite. If you choose to remain silent, you must state that you are doing so to exercise your Constitutional right. Just remaining silent is not an affirmative declaration. Yes, it's another 5:4 Supreme Ct. decision. When taken in for blood/urine/breath test, always state that you are happy to submit but want your attorney present for testing and any questioning AT ALL. All questioning must then cease until your attorney is present. Things like labeling of samples, chain of custody and calibration of equipment are important.

    Driving can be dangerous without drinking.....1 your dealing With people who do drink and drive, 2 people who are busy on their phones, 3 people doing everything but driving. If someone hits you that's not drinking and you are drinking...it's your fault, not theirs. It's just not worth it. Don't drink and drive. Simple truths

    When I got pulled over in Ohio the state trooper told me I could refuse to take the breathalyzer back at the station but if I did they would automatically suspend my license for one year for refusing it. Same thing about stepping out of the car and walking the line and doing those tests he said I couldn't refuse or he would arrest me for refusal. So if this is not true what do you do when a cop lies to you?

    I used everything in DUI arrests. 1. Driving behavior 2. When I approach the car I smell alcohol, you fumble too much getting your license, or you hand me your Visa card. 3. When I ask you to step out did you have balance trouble, stumble, or stagger. This is before I've asked you to take a field test.

    Prevention is your best defence..many people aren't initially pulled for their driving but issues like a light being out..always check your bulbs daily...if pulled be quiet and show the officer respect...but be warned..I received a DUI conviction on two beers..the system is rigged against you...so my advise is don't drive with any alcohol in your system.

    @greggh Its not for fear of hurting the feelings. Its to make sure you get the benefit of the doubt in court. Your cooperation will help your case. Being belligerent , too direct or too "matter of fact" will give the officer fuel and reason to interpret your actions as being disruptive or interfering with the officers which will surely NOT work in your favor. You do not want the officer to think that you are uncooperative or rude. NOW, if you dont care any of this, feel free to assert your way

    Yeah, I'm with you, it's just more of a practical matter though, I think. Shit gets sour real fast if you seem to be "resisting" or "refusing" to obey their orders.

    You get pulled over for a DUI--what do you do?
    You say "No, I haven't been drinking". Then if they ask, you take the walking test, blow into the machine, whatever. You weren't drunk driving, RIGHT? So there's no problem.
    I never understand this stuff. Is this supposed to be for people who were "lightly drinking" before driving? God, just don't drink before driving.

    But one situation you did not address. When you mentioned about if you do not blow ( PAS) or submit to any sobriety tests you will lose your license for a year but is it better to refuse to take the blood test rather than taking it , you said it was a requirement. Does the authorities manipulate your arm or wherever they draw blood even to the point of aggressive control and restraint to get it.

    Yeah good point. I opted for the easy way, even if it allowed the cop to give a test. I never drink so it was hard not to pass. I was only out about 5 minutes of my time. None of this towing charges, blood test, license suspension, etc. The big plus is I saved alot in attorney fees!

      you don't that's why dui laws are oppressive.its only misdermenor or felony that requires you to give up your constitutional rights and still be punished,by multiple government organizations and seceral private effects like insurance and loosing your job and can effect your credit.

      Absolutely !!!!! Nothing without a Warrant, They’ll say things that are scare tactics, your license will be suspended etc. Don’t answer questions, blow or walk for them.

      @@gngraves Refuse all tests that do not have a warrant. There’s a 6 month license suspension for refusing, but you can still drive to work etc

    Remaining silent before an arrest can be mentioned in trial, it is only post arrest and before your miranda rights have been that anything said cant be used in court. After the arrest, is really the only time remaining silent is affective.

    Don't rely on the claim of the lawyer that they are competent in handling DUI cases. As lawyers they can always make that claim because they have studied the laws that apply to your case.

      Tribute Guy I think in many states if you refuse the breathalyzer then that would be a misdemeanor charge in itself, so you'd face that plus the DUI that they would still charge you with.

      Anyone can decline the physical sobriety test. Not required. The BAC IS.

    Ok, we can keep the conversation literal if it works better for you. No, I didn't watch this in case I got pulled over while diving. I did watch it in case I get pulled over while driving. I commented because you seemed to be oblivious to the fact that not everyone who gets pulled over for drunk driving is driving drunk.

    It's interesting to see these attorneys go on about the substantial penalties of DUI then you go watch a bunch of videos about DUI cases in court to find out the defendant had 4 or 6 or 8 prior DUI convictions. Sounds like the penalties aren't quite as bad as we are led to believe by these attorneys given the number of repeat offenders.

An arrest will come down to the reason for the stop, how intoxicated you appear, you'll be observed when you exit the vehicle, the way you talk, your eyes, if you fumble through your license, etc. (ex., handing your visa card to them instead of your license) Good police officers do not need field sobriety tests to make an arrest. If they have probable cause to believe that your under the influence based on everything else they observed, you can and probably will be arrested.

    There are many factors involved when someone is stopped by the police. It's always better to speak with an attorney and not to the police any more than is necessary.

    This DUI THING IS VERY SHADY BECAUSE IT DOESNT NECESSARILY MEAN DRINKING, IF THE MEDICATION YOU ARE PRESCRIBED BY YOUR DOCTOR HAS A WARNING ON THE BOTTLE THAT SAYS YOU SHOULDNT OPERATE MACHINERY OR MAY CAUSE DROWSINESS THAT CAN BE USED AGAINST U AS (UNDER THE INFLUNCE) SO U CAN BE CHARGED WITH DUI (DRIVING UNDER THE INFLUENCE). OMG I WAS CHARGED WITH A DUI I WAS PARKED AT A CONVENIENCE STORE WITH KEYS OUT OF IGNIGTION. AND OUR LOCAL POLICE CAME UPON ME 2 DEEP ON WHEN HE SAID THE REASON HE STOPPED ME WAS BECAUSE SOMEONE HAD CALLED MY PLATES IN AND SAID I WAS DRIVING RECKLESSLY ON THE HWY TO MY DESTINATION WHICH WAS A TOTAL LIE. FIRST OF ALL HE DIDNT PULL ME OVER I WAS PARKED IT WAS A WEEKEND NIGHT AROUND 1030PM. SO WHEN ASKED IF I HAD BEEN DRINKING I SAID NO AND THEN I WAS ASKED TO DO I FIELD SOBRIETY TEST OF WHICH I PASSED BUT BECAUSE I TOLD THEM OF MY PRESCRIBED MEDS I HAD TO BE TAKEN TO THE JAIL SO THAT I COULD BLOW IN THEIR MACHINE SO THEU COULD BE SATISFIED. SO THEY PUT ME IN BACK SEAT OF THE PARISH SHERIFF'S UNIT WHICH HE WAS CALLED TO PERFORM THE FIELD SOBRIETY TEST, SO NOW THEIR ARE 3 OFFICERS EYEBALLING ME. ONCE AT THE JAIL THEY MADE ME GET BOOTY HOLE NAKED SO THAT THEIR SHE-MAN DEPUTY COULD GET HER ROCKS OFF. IT WAS MY TIME OF THE MONTH AND WHEN I INFORMED THEM OF THAT SHE ASSURED ME THEY WOULD GIVE ME A REPLACE FOR THE TAMPON I HAD TO REMOVE WHICH THEY DID NOT. IT WAS VERY HUMILIATING AT THIS POINT. THE POINT IS REMAIN SILENT !!!!!! REMAIN SILENT!!!! SO A FEW THOUSAND DOLLARS LATER CHARGES WERE DROPPED CAUSE THE ARRESTING OFFIERS WERE A NO SHOW!!! GO FIGURE!! BUT I WASNT REIMBURSE FOR THE ATTORNEY I HAD TO HIRE!!

      Not that simple though. A lot of people take the take the FTS are completely sober and officers still fail them. Don't take an FTS ever, take a blood test though.

    This may be redundant, but fewer words are always better. They are also looking for slurred speech and the smell of alcohol on your breath. Just say "no thank you" and that's it. Say no more.

IF YOU BEEN DRINKING CALL A CAB OR HAVE A FRIEND DRIVE YOU HOME (drinking or not its their prob if they get pulled over)as long as they can get you home safely that is

The last thing any officer wants to do is let someone who is drunk or suspected of being drunk drive away... only to allow that driver to get into an accident and possibly kill someone! The officer, himself, may get into serious trouble for allowing that driver to drive away by losing his job, or being disciplined by his department, or even being sued by the driver or victims of the accident that he should have prevented. Officers have to be maintain the safety of the drivers.

    @glennus626 Where there is no victim there is not crime. Few attorneys will defend your rights on constitutional grounds and inform you that there exist these two basic legal systems operating side by side; they are the constitutional common law and U.C.C. governed contract law. Most of the time you are being prosecuted under contract law. Knowing and understanding the difference is critical to knowing how the government has become the worst of all criminal corporate enterprises.
