    This video is over 10 years old and checkpoints still exist. Refusing to answer that question puts the cop on notice you're hiding something.

Are you familiar with these amendments, or would you like me to advise you? If you wish to arrest me for invoking my 4th, and 5th amendment, I will not resist you. (I did not ask the cop would you like me to advise you on these amendments) The Jury felt, I should have asked the cop this question about: (would you like me to advise you on these amendments?) I still did pretty well!

    I disagree with your advice to verbally respond with an apology. Talking is the last thing you want to do what kind of lawyer are you? Of you are under the influence. Talking is the last thing you want to engaged in. A very simple response. Am I free to go or am I being detained. If being detained then politely tell the hero you are not answering any questions and you dont consent to the detainment. No roadside sobriety check. If arrested no breathalyzer, draw blood.

    I've arrested thousands of DUIs. Whatever your song and dance you're screwed. Checkpoints have gone through the court system. You're screwed. Taking the 5th with booze on your breath doesn't work. You'll do the tests or your refusal will result in a ride downtown. Did I say you're screwed?

    But one situation you did not address. When you mentioned about if you do not blow ( PAS) or submit to any sobriety tests you will lose your license for a year but is it better to refuse to take the blood test rather than taking it , you said it was a requirement. Does the authorities manipulate your arm or wherever they draw blood even to the point of aggressive control and restraint to get it.

    First of all, the fact there's a checkpoint; this is already a violation of The Constitution. Nevermind The 4th or 5th Amendments. The fact there's a checkpoint, is a VIOLATION already ! You have The Right to travel freely on State and City highways and streets without being molested by government officials, unless you've committed a crime. I learned a different story from a different attorney. I agree with some of your video. While I disagree with other parts.

    It's interesting to see these attorneys go on about the substantial penalties of DUI then you go watch a bunch of videos about DUI cases in court to find out the defendant had 4 or 6 or 8 prior DUI convictions. Sounds like the penalties aren't quite as bad as we are led to believe by these attorneys given the number of repeat offenders.

    Not all justices agreed with the ruling; DUI checkpoints are direct violations of the constitution! So when it comes to a DUI checkpoint, I am not nice! Why? Fuck them!

    I went thru a dui checkpoint in Gardena, CA. Flashed my license and asked the officer if I was free to go. And off I go. I could have refused and crack my window half an inch but I wanted to go home and was not drinking................................

      It depends on the circumstances. Deception is an important tool in questioning. But for cases like this, or for a small amount of drugs, yeah it's bogus.

      @@jonathanwpressman lying during interrogations is proven to lead to false confessions. I can understand law enforcement lying to someone about how their loved one died in a car crash, to tell them relatives they died quickly instead of slow and painfully in a heap of burning metal, but during an interrogation for the purposes of establishing guilt it should never be allowed.

    Good advice. Thankfully I don’t drink and drive so I should not need it, but I could be accused as there are checkpoints in my state as well and we all know it is a revenue game!

    DUI checkpoints, like all illegal, and unconstitutional police actions can only be fought with high-powered, highly paid attorneys. Refuse to cooperate with these thugs. NEVER, EVER ANSWER ANY POLICE QUESTIONS! Ivan Morse is a fraud if he tells you to speak to police, or answer their questions.

    First off this is 12 years old so I doubt if this attorney is still active in practice. Secondly his advice is far from being sufficient. In California you never have to take a field sobriety test. There is never any legal consequences to refusing to take that test. It is never legally required before or after an arrest. And while the implied consent does require you to submit to a breath or blood test, it does not require you to do so until AFTER you have been arrested. They cannot force those tests prior to actually arresting you. And rather than explaining how nice the officer is, how much you respect him, and that your attorney has advised you, the best thing to do for all of their questions is a very simple “I don’t answer questions”.

    I would never hire this atty! He should have stated that if you refuse to take a blood or breath test then yes they will take your Driver's license for a year, however since they have NO EVIDENCE to convict you it won't go on your driving record and won't cost you 10s of thousands of dollars!!!

    It's Better to AGREE to answer questions and discuss my day and comply with orders like all windows down.. but my pesky attorney Indicated the courts demand I remain quiet. And implied consent only works for that states DL holders. If the cops reason for exiting the vehicle is stated as for officer safety (aka cowardice). You have to get out.. for field sobriety,. I would LOVE to, but my attorney has stated this is equivalent to assisting an arrest and testifying against oneself..

    Bad advice. Do NOT give a long sentence in your reply. That alone can lead to reasonable suspicion by saying that you slurred your speech or they smelled alcohol. Just shake your head no.

    This info is somewhat obsolete. The Supreme Court has held that a blood test is too intrusive and requires a warrant.

    When I got pulled over in Ohio the state trooper told me I could refuse to take the breathalyzer back at the station but if I did they would automatically suspend my license for one year for refusing it. Same thing about stepping out of the car and walking the line and doing those tests he said I couldn't refuse or he would arrest me for refusal. So if this is not true what do you do when a cop lies to you?

    How is it that being forced to take any test is not a violation of your 5th amendment rights, you are basically allowing your body to give the answer that will incriminate you without a lawyer present to represent you in a legal preceding .

    I'm at an age now to where I have not had a drink outside of my home or a relatives home where I was spending the night in 15 years. With the invention of large flat screen HD TV's, surround sound, and the comfort and amenities of my home - I find it more safe, relaxing, and rewarding to drink at home without the anxieties of getting a DUI, or putting myself, or others in danger...I would advise someone if they did not drink that night or can honestly say they had a very little amount of drink to just say no and not be evasive or suspicious by remaining silent, or saying I plead the fifth. Suspicion leads to officers becoming more heightened in their vibes and whether true or false the longer an officer is in your presence the more chance something can go wrong. Just say no, show your license, and be on your way, and stop trying to be Perry Mason.

    It's not TECHNICALLY a violation or per se violation. The term is FLAGRANT violation NO WHERE in the Constitution is there a provision for CARVE OUTS. The constitution has a specific process spelled out to ammend it. 5 out of 9 pedophiles sitting on a bench don't have the right or power to amend it. The Constitution was written to LIMIT the power of the government and PROTECT the rights of the people. Not the exact opposite of that. IF SCOTUS can unilaterally declare carve outs FOR THE INTERESTS OF THE GOVERNMENT then the Constitution is worth less than toilet paper.
