First of all thank you for the information and second of all I'm in a delimma and that is that my Attorney says that I should file chapter 13 to keep the Federal Student Loans away for the duration of the time filed and that chapter 7 will not help with the garnishments that the student loans has been torturing me with for the past 7 months. I was helped by family to pay for the Attorney fees but now everyone is telling me to do Chapter 7 to start out with a clean slate creditwise. I need advice here please, thank you.
HI @Susan and glad you sought counsel but it seems that you are unclear on your direction. Please write all your concerns out and schedule a meeting with your attorney to get them all addressed. Meanwhile look for a new video to address some of your issues here.
I was wondering if I were to file chapter 7 and the only positions I have that are legally mine, that I am on paper the owner/ sole owner of is my vehicle, an old T.V, my clothes and my dresser, would that all be considered exempt or non exempt property? I dont much care if my T.V is used as nonexempt (the bank could pawn it for the $50ish theyd get out of it if they want to go for it) but I use my vehicle to go to work and my clothes; well, I use those daily like most people.

Hi @Cherry2k3 garnishment is an execution means to collect a judgment- can only be done if there is a judgment. Bankruptcy stops all collection activity until the discharge and then after the discharge those creditors cannot bother you again. your attorney will help guide you through the means test- and probably attempt first to negotiate settlements with your creditors before putting you in a bankruptcy. Hi @Suns No one can make you get a job. You must qualify for a chapter 7 under the new rules- check out our video on the difference between chapter 7 and 13. If your situation requires that you file a chapter 13 then a portion of some of the debt has to be paid. If you qualify for a chapter 7 then the unsecured debt is entirely discharged. Your social security is protected, cannot be garnished. I do not know about the annuity. There is an organization called HELPS. They specialize in helping seniors with debt. www.helpsishere.org/
I want to hand over my attorney the names and addresses of all my creditors. Most are JDBs and have PO BOX addresses only. Is an address listed on the notice, even if it's a PO BOX, okay to contact the JDBs? 1 Also, original creditors often have numerous addresses. How will the attorney know which one to use? Thanks.
Hi @Mary - some creditors have established addresses that are used when they are listed in a bankruptcy and for others your attorney will know which address to use - don't worry about that. A PO box will work for mailed notices. If a debt has gone to collection then that company will also be listed as well as any attorneys if they have become involved. Good luck!

Hi Al - you are allowed to represent yourself- it is called filing 'pro se' (pronounced Pro Say) but that may not get you the protection you need. Each bankruptcy court has the documents on their website for you to complete with instructions. Depending upon where you live there are attorneys who do the chapter 7 on a flat fee- if you can hold on and save the money to have them represent you that is the best course of action- Please consider it and seek one out that you can make payments to them until the filing fee and their fee have been paid. That protects the money you are gathering from being taken by creditors. Whichever way you go - best of luck to you!

Hi @Allen sorry for your troubles. If your financial situation is manageable then you can work out your debt payments. If you feel underwater then you should seek legal counsel in your area and give them all of your information.

Does filing chapter 7 stop wage garnishments? I'm getting 2 wage garnishments and child support takin out 800 dollar check is 380:(
Hi @Wayne yes the automatic stay becomes effective when the bankruptcy petition is filed. It stops everything.

Mary, I got GOOD help with bankruptcy. We need to talk. I also got help with my student loan. Nobody helps with that.
