    I have always been baffled by a "restraining order." Yeah, the threat of a low-level misdemeanor is going to keep someone from committing first degree murder? Makes my head hurt.

      A restraining order just gives police the right to tell the person to leave if they show up, whereas without one, they are powerless, especially if the person lives there or just stands on public property outside the premises. It depends on the police getting there in time, of course, but that is where most of its power lies. Otherwise, the offender could stand on the road outside the home or visit the other person’s workplace and there’s not much the police could do.

    People always say… “Why didn’t they just leave?”Most women who are killed by their partners, are murdered AFTER they leave, or after they take steps to leave.

      Stockholm Syndrome. Psychological abuse, controlling and physical power over another. I hope you're not making a case for women to stay as though they will get murdered if they leave, even though that happens too. I don't think that's statistically true. More often occurs in the home. Thus the phrase "Domestic Abuse" was coined for violence in the home. Most times it's not premeditated. The guy just snaps. So restraining orders do not prevent. Stalking and murder after leaving is real though and why many are afraid to leave. Good gosh, just watch "Sleeping with the Enemy" (Julia Roberts)

      What happened to this woman is terrible, period. I don’t think there is enough data to extrapolate this case to the broader issue of what gender gets custody in a marriage that unfortunately fails. A woman in Florida (allegedly) assassinated her ex husband, so she could get custody and her brother is now serving life-that doesn’t tell us anything about women in failed marriages as a whole. This man was a manipulative murderer. This woman, despite it all, cared enough for *him and her children* to get the restraining order. May she RIP 😞

    I didn't tell my ex I was divorcing him. It was daily life as usual. I knew where he hid his guns and I took them to the Police Station on the day I left. I told the cops I was divorcing my husband. They took the guns and told me I was saving a life. In addition, I prayed a lot. In fact every time he would leave the house I would fall on my knees and pray to God for direction. I had saved up my money and got my own apartment fully furnished. The day I made my move I went to our son's school and picked him up early. I was long gone and he was served with divorce papers. He didn't even see it coming. I give all the glory to God for giving me guidance and direction to get out! Domestic violence is no joke. Don't ever tell a man you are leaving him. Make a plan of escape and stick to it. Even if you have to move to another State. Prayers to this young woman's family. And praying for women and some men who are caught up in domestic violence right now.

      Mary men will now have to learn the hard way that's why we're living in a time right now where men think they own their woman and that the old saying goes if I can't have you no one else will also this might explain the reason why men don't want to go get counseling suffice it to say like if it doesn't work and I assume whatever insurance you have doesn't cover it, also men don't want to talk about their problems they feel like it's going to make them more angry. Also to add one more thing it seems like the breakup and divorce leaves men broken.

    This is exactly what happened when I went through a divorce. I filed for divorce due to domestic violence. My attorney had to push hard for a restraining order and even still the judge granted him visitation. He became violent towards the children because I never took them to visitation. I had a 3rd party show up with the kids. He would ask where I was and why I didn’t bring them. He eventually figured I wasn’t going to show up and stopped seeing the kids. I was one of the lucky ones.

    For the attorney to say he never saw this coming is ridiculous. This is usually the way these spousal abuse cases go. The minute she filed the restraining order she was doomed. Restraining orders do not work, men who are controlling and abusive don’t care about a piece of paper. This is heart breaking for her family and friends.

      @@azicepricess if things are at that point, women need to take it seriously and take matters into their own hands as if their life depended on it. and it does. we don't think it'll go that far but unfortunately women are murdered by their parents all the time. her husband probably showed signs of abusive and control long before he killed her. police can only do so much. that poor baby girl.

Lord Jesus, PLEASE protect this girl. I can't imagine what awaits her now. She must feel like she's lost everything. This is just too, awful for words

    That guy is a monster. That poor baby. It just breaks my heart. These men use visitation with their children as an opportunity to punish their partners for daring to leave. He obviously doesn’t care about his child if he could do this heinous act in front of her. Abusers should never be granted unsupervised visitation.

      A woman in a relationship isn't always perfect/sane/angel that does no wrong, but often they're treated like so by the society,legal system and the media. And to do it in front of a child. These men do not just snap. He’s been abusing her which is why she filed for the restraining order. Threatening suicide is a form of abuse and really common tactic if you know anything about domestic violence. Even when the woman is literally murdered, people somehow find a reason to blame them for getting killed. This type of misconception perpetuates abuse.

    That despicable lawyer and useless judge should both resign in shame. They both just assisted in getting a woman killed in front of her child. Let this be an unfortunate lesson for every other lawyer and judge out there handling custody cases as it relates to domestic violence. Goodness this is so upsetting!!     He "Never" thought it would happen?!!! How? Unfortunately, this is textbook behavior for domestic violence! So many victims seek help and protection and they are constantly being failed. PLEASE arrange for her daughter to receive psychological therapy! Otherwise she will experience and develop mental health issues (PTSD, paranoia, IED, bi-polar, chronic depression, self-mutalation, etc) or become suicidal.

    Stop telling abused women to get restraining orders. Courts often force this as a first step. It can and often does escalate abuse and gives a false sense of security. All it does it make a woman feel safer when in actuality she is not. That child is forever traumatized and now is an orphan because our system failed her and her mother.

      I think a lot of lawyers and even counselors are ignorant of narcissistic personality disorder. Our counselor and my ex-inlaws (probably also narcs) always pointed the finger to me, and I gladly sought to correct myself. My ex had everyone fooled, even the counselor whom I really trusted.

    That lawyer saying he never saw this coming annoyed my spirit. This is why I quit family law. The many times I would tell male lawyers about their male clients' threats against my clients AND ME just to be ignored or told I was being dramatic are too numerous to count.
    Instead of identifying the most amicable solution, they often fuel the flames of discord amongst the parties for more money. Threats of killing oneself over a break-up should not be taken lightly.
    Maybe if they stopped dismissing obvious signs of instability and violent behavior, they'd be able to intervene. I don't know. But saying you never saw this coming should be a wake-up call to the type of behavior you ignore or dismiss.

      My lawyer said she had lost a previous client to an abusive ex husband. That being said, the judge still did not take us seriously.
      A woman in the DV support group I joined was killed.
      My ex was not recommended to have unsupervised visits with the kids after a court ordered psych exam and the judge gave him it anyways (despite him being homeless).
      I used to think the horror stories were the exception. I think …. Sometimes it works out. My kids and I are still here…. So that’s good. But, we need some huge reform.
      I’m so sorry for this little girl, mother and family. That man most certainly did need the help she wanted him to get.

      @francinesanchez5402 you are absolutely correct that reform is needed. I often say family law is the most vile, insidious practice I've ever witnessed. The amount of manipulation, plotting, and entrapment that occurs is astronomical. Attorneys even do it to each other. It gets very nasty.
      I once had to represent a client (my boss didn't want to deal with him but still wanted the money) who was bold enough to threaten his estranged wife IN COURT during the hearing. There was no controlling him, but the judge yelled at me from the bench to get control of my client. It was crazy. When I told him to stop the threats and behave appropriately, he threatened me! And then the judge threatened to hold ME in contempt of court since I couldn't "control" him. What are the bailiffs there for? I felt like I was in the twilight zone.
      I demanded that my boss either take back over his case or terminate his representation due to his threats. He made a joke that it wasn't much money anyway and terminated representation. So many things wrong with the legal system.

      Not disagreeing with the OP's post, although if we are concerned about Safety and Justice and Truth then let us mean that for ALL individuals. Let's not make this a Male Bad / Women Innocent point. Domestic Violence is a serious issue and women are NOT guilt-free from doling out abuse as well. The most extreme violence is meted out by men, but various forms of abuse are perpetrated by wives upon husbands as well as mothers upon their children.
      To any extent that the legal system has blind spots, sexism, and basically support of injustice towards women AND men, then can't we all here agree that reforms need to occur? ( The "Manosphere" has legitimate gripes over injustices they experienced after divorce, for example, regarding favoritism towards their ex-wives. Don't mock their pain, just as women ought not to be mocked over their pain and traumas experienced in their previous marriages. )

    Quit asking people experiencing domestic abuse and violence to get restraining orders! They should be considered an option, not a requirement to prove you're serious about leaving an abusive relationship! My ex nearly killed me just for filing for divorce! I'm sure he would have if I'd had him served like a "criminal". Calling the police led to accusations of trying to get him fired, among other things. The person inside the relationship knows the abuser best and can usually tell you what support or resources they'd need to get out. Unless you're willing to provide those support services or a full-time body guard, don't tell anyone they "need" or "have to" get a restraining order for protection. That order doesn't do anything to actually protect you.

    I am SO TIRED of hearing of men killing their current or former partners. This just happened to my friends sister in my city. She left him because of abuse, met a few days before Christmas to discuss what to do with the 3 kids they have for the holidays, he kidnapped her and was missing for days until he was arrested 4 states away. She is most likely dead and he won't tell where her body is. Kids have no one on Christmas. I barely survived leaving my relationship, i was stalked for years. Why do these men feel like they own women and children?? Why not just separate and be normal? This is literally an epidemic and nothing is ever done but protective orders which do NOTHING to help!!

      The thing to do to avoid these kinds of scenarios is to be cooperative, a quality that many women severely lack in the West. If you want the best outcome for the kids, its best to be cooperative as parents and not be uncooperative which may lead to unnecessary violence. Everything happens for a reason and in this case, she did something to that man (which we don’t know) that triggered this event. Also, the police are not supposed to be your Heros wearing capes.

      Parental rights trump children’s right. Men’s rights group have been advocating for 50/50 custody and most courts will move towards that even if the man had a history of abusing the mother. How many more will it take for the penny to drop? And if we’re talking about “majority of the time” it is also these same men that move on to abusing or abandoning their children when they don’t have access to the mother. The story earlier this year of the man that killed his baby daughter on camera to punish the mother is proof that you’re talking nonsense.
      Child support is an obligation for participating in bringing a child into the world one is not actively taking care of full time. That does NOT grant access privileges. It’s so the state doesn’t have to pay for someone else’s obligations.

    We have seen this same tragedy far too many times. My suggestion: If you arrive at the conclusion that a restraining order is needed, take the next important step immediately and begin making plans to fully protect yourself and children against possible scenarios where you could be harmed by the other person. Take precautions even though these may be costly and/or inconvenient, at least on a temporary basis. This provides the time necessary to observe the behavior of the person who is the threat to determine the level of risk of an attack. Filing a Restraining Order can be a 'trigger', and this must be fully considered. As the song says, "There must be 50 ways to leave your lover". Choose wisely.

      Restraining orders only apply from a legal standpoint if the person being retrained steps over it. Its useless until then because it doesn't do anything. Also as the saying goes "the more fool proof you make it, the smarter the fool becomes". I dont think you're wrong at all, I do think its something to consider if you are getting a restraining order but also if you plan to get one. Talk with a lawyer and make sure you really understand what it does and when it applies. At the same time as you see in the story, it didn't take very long for that line to be stepped over. So even if you had preparations, they may do nothing. It is still important to choose who you date and marry because so often people do say "well there was no signs", that can be a toss of the coin. Signs could have been there but they were ignored for the first 3 months. People are just so casual about relationships that they dont consider who they date. Many just dont want to be alone and they'll be casual. Then we can consider how they live their lifestyle and that impacts who you attract. Some people are very good actors and I say that as someone who has a former sister in-law who ended up as a complete psycho.

      In Iceland, when a restraining order is granted a monitor is placed on the alleged perpetrator. If he comes within a certain number of feet from the victim’s home or workplace, the cops are notified and the perp is immediately picked up. Because of this law, these types of murders are non existent.

      Women need to stop chasing bad boys. More often than not women get themselves involved with toxic men they know are not good for them but women have no idea how to pick good men these days. This is why I admire other cultures who have the parents take a more active role in picking a husband/wife for their children. American dating culture is toxic.

    A restraining order does squat to keep you safe. It's simply more red tape for the victim to deal with as they attempt to leave their abuser.

Get training in weapons, martial arts, boxing--as much as possible. Also--check out anyone you're dating. U never know what u may find! Hopefully u will never need to use these skills. But--if u DO-- don't hesitate--protect yourself! Worked for me.

Whether If it The consequences of her own actions or What she has been taught all her life By the world and. her mother's and grandmother's to be an independent. Strong Woman who rebellious against her husband and constantly Motionally neglectomore or abuse them. And think that their never be no consequences. For their own actions.
      And marriage completely destroys this delusion that the world has made.. And she does not want to accept That. it's not okay for her to Rebelling Or have any responsibility for her husband.
      Or it's Not okay to hurt or abuse or neglect her husband.
      Especially when the world makes her feel better And more comfortable About her neglect for an abuse. Because hes just a soulless tree that she can take money off of whenever she wants.. But marriage makes her. needs to Be dependence trueful and Faithful cearing and humble and quiet and meek. to her husband. fulfill and help him his needs. As the husband should do the same. Her
      But she has to realize that it's not just about her. It's about him and he has a soul. And it's not just some game where she can take advantage of her husband and not have any consequences from it and can leave whenever she wants.
      marriage breaks the delusion that men are Souless trees that they can just Take money off of whenever they want.
      And leave to rot.
      I'm only talking about women. In general,
      Trust me if this was in reverse, everybody would be sympathizing with her.. Rather than condemning her

I’m sorry but every time this happens, that’s all I can think about, how often stupid men say that she should just leave him and get a restraining order or like that’s not the most dangerous thing to do in the situation. Women in these situations need protection and we as a society need to be better about offering it. And men need to stop making excuses for stupid abusive men, and hold them accountable and protect women.

    I’ve been working in family law for decades and I will never understand this need for ultimate control some people have. This man gave absolutely no thought to what this would do to his child. I feel so bad for this little girl. I hope her family gets her into therapy. 😢

      This has nothing to do with the country. I guarantee he was like this from day one and she ignored the hundreds of red flags until it was too late. Not to mention why would you ever have a child with someone who has all these issues. The lesson is that if you see the red flags at the start you need to run.

    My daughter dated someone in high school whose father committed murder/suicide in front of him and his little sister when they were young. They never got over it and he could never sustain normal relationships. My daughter found out he cheated on her so she broke up with him. I never felt animosity towards him but he needed more therapy than he and his baby sister received. His sister is doing much better. I just wish the mothers would take the children and leave before tragedy occurs. I did with my 3.

      She did leave. Most women are killed when they leave, or shortly thereafter, and visitation is a common way to force contact after she leaves. Glad you were able to get away with your kids, but not everyone does, and it's not their fault. It is the fault of the one who does the murdering, not the one who is murdered.

    I'm telling you, growing up in Hawai'i, a whole lot of Hawaiians get mad jealous and controlling of their significant others. More-so, the men. They freak out and lose it. I'm not saying that all of us are like that but I've seen it TOO MANY times there. It's sad.
