  • In Part 2 of our special Ad Law webinar series on running compliant sweepstakes, contests, giveaways, and other types of competitions, join Venable partners Melissa Landau Steinman and Mark Schamel for a master class on the latest sweepstakes and promotional marketing strategies, and learn about the quirky promotional concepts they’re seeing as the digital marketplace continues to rush ahead, as well as some of the pitfalls and risks associated with enforcement in our current marketplace.
Sweepstakes and prize promotions have evolved considerably since George Washington used a lottery to help finance his Revolutionary Army, though some of the precedent in the area seems like it is nearly that old. Structuring a legally compliant digital promotion in this highly regulated space has become particularly tricky, moreover, given the ever-faster pace at which the technology is developing, and the government’s close scrutiny of issues like dark patterns and disclosures, privacy, and other matters related to promoting prize giveaways. In this program, Melissa and Mark will talk about what’s new in digital sweepstakes, contests, and other types of giveaways, including the latest regulatory and caselaw updates, and provide a framework in which to think about prize promotion concepts.
Some of the emerging issues and topics covered will include:
User-generated content contests and specialized competitions, such as hackathons, film and photo competitions, and other types of skill competitions
Promotions targeting specific audiences, like employees, women, and minorities
    Charitable sweepstakes, raffles, and auctions
    Cryptocurrency and NFT giveaways
Artificial intelligence in sweepstakes and contests
    Global sweepstakes
    Esports gaming contests and sponsorship
    Video gaming and gambling developments
    Liability and criminal exposure
