It is not alleged in stealing when the guy who stole the money confessed under oath that he stole the money.

that is not what he is being charged with, they have to prove beyond a reasonable doubt that Trump acknowledged the payment was made to cover up the payment in order to win the election. Nobody has testified to that, as a matter of fact the payment was made after he was President, the witness stated Trump did not know about the payment, the witness stated that he made the payment to protect Trump's wife, this was backed up by Choens attorney. This needs to be dropped by the Judge.
