    My school always flip-flopped between "students don't have constitutional rights on school property" and "minors don't have rights and the parents' rights don't extend to the kids"

      I've always hated this about the system: if the teacher makes a problem out of it, that's not the kid's fault, it's the teacher's own fault.

      Yeah, it's vague and broad on purpose, because you can't predict future and you can't objectively define what distracting, disruptive or inappropriate is. People need to use their brains more.

    99% of the time the school would claim that it's disruptive anyway. They'd write you up for disrespectful or disruptive behavior if you try to point out the fact that nobody gives a shit if you're wearing a tank top or a t-shirt beneath a hoodie that makes it impossible to see what you're wearing anyway

    It was really annoying when the teacher would stop everything to point out a distraction no one even noticed. After a while, I'd think to myself, "Are we learning about WW2 or playing I spy?" Still so happy I'm out of school.

    I used to wear my mask past the rule of wearing masks in school. I am the most quiet and reserved kid and never ever did anything disruptive. But still my teachers called my parents to school just to get my mask off.
    I now feel even more violated

    Thank you, Mike. I want to become a lawyer because of you. You also saved my life last year, when I was in eighth grade. I felt I was worthless and didn't deserve to live. One day, when I was at my lowest point in life I kept searching up "how to die" on UA-cam. I clicked off because I was tired. But then I came across a UA-cam short from your channel and clicked on it because it looked interesting. I kept watching more of your videos and I thought, "Hm, I don't have to end things now. I can be like Mike and do my best to make something of myself. I will also fight for what's right."

    Sometimes this will have you starting a piece of paper that most kids don't read, but usually that piece of paper tells that you're giving up some of your amendment rights to be there or you would be terminated from that school

      Unfortunately, too bad they can, will and have abused their authority to claim it was distracting to other students. Happened to me a few times. Ruling means jack fucking diddly when everyone will sooner side with the adult than some kid, even less so if you aren't well off or well known(in a good way).

    Ngl this kind of reminded me of how after covid I was the only student who still kept wearing their mask to the point nobody knew how I looked until a year or so later. I still remember vividly asking something to the teacher and she was like “Damn I’m sorry ___, I couldn’t recognize you” 😭😭

      I only wore a mask when it was required by the property owner. That was their right to require for entry into their property.
      They've only really proved effective to reduce spittle. In many cases they're worse than wearing nothing because you're basically wearing a petri dish on your face if you're not changing it out regularly. It was basically just a placebo to keep people from panicking and if you're a conspiracy theorist an experiment to see how much control they can exhibit utilizing fear.

I once got in trouble for being on my phone in class, the funny part, I DIDN'T OWN A CELL PHONE! That teacher probably felt like a damn fool when she got called into the principal's office with me.

      @@lillii9119in the video he refers to the fact that the student couldn’t hear was distracting and how it took time from the lesson as disruptive I’m sure they go hand in hand in someways but in the context of what was said it was only disruptive because the teacher took the time from the class to talk to the student to get him to take it off the teacher made the disruption himself

    Last year, I wore a mask that I made in school, but the teacher told me to take it off, because apparently, "they need to my face so that they know what I'm doing.", which makes no sense.

    The thing is that they use the "distracting or disruptive" to screw over students. Because, if you've been involved in stuff like this, the teachers are the ones making things distracting and disruptive. I did love when this happened in middle school when we had different teachers because I was like "well x, y and z, were perfectly able to teach their class"

      At certain ages of students,it can be very distracting, especially if she's good looking. And they are not about to make rules just for good looking people. ("It's ok,you can wear that,your not that attractive"😂)

      Ironically, many teachers who complain about students wearing disruptive stuff, are the ones who clad themselves like that every day. Yet, if the student confronts them about it (through a principal or directly face to face), the student gets punished instead.

    Mike my school gave out a google forms that was mandatory and had to be turned in and when my parents were doing it they ran into a problem, the google forms would only let you submit it if you agreed to the school’s bathroom policy, the policy gives you a limited amount of bathroom passes and if you run out of them you can’t go to the bathroom, and if you go to the bathroom without using it in one of my classes you could get a tardy, a certain amount of tardiness will give you a lunch detention and eventually a in school suspension, this is a huge problem because my parents don’t agree to the policy due to the fact that kids can’t control if they get constipated, have diarrhea, or are just on their periods, these bathroom passes are supposed to last for the whole school year and you only get ten, going to the bathroom during switching period is not a good idea either since you only get three minutes to get from class to class, my school forced my parents to agree to a policy that they don’t agree with, is that even legal?

      It's not legal. Your parents can sue. Such a policy is dangerous for the safety of students, both for their physical health and mental well-being. It also goes against your constitutional rights. Not even prisoners can be prevented from using the toilet.

    Except that it is literally US history. The degree to which people protested the Vietnam War, and the counter protesters that opposed them, are a very important part of our nation's history that doesn't really get talked about as much as it should. A Supreme Court case that dates back to and stems from the political and civil turmoil of that period is absolutely a valid topic to have in a US History classroom.

      That's true. As a Vietnamese, even though I, personally, love those kids for what they did, agree. Loyalty to your country is important, no matter what. Yes, what the US did (personally for me) is wrong, but I can totally understand why they bought the kids to court.

    What would “disruptive” mean? Like, if I have something that isn’t distracting to me or anyone else in class, but the teacher decides to be disruptive about it, is it still my fault?

      It depends on the school's rules. But if the teacher is reasonably distracted then the school will take the teacher's side.

      ​@@someperson9998 That is the point, the teacher will throw it to the courts, the courts will keep throwing it upwards until each specific case is judged by the SC. It's meant to say that it's legal while, de facto, you will still be punished for it and only someone extremely wealthy or influential will ever see the SC even judge their case over it.

    Just had a thought, because: "Surely the school would just expell them" but then again public school is a government entity. so that would be a violation of the 1st amendment... but could a private school just expell you for it?

    And the thing is, when kids wear something to express themselves or something deviating from the norm...nobody finds an issue with it, it's always the teachers who find a problem with it and they are the one disturbing and disrupting 🙄

    A problem with that law is that teachers will be spiteful and purposely make it disruptive or distracting by making a fuss about it, its a common tactic in every school and not a single time a student was being actually distracting or disruptive until a teacher took issue with it

      Depends on the item. Paper bag? Definitely yes. Hoodie? No. One of those hats with the spinning propeller on top? 100%. An armband protesting a war? I would say no unless it causes active disruption from students arguing in class instead of paying attention.

      @@escapetherace1943 This was the example when I was in Highschool, if it's able to catch the teacher's attention, and they have the inability to not ignore it, they use that to justify "less developed" brains from being unable to ignore the flashy/abnormal thing, despite it being a great teaching example of keeping focused on your career. Just use it as an example instead of trying to penalize a student for self expression because it "challenges your authoritative stance in the classroom". Most cases that's what it boils down to, a teacher misquotes a school policy, the students (who basically get quizzed on school policy every year) corrects them or finds a loophole, and the teacher takes it as an insult to their leadership.

      1st amendment just means that the government isn't allowed to censor you. But private citizens, particularly your parents have the right to react to speech how they see fit. That's not a violation of the 1st.

      ​Adding onto what@@thelemurofmadagascar9183 said, it was ruled in this case that children keep their 1st Amendment rights when entering a school, meaning that the school board can't suspend or expel you for excerscing them at school unless they're proven to be offensive or disruptive. The way school's determine whether or not to take action is through what's called the Tinker Test.

      When I was in high school, my principal mentioned that at the beginning of the year when your parents sign the emergency card, they are signing away all of your constitutional rights. That's why schools are allowed to search your bags whenever they want even without your consent.

    I think for the most part armbands should be perfectly fine so long as they don't have proven gang symbols or something like a swastika.
    A head covering on the other hand like something that completely obscures your face that I definitely understand that not being allowed in school.

    My home (Vietnam) won the war. And one of the reasons leading to victory was also come from American’s peace protests against the war (Which was one of the reasons forced the White house to stop the war). Many people sacrificed their lives for the victory against the U.S. But now, it’s nice to see the war ended and our relationship developing in peace.

      We (American here) COULD have won, if our politicians weren't deliberately sabotaging us and forcing the people fighting to do things like throw themselves directly into anti-air defenses. But I guess those military contractor CEOs who made far more than the people actually fighting and dying had to feed their families somehow.
      Honestly though, I'm kinda glad we lost. They say it was to stop the spread of communism, but really, it was just a money-making war. I'm glad those students saw it for what it was.

    In my country that would be illegal because we have something called Vermummung Gesetz (Shiring law) which doesn’t allow people to hide their face behind masks or anything. The only exceptions are hijabs
