- A hearing Friday is setting the tables for a final decision over whether Fulton County District Attorney Fani Willis will continue to oversee the 2020 Georgia election RICO case involving former President Donald Trump and others. Attorneys are making their closing arguments on Friday. Attorney John Merchant (Ashleigh Merchant's husband and law partner) is starting things off.

And yet the “highly respected” republican judge , didn’t see that way. The conservative judge (Macaphy) said there was only an appearance of impropriety, but no financial conflict of interest. He suggested a lack of veracity in the testimony but was clear - no evidence of any conflict. Now it diaper Donald chance to clear his name - the convicted rapist is avoiding his courts like a drug cartel gangster - threatening anyone who dare question his criminal empire.
So far it doesn't seem like this Judge is going to do the correct thing 😂

The real conflict here is that Ms. Merchant promised Mr. Bradley a job for his speculations on Ms. Willis and Mr. Nathan relationship. Thus, Mr. Bradley and Ms. Merchant colluded for financial gain in this transaction rather than the case against Ms. Willis and Mr. Nathan. No wonder, Mr. Bradley behaved uncomfortably in court.

Clearly you don’t understand. The threshold for disqualification thus what needs to be proved is for the appearance of conflict. The REASON why the appearance is the threshold is because it’s about the public’s trust in the court system. So if future defendants and jury members are watching they have confidence in the court. Imagine a courts DA be corrupt (regardless of what you this in this case, just imagine) wouldn’t the public be skeptical at jury duty? Maybe people will vote not guilty because they think the DA is corrupt even when all evidence is clear. Anyway, something to ponder

Can I ask - what standard is John Merchant advocating for judging the appearance of misconduct? If it is that they had a romantic relationship, then that would seem to disqualify any two people who have ever had a romantic relationship in the past from ever professionally working together thereafter. If it is that they should have disclosed their relationship to someone at some point while they were seeing each other, then he has yet to say to whom they should have reported their adult relationship and more importantly, if that standard then applies to any District Attorney anywhere who ever has a consenting adult relationship. If it is that they should not lie under oath, which Merchant claims they did, then that argument falls apart because the only evidence he could offer for this was the oral testimony of a woman who had a personal falling out with Willis and whom his team went out and found - in other words, hearsay that they themselves brought forth, which is, again, unsubstantiated by anything else, anywhere, that they have been able to find.

not forget that when we cannot account for money recieved and dispursed cash or not we have to deal with a 3 letter agency. This was the most high profile case of their lives and they treated it like a lemonade stand. That alone says everything about the lack of professionalism, concern, knowledge, and credibility. In fani's testimony, the bias the judge had was clear. As we heard more and more damning testimony, it seemed he quieted down and realized he wouldn't be able to question the obvious truth and keep any air of integrity. Mr. Merchant was right on: How can the state meet the burden of proof AGAINST the very corrupt state officials who DID NOT provide a paper trail (as required) and simply cited alleged cash-only transactions? It's like a referral doctor seeking previous records from a family doctor who either did not keep them as required or simply threw them away. If that is enough to evade fraud then the public would have to kill a lot of officials in order to receive justice and that is a fact. I have been denied many things when an official said that I did not file a certain thing or fill out a necessary form and I had but cannot fight against it if said official tosses the original and I don''t have a copy or can't locate it. The state is no different and no amount of attorneys for any amount of witnesses absolves them of their own rules and laws.

As a lawyer you should be very aware that documentation is extremely important. You pay back with cash? It appears very likely she hired him while being in a romantic relationship. That said if she entered into the relationship after the fact it shows poor judgement AND she hide rather than disclosed the relationship. More poor judgement and very likely an ethics violation. At a minimum they both should be taken off the case.

Even if their relationship began after he was hired (which I don’t believe for a second) they had a requirement to disclose the relationship. Beyond that if (big if) she reimbursed Wade for the trips she should have done it in a way that could be validated.
