      Most 'catch and release' programs are for non-violent crimes to help reduce the massive overcrowding in jails and prisons. This guy's original charges were non-violent, which is why he was released. After avoiding his cases, however, it's less likely he will be free without restrictions as it seems to have been done before.
      If you've never seen the inside of a jail or prison, let me tell you, in a shocking number of them, the conditions are way beyond sub-par. They have too many inmates - some times more than 4x maximum capacity, and we are having a nationwide shortage of police, prison guards, and funding to repair and maintain facilities, some of which, like Ryker's Island, are well beyond 100 years old.
      It's not the court's fault - it's the state and federal government's fault for not keeping up with changes in the criminality rise we've seen in recent decades.

    Legislation all over the country needs to rewrite, update the laws, penalties, and give our judicial system have more teeth. The US doesn’t have enough room in the jails, prisons, not enough Correctional Officers, not enough facilities, not enough police, so all said - it’s our fault we’re in these situations. Criminals are responsible for their choices, actions- but we as a society have to take responsibility for our part.

    A defense attorney bonding out his defendant? Is that even legal or ethical? I know it's Harris County and it's way more lenient compared to other counties in Texas (how else to explain that this defendant was only charged with a misdemeanor instead of a felony family violence count?), but there's no way that an attorney should be allowed to post bond on behalf of a client. I'd love to see a defense attorney try that in front of, say, Judge Simpson...
    And how was this defendant not remanded for violating his bonds in the other cases in the first place? Are the district judges in Harris County that stupid? And this defendant violated his parole with TDCJ? And court cases in Fort Bend?
    And I ask again... HOW WAS THIS DEFENDANT OUT ON THE STREET LAST WEEK TO COMMIT NEW OFFENSES IN THE FIRST PLACE?

    5 OPEN CASES against him... THAT should be criminal! MAYBE bond on a second case, in a very special situation; however, on the third case there should be NO BAIL under any circumstance.
    31 pages of crimes is why we are having a crime epidemic! That is a complete failure of the legal system from protecting society.

    • @gordonduke8812
      @gordonduke8812 Місяць тому +1

      And herein lies both the good and bad of our system. Being out on bond means the case hasn't been heard in court yet. Our system dictates that a person is presumed innocent until they are proven guilty. And that goes for each case against him. It is also a staple idea in our justice system that it is better for ten guilty men go free than to have one innocent man convicted.
      Also each bond must be considered on the merits of that particular case. If some of the cases are violent in nature and the person holds an increased danger to the public, that can be taken into account. These principles are something that each citizen must be able to enjoy, but these principles do tie the hands of the judge at times. That's why they say the wheels of justice turns very slow. I don't like it either, especially when you see a guy like this, but if I were the one being accused of a crime, I might see it a little different.

    • @andycole5957
      @andycole5957 Місяць тому

      @@gordonduke8812 That's all well and good, for when the system was created and trials started immediately and were usually over within a couple days of the original crime, if not the same or next day. We also have a right to a speedy trial; however, I have yet to see charges dropped on a case for the trial not being able to be heard soon enough... So we pick and choose what rights we honor already. It was inconceivable back then that trials would be pushed out for several months, or even over a year. In fact, historically speaking, a common tactic of the day was to jail someone on suspicion of a crime, but not hold the trial, so they could leave then locked up. So our system is already failing to provide what is a "right" (a speedy trial), which is making life worse for all involved. Also courts back then people didn't plea not guilty when their was overwhelming evidence because now we have too many rules and doctrines that are more in favor of procedure than finding the truth; therefore people plead not guilty hoping for a technicality, or worse the DA offers a plea deal even if they have overwhelming evidence just move the case through faster. It's a broken system.
